PIG SHOT AFTER ATTACK ON 3 BROTHERS

The racist dog policemen must withdraw from our communities immediately, or suffer the wrath of the armed people as pig Lawrence Heap did.

"Special" pig Heap, had invaded the Divisadero-Grove St. community of San Francisco Saturday night, February 8, 1971 when he saw three brothers coming out of an apartment building in the 14 hundred block of Grove Street. He alleges that one of the brothers had a shotgun, so he began firing his revolver at them. The brothers' first instinct was to defend themselves against this unprovoked attack. They righteously returned fire, wounding the pig. Fascist dog Heap staggered to a nearby fire hall and alerted the storm troopers all over the city.

Immediately the technological advances of the fascists were put into effect. Within three minutes after the shooting, pig patrol cars were screaming into the community. Within five minutes, the fascists were sealing off a four block square area. The pig helicopter was called in. Its search - light changed the night into day-light as it scanned the alleyways and passageways behind the apartment houses. It dropped down to the rooftops and circled the area for an hour, as nearly 100 pigs occupied the community, pacing the sidewalk, terrorizing the people with their nervous fingers on the triggers of shotguns, high-powered rifles and .357 magnums. Patrol cars raced back and forth, screeching their tires and screaming their sirens. The community was under siege by an army of nervous, paranoid, and dangerous fascist pigs telling people to get back into their houses and away from their windows, and harassing people on the streets.

One woman who lived in the area said she was on her way home from work and the pigs told her that she could not enter the area. It was eleven o'clock at night and she insisted that she had to get home. The pigs finally let her through but it took her thirty minutes to walk two blocks because each of the occupying fascists stationed on the streets ten to twenty feet apart stopped and questioned her although the pigs at the road block had permitted her to pass.

This invasion of the Black community by armed gestapo proved fruitless. The brothers who committed this revolutionary act are free. The people are tired of the fascist pigs coming into their communities bent on intimidation and terror, and the people are rising up against the goon squad lackeys of the imperial fascists. The pigs must withdraw.

THE DOMESTIC WAR

As the fascist armed forces of the American empire invade new territory and step up their aggression in the communities of Southeast Asia, so do they increase their oppression of people inside the U.S. community. In recent weeks the Afro-American, Mexican-American and Asian-American peoples have experienced escalated attacks. Black High school students in Wilmington, North Carolina are currently boycotting their schools in demand for changes in the educational institution.

On February 6th the fascist pigs of Wilmington murdered a Black youth, 19-year old Stevenson Gibbs Mitchell. Fascist authorities in the city had nothing to say about the murder. To them it wasn't even worth a token investigation. The next day, February 7th, a White racist was killed by sniper fire in the Black community. The search and seizure mission that followed this racist's death brought scores of national guards and state pigs armed with machine guns, automatic rifles, and armored personnel carriers into the Black community.

These pigs centered their search on the Gregory Congregational Church where they alleged there was a sniper's nest. When they rushed the front door of the church, the pigs found a custodian and another woman from the community. As the forces of reaction escalate at home and abroad so does the revolutionary armed resistance.

GUERRILLA ACTION U.S.A. 1971

As the year 1971 progresses into its second month, revolutionary activity escalates, both locally and intercommunally.

In the poor and oppressed area of Hunters Point, San Francisco in the United States Community, an explosion rocked the early moring hours of Monday. February 8th For years Hunters Point has been the scene of murders and brutality of Black people by gestapo elements.

However, on this particular night the San Francisco pig department received calls complaining of prowlers, and suspicious men in a car at 1529 Hudson Avenue. After these two initial calls, the pigs didn't investigate extensively because they found out that the house was abandoned. Later however the pigs did respond to a third call stating that screams for help were coming from the two story house. Three pigs staked out the front of the house while three other pigs entered it from the rear. Inside the pigs found a bottle with a lit candle in it. To inform his pig cohorts of the findings, pig William Walsh opened the front door from the inside. At this point, an explosion occurred that blew away the entire front porch and scattered debris and broke windows within a hundred yards.

Pig Don Hansen, a bomb squad inspector said. "If anybody had been standing on that porch and opening the door in a normal way they wouldn't be with us now. There is no question in my mind that this was a plot to kill officers."

LOS ANGELES: WOMAN ARRESTED FOR GOING TO FREE CLINIC TOO OFTEN

The fascist pigs of the Los Angeles Police Department, as well as the other pig forces in Babylon, are trying constantly to hold down the spirit of the people as we wage our struggle for survival in this dying land.

An example of this is as follows: On Tuesday, January 26th at about 3 p.m., a sister named Gloria Rodriquez came into the Alprentice 'Bunchy' Carter Free Clinic (Los Angeles) for treatment of a severe case of epilepsy. The sister was examined by the doctor and was on her way home.

Gloria often comes to the clinic to be treated. On this particular day Gloria left the clinic and was proceeding to her home, when two pigs from the vice squad of the L.A.P.D. stopped her. They told her that since she was always in and out the clinic, she must be a member of the Black Panther Party. They said, after assuming this was so, that they were taking her in for prostitution. They said, also, that unless she would "snitch" on whoever was dealing drugs in that area, they would give her more time. But she didn't bend to their intimidating remarks. Everyone knows how ridiculous this is, because the pig rulers of our communities control all of the drug traffic. And if they really wanted to catch a person dealing drugs, all they would have to do would be to take Nixon's, Agnew's and Mitchell's phone book from their pocket and proceed to dial the dealer on the phone.

Gloria was taken down, railroaded and made to spend a week in the County jail. After she was released from maximum to return to minimum security (the streets), she went to the drug store to have a prescription filled for the medicine she was denied while in jail. A plain clothes pig followed her into the store and began asking her to "date him." The sister knew that this was a pig trying to set her up to be again jailed on the same charges for which she had just served time.

Gloria dealt with this situation by exposing him to the people in the drug store. By doing this, the people were able to see who the true enemies of the people are. One elderly man even remarked that "The pig should be busted for soliciting her (Gloria), instead of vice-versa."

This is only one of the many means the fascist rulers use to try to keep their oppression scheme uptight. But our struggle cannot help but be successful with the masses of people joining together, arms in hand to deal the final death blow to those who have treated the people of the oppressed communities of the world so wrong for so long.

LOS ANGELES: LARRY TOPPS MURDERED BY PIG HENCHMAN

Recently in Los Angeles, another youth fell victim to blind injustice and murder. Larry Topps and two of his partners. Johnny Bryant and McArthur Ballard, approached the Mars Gas Station on Imperial Highway to get some cigerettes. While Johnny and Mack were waiting across the street for Larry to get the cigrattes they heard two shots. Running to find out what had happened, they found Larry on the ground shot in the temple and the shoulders. The bootlicking benchman then turned his gun on Johnny and Mack and told them to back up. Immediately thereafter about twelve L.A. County Sheriff cars drove up and pigs jumped out brandishing shotguns. Not showing any concern for brother Larry by attempting to get him to a hospital, the pigs instead jammed Johnny and Mack up against the wall for questioning and further harassment. A half hour later an ambulance came speeding down the street siren screeming, in an obvious attempt to disperse the growing crowd, Larry Topps was, by this time, dead.

The murderer, John "Bossman" Washington, who lives at 10971 Grape St., works as an attendant at Mars Gas Station at night. Due to his continuous practice of pistol whipping brothers, flirting with young sisters, and arbitrarily pulling his gun on people of the community (carries .38 special with him and has .45 in the office), he has been called "Bossman." The maddog "Bossman" maintains that Larry tried to rob the station and therefore he shot him in defense. Yet the witnesses in the community say that Larry was shot with his hands in his pockets and that he had no weapons on him.

The evidence is clear, the facts are straight, time and time again down through history murder after murder. John "Bossman" Washington murdered Larry Topps. Another pig henchman has slain another member of the Black community. The oppressed people of the community of Watts, of Los Angeles, throughout the worlds' communities, rise up against the intercommunal pig invader in our communities and force him into the sea of death.

OAKLAND, CALIF: DURANT ELEMENTARY SCHOOL RUN BY FASCISTS

Slavery manifests itself in many ways: economically, when greedy businessmen legally and systematically rob and exploit the oppressed; politically, when lying-dog politicians fool the people for their own selfish gains; and, socially when fascist pigs patrol our streets ready to brutalize or murder us to keep us in our place. But also slavery exists when black people are denied relevant education and have to submit to the whims of a madman.

Principal Vern H. Green of Durant Elementary School (Oakland, Calif) is such a madman. The parents of the school children and people from the community are unhappy about the way problems are solved at Durant. Last November the parents of the West and North Oakland Community Supporters Council of Durant Elementary School put out a petition to get rid of racist pig Green.

There are a number of problems that the people have complained about and which this foul pig has blatantly ignored: Most of the instructors at Durant have probational status, which means that the children are being taught by instructors who have little or no experience; Classes are being disturbed by non-parent visitors of teachers who come and go as they please, Yet at the same time, parents cannot visit their own children without a principal's permit and a teacher's appointment: Parents can't transfer their children to another room, when there is a problem between teacher and pupil instead they must transfer the children to another school; There are known cases of childbeating by teachers; Doors are being locked keeping children from using the bathroom, and thereby causing them to go all day with wet pants; Parents can't even use the school building to hold community meetings or activities; the curriculum is considered irrelevant as far as teaching the children about their true role in the world and how to cope with their environment: and there is no cafeteria at Durant, so the children are unable to get hot lunches.

The parents first took these complaints to racist Green himself and demanded that something be done. This pig simply oinked in their faces talking about he'll see what he could do. And, of course, nothing was done.

Ever since Green has been principal of Durant, crucial problems have gone unsolved. He doesn't relate to the community at all and has no communications with us. The feelings of the community about him are mutual. This pig doesn't care what the needs are of the school nor the community, as he goes about his way making decisions that will affect their future, has even come out with statements condemning the Black Panther Party and the community workers at the St. Augustine Breakfast Program. In addition, he has said that we corrupt the children who come to the free breakfast. (In reality the children are learning who their true enemy is and how to deal with this decadent system.)

The parents put out their petition to get rid of Green. Two hundred-fifty signatures were placed on it, and then taken to the Superintendent of Schools, Marcus A. Foster. Foster cold-bloodedly turned it down. This proved to the people that they did not control their school nor thier community. Racist Foster swiftly countered the move of the people to get rid of Green by appointing bootlicking Rev. L.H. Murphy as Director of the Attendance Improvement Program at Durant. This so-called negro at one time pretended to support the parent's demands, while doing volunteer-work for the community. But this traitorous lackey couldn't pass up the pay-off position offered him by "Mastuh" Foster. Now Murphy is vigorously opposed to the parents and their petition. He supports Green and his brand of slavery and has even gone as far as to erect his own program, the Durant School-Community Advisory Committee, to counteract the parents' group. But this is proving negative because no one in the community will support it. The school has given him the biggest room in the building -- a room that used to be a kinder-garten room. Not caring for the needs of the pupils, the school has jammmed the kindergarten classes into a much smaller room, so that Murphy could have the big room to plot out his lies and devious acts to oppress the people.

The contradictions between the pigs and the people have appeared much clearer as we see that our demands are not met and simply ignored. We see that we don't control any institution in the community, nor can we get our needs fulfilled. We see that the pigs who run the system are our sworn enemies, because their interests are to oppress the people.

We will not toler are the madness of these criminals controlling our communities nor compromise one lota on our quest for total freedom. The people will move against pigs like the Greens, the Fosters, and the Murphys and rid, this filth from the face of the earth. Because the people are realizing more and more that the only way to gain freedom is to liberate it with the blood of the oppressor.

REVOLUTIONARY INTERCOMMUNAL DAY OF SOLIDARITY FOR BOBBY SEALE

As can be seen from the following reports, the people of the communities of the world are aware of what is occurring in the community of North America, even though the establishment media tries to mislead them.

Not only are they aware, but they have decided in the true spirit of revolutionary intercommunalism to speed up the process of having our communities no longer existing as dispersed communities under seige, but to form one world liberated community.

Their first move in this direction is their realization of the importance of the Vanguard of the American Revolution, the Black Panther Party, and therefore understanding the importance of saving Chairman Bobby Seale from the electric chair.

March 5th, 1971, has been declared Revolutionary Intercommunal Day of Solidarity for Chairman Bobby Seale. Demonstrations and manifestations will be held in Germany, England, Belgium, Italy, France, Denmark, Sweden and the Netherlands. In those communities where the people are engaged in active warfare their support will be in different forms.

American imperialism no longer has anywhere to run or anywhere to hide. Its true aggressive, vulturistic and barbaric nature has become known to everyone on the planet earth, whether they be in liberated communities or communities under seige.

The farcical trial that exists in New Haven, Connecticut, where Chairman Bobby Seale and Sister Ericka Huggins are being tried for murder must not be allowed to continue.

If the rest of the communities of the world can recognize their responsibility, why can't we here do the same. The Black Panther Party says Chairman Bobby Seale and Sister Ericka Huggins will not go to the electric chair. They will and must be freed to take their rightful place in the community where they belong. However, we need the support of the masses of the people. You are also on trial for your lives, your children's future, the future of all mankind.

BOBBY SEALE AWARDED DANISH HIGH SCHOOL PEACE PRIZE

The Danish High School Association, an organization of 32,000 students elected Bobby Seale, Chairman of the Black Panther Party to receive their Peace Prize for 1970. The reasons given for having chosen Chairman Bobby were both political and humanistic. Having seen and heard Chairman Bobby Seale in Denmark, the Danish students had an opportunity to learn something of the oppression, exploitation, racism and fascism that exist in the U.S.A.

The following are excerpts from their declaration:

"By demanding the release of the political prisoner, Bobby Seale, we refuse to accept the way the so-called democratic governments treat the minorities whose right it is to fight for freedom, and whose lives are supposedly guaranteed by independence declarations and constitutions.

"Bobby Seale is elected because his situation is typical of one who lives in a country whose constitution is supposedly ideal for all societies in the "free world." He is an example of all peoples fighting for their rights and a decent life… We fully endorse "Free Bobby." The money given with this prize should be used by Bobby as he sees fit. We look upon his trial as a showcourt and realize that it is impossible for him to receive a fair trial.

We intend to ask the Danish-T.V. in the U.S.A. to keep us informed with upto-date information on this case.

CREATION OF THE BOBBY SEALE INTERCOMMUNAL TRIBUNAL AGAINST AMERICAN IMPERIALISM, FASCISM AND RACISM

Preparations have started for the organizing of the Bobby Seale Intercommunal Tribunal which will be held in Stockholm, Sweden in the later part of March. The exact date will be announced in the near future.

The primary reason for this tribunal will be to expose to the world the U.S. government's attempt to legally murder Chairman Bobby Seale. At the same time testimonies against American barbaric and criminal activities throughout the world will be heard.

Writers, scientists, attorneys of political prisoners in Europe, in particular Spain, Greece, Portugal, France and Italy will take part.

Representatives from liberation fronts of the oppressed communities of the world will also testify against the direct or indirect effect of American imperialism on their just struggles for liberation.

American imperialism will be exposed for what it is--the No. 1 oppressor of all mankind on the planet earth.

EXCERPTS FROM A LETTER FROM ERICKA

ONE DAY JON CAME HOME WITH A PANTHER PAPER. HE WAS SO EXCITED. THE WHOLE TIME WE HAD LIVED THERE, WE COULDN'T FIND OUT ANYTHING ABOUT THE PARTY-- DIDN'T EVEN KNOW WHERE THE OFFICE WAS. THEN THIS BROTHER SOLD HIM A PAPER: HE INVITED US TO ONE OF THE DANCES WE USED TO HAVE AT THE BLACK CONGRESS BUILDING.

AFTER WE CAME THROUGH THE DOOR TO PAY OUR $.50, WE WENT ON IN AND MET A FEW PARTY MEMBERS, THEN THIS SKINNY DUDE CAME OVER TO US AND TOLD US TO COME INTO THE LITTLE OFFICE THEY HAD THERE. THIS MUST HAVE BEEN LATE FEBRUARY, 1968.

THAT NIGHT I SAW THE FIRST CONFRONTATION WITH THE PANTHERS AND THE PIGS. A LOT OF THE REAL OLD L.A. PARTY MEMBERS WERE THERE LIKE RONALD AND ROLAND FREEMAN. A BROTHER OR TWO GOT ARRESTED FOR STEPPING OFF THE CURB OF THE SIDEWALK ONTO THE STREET, SEVEN PIG CARS WERE THERE AFTER TWO MINUTES. IF IT HAD BEEN A MURDER OF A BLACK MAN, THE PIGS WOULD HAVE TAKEN TWO HOURS TO APPEAR. THE PIGS STARTED BY INTIMIDATING THE BROTHERS FIRST. THE PIGS SHOVED THE BROTHERS IN THE CARS. WE ALL FOLLOWED THE BROTHERS TO THE PIG STATION, 77TH, OF COURSE. WE STOOD OUT THERE A LONG TIME WAITING TO HEAR WHAT THE PIGS SAID THE CHARGES WERE, ABUSING A POLICE OFFICER OR SOME SUCH MADNESS, ONE OF THE BROTHERS TRIED TO CONTROL THINGS BUT NIGGAS WAS MAD… MAD BECAUSE OF RACIST PIGS INTIMIDATING US FROM THE ROOF OF 77TH, MAD BECAUSE IT WAS SATURDAY AND NIGGAS WANTED TO GO HOME, MAD BECAUSE THE BROTHER WAS TELLING THEM TO COOL OUT WHEN IT WAS AMERICA WHO NEEDED TO BE BROUGHT TO A HALT. THE BROTHERS EVENTUALLY GOT BAILED OUT BUT WHEN THEY DID THEY REALIZED THEY HAD TWO MORE COMRADES.. ME AND JON.

I DON'T HAVE TO EXPLAIN THAT WHOLE FEBRUARY '68, BLACK CONGRESS SCENE… KARENGA/ BLACK POWER PIMPS/ PIGS/ LACKEYS/ MAYOR YORTY… ALL OF THAT. BEST THING ABOUT THE WHOLE SCENE THERE WAS FOR ME WAS WHEN I FIRST MET BUNCHY… HOW CAN WORDS EXPRESS IT? I WAS SITTING IN THE OFFICE. HE HAD JUST GOTTEN OUT OF JAIL (AND WASN'T SUPPOSE TO BE HANGING AROUND THE OFFICE). HE WALKED IN, SILENCE. HE WAS REAL DISTANT FROM EVERYBODY, BUT NOT CONDESCENDING, JUST SORT OF OBJECTIVELY VIEWING THINGS, HE COULD DO THAT WITH HIS EYES. THOSE EYES. I DIDN'T DO ANYTHING, COULDN'T BUT LOOK, AND I SAW IN HIM ALL THE THINGS THE STRUGGLE MEANT, THE STRENGTH, THE POWER, THE ARROGANCE, THE (RESIDUAL AFRICAN) POLISHED WAY HE DRESSED WAS THE PRIDE OF THE BLACK MAN FIGHTING FOR FREEDOM --FOR US ALL TO DETERMINE OUR OWN DESTINIES. I FELT AS IF I SHOULD HAVE BOWED INSTEAD OF SAYING HELLO, I NEVER RESPECTED ONE MAN SO MUCH, AFTER THAT YOU COULDN'T HAVE KEPT ME FROM STRUGGLING UNLESS YOU CUT OFF ALL MY LIMBS AND TORE OUT MY TONGUE AND THEN I WONDER I BUNCHY NEVER ORDERED ME TO DO THIS OR THAT THEN, HE DIDN'T HAVE TO. HE JUST LOOKED AND STROKED HIS MUSTACHE AND MADE YOU FEEL LIKE RIGHTEOUSLY WORKING, LAYING YOUR LIFE ON THE LINE. I DID FROM THAT DAY ON.

PEOPLE CAME AND WENT. THE TRAITORS WHO TESTIFIED FOR THE MOCLELLAN COMMITTEE, LARRY AND JEAN POWELL INCLUDED, BUT A FEW STAYED ON. THE HARDEST WORKERS WERE RONALD, FRANKO, ROLAND, LIL' TOMMY WHO BUNCHY LOVED AND WHO LOVED BUNCHY; ROBERT LAWRENCE, STEVE BARTHOLOMEU. OUR WORK COULDN'T HAVE BEEN TO CONSTRUCTIVE THEN THOUGH BECAUSE WE DIDN'T HAVE THE MONEY, CARS, OR LOCATION ADVANTAGE TO GET TO THE MASSES OF PEOPLE. THE BLACK CONGRESS BUILDING TRIED TO PUT RESTRICTIONS ON US TOO.

THEN ELDRIDGE… HE CAME DOWN FROM UP NORTH TO SPEAK TO THE CHAPTER. I'LL NEVER FORGET THAT EITHER. THE WAY HE BLEW THOSE BLACK CONGRESS FOOLS AWAY THAT NIGHT, INCLUDING KARENGA. HE WAS MOSES, KATHLEEN WAS WITH HIM AND LIL' BOBBY TOO, I THINK, HE SAID SOMETHING LIKE HE WAS PROUD OF THE WORK WE WERE DOING BUT THAT WE HAD TO GET OUT OF THERE -- QUICK! WE DID.

THAT WAS A TURNING POINT IN L.A. PARTY HISTORY, I THINK BECAUSE WE BEGAN TO OPEN UP OTHER OFFICES… 80TH AND BROADWAY, THE WEST SIDE, COMPTON, BUT BEFORE WE LEFT THE BLACK CONGRESS, LIL' BOBBY WAS KILLED. BURNING OF COMMUNITY CENTER IN LOS ANGELES

Uncle Toms, bootlickers, informers and generally reactionary forces in our community have proven to be a more than adequate tool to benefit the oppressors in their attempts to stifle and hopefully stop our just struggle for freedom. The actions of these pig agents, hired and paid by the oppressor himself, must be seen for what they are - roadblocks and attempts to put brakes on our struggle toward freedom: in other words, actions counter to the revolutionary goal of the people.

Early Saturday morning, February 5, 1971, the Black Panther Party Community Information Center at 2136 East 113th Street, Los Angeles, which Center has for over a year endured continuous harassment and unsuccessful attacks at the hands of the Los Angeles Police Department (i.e., harassing children attending the free breakfast program, brutalizing and threatening community workers, even paying someone to crawl through a window in the middle of the night, when the Center was empty, to assist the pigs' entry for the purpose of carrying out an illegal search for weapons) was deliberately set afire and the contents wantonly ripped apart and scattered to the winds.

The L. A. P. D. with the assistance of the pig Fire Department spent four to five hours destroying the Center. This was not done because the Center held a "cache of weapons", or was "fortified with sandbags" as the fascist news media reported, but because our survival programs were successfully serving the basic needs of the community in the Watts area. The pig press also reported that the fire in the one-story frame building," once a house, converted to a sandbag fortified office of the Black Panther Party", was "put under control" in 15 minutes. But, in addition to the pigs" destroying the building, they confiscated a typewriter, the daily telephone logbook and two purses belonging to community workers. They did this in the disguise of being "just firemen".

The Community Center was not a house converted into an office. The Community Center functioned as the nucleus for revolutionary activity throughout the community, particularly the nearby Imperial Courts Project. There were no sandbags, no paramilitary fortifications, as the media attempted to project. Revolutionary activity was manifested in the Free Hot Breakfast for School Children, held there from 7:00 to 9:00 A.M. every weekday, and the day-to-day assistance given to the people housed within the minimum security prison of Imperial Courts.

The destruction of our Community Center, which housed the Free Breakfast Program and served as a point for disseminating much-needed information to the people, is not only an attack on the Party but more importantly an attack against the very lives of the Community, particularly the Youth.

We now call upon the community to seek out all reactionary and counter-revolutionary elements attempting to set back our revolutionary progress. In the past, these reactionary elements have been allowed to remain in our community after committing lowlifed acts against the Center and the People. But, their presence can nolonger be tolerated. It's necessary now to seek out these reactionary forces and destroy them, because it will give the oppressor one less tool to work with, making him weaker, while at the same time strengthening our task of liberating our communities from the empire of oppression.

Our survival programs in the Watts area will continue. The destruction of a frame house will not stop revolution. The flames of resistance still burn and will continue to burn until freedom is ours.

RUCHELL MAGEE SPEAKS OUT

WHY IS JUDICIAL SYSTEM SO BENT ON APPOINTING RUCHELL MAGEE A LAWYER?

This question is tantamount to the oppressive status of all poor people, who are constantly commingling (comblining) with the judicial system. The answer is likewise of utmost importance in chronicles of judicial proceedings now and to come.

Very succinctly put, the judicial system is fighting Magee's right to represent himself, because for many years they have been allowed the privilege of sweeping all unwanted and unexposed dirt under the legal carpet by the ploy of using a (lawyer) broom Barrister. Magee knows of this ploy by his direct experiences the past 15 years, and the related experiences of others.

This judicial system knows it's a pig sty - that only breeds other pigs through use of verbal trickery and other elandestine techniques to keep the masses of the people ignorant to the law they are attempting to obey.

In many cases where prisoners (slaves) are held in slavery (prison) they approach the court and request an attorney which the court will refuse to appoint or appoint a hatchet man which the slave will not accept. Then the court will demand that the slave represent himself, which the court knows the slave is not qualified to do. Because most slaves know no law, and a few don't Intelligently comprehend the english language.

Yet a system so dedicated to the preservation of rights forces an indigent, illiterate class to represent themselves, knowing full well they are not qualified to do so.

Now comes Ruchell Cinque Magee, who has been and is now in abject slavery. He is fully qualified to represent himself, and this fact has been acknowledged by the justice dispensers. But why do they still fight Magee? Why is there such silence on the fact that Magee has petitioned for the impeachment of President Nixon, Governor Reagan, Federal Judge Zirpoli, Marin County judges Wilson and McGuire, and appeal judge Winslow Christian; ex-Attorney General Lynch, and Deputy Elbert Harris? Why the silence on the issue of removal? Is the silence because the issues are frivolous or is it because they are true, and the judicial system wants these issues kept hidden from the people, as no one will doubt the judicial system is looking for any error to discredit Magee's facts.

Or is it because upon inspection of some of the many documents filed by Magee, and the court orders denying same, would convince any open, fair-minded person that the entire judicial and prison systems are practicing slavery under color of law without legal authority"?

Or is it because the judicial system has investigated Magee's case and knows beyond any doubt that he is innocent and has spent the last 15 years, excluding a few months, in prison - SLAVERY FOR CRIMES he didn't commit?

Or is it because Magee filed "petitions for removal" to the federal court, not only exposing the slavery he is in, and has been in for years, but also exposing the fraud indictment and conspiracy to murder him and Angela Davis?

THE SHALLOW GRAVE OF REMOVAL

The answer to these questions and more lie in the shallow graves, marked "petition for removal - Ruchell Magee vs. L.S. Nelson, et al; and petition for removal - Ruchell Magee and Angela Davis vs. judge J.G. Wilson, et al." Now that the excavation of the corpse of removal is completed, an autopsy must be performed - to ascertain why did the judicial system attempt burial.

In the first removal Magee presented that he was prevented from enforcing his rights in the state courts, as the prison warden and state courts had conspired to charge him with a murder, they knew the warden ordered his agents to commit. Magee further shows he is denied and/or cannot enforce rights in the state courts which the constitution guarantees to all citizens.

The facts and law of the first removal petition were totally disregarded and ignored by federal Judge Zirpoll, who at this very moment is falsely maintaining and concealing the allegation therein. To insure that his acts remain hid, refuses (contrary to law) to allow his adverse decision to be appealed to a higher court. (see Magee vs. Zirpoli. United States circuit court - now pending)

During the interval of the first and second removal petitions judge Willson, McGuire, Christian and others have, in absence of all jurisdiction, gagged and shackled Magee for making lawful objections. Then lied that Magee (1) didn't know law; (2) had an I.Q. of 75; (3) could neither read nor write; and (4) had struck attorney A. Leonard Bjorklund. Each of these lies were proven to be false, and a stratagem to force a shyster lawyer upon Magee.

The facts of this case are a precedent in law, for a judge to gag, shackle and chain a defendant for making proper legal objections, which he is required to do by law, and then attempt to paint him a moron - and thereafter force upon him a lawyer, under the guise he is not qualified to represent himself. (Now who's incompetent)?

There is no doubt that the state court was without jurisdiction to act because of the removal petition in federal court. The law is well settled that a removal petition pending in federal court prohibits the state from all proceedings, until it is properly remanded, if remanded.

U.S. PRESIDENT NIXON IGNORES JUDICIAL RACISM

Magee appealed to President Nixon, prior to and after August 7, 1970, pleading with Nixon to intervene in his flagrant racism SLAVE case, because of the state and federal judicial racism. Thereafter, Nixon, through the use of his office, used the national radio and news media to influence and bring about the murder of Magee and Angela Davis, in that Nixon made certain statements (December 14, 1970 or about), concerning the "guilt" of Magee and Angela Davis, which Nixon knew were false, and made for the sole purpose to aid and abet and perpetuate with his consent and sanction, and help, the conspiracy to murder Magee and Angela Davis. As though they are trying to turn back the judicial clock a hundred years and restore racism in our law.

Instead to hear them (pigs) explain it, they are genuinely concerned about "crime in the streets", and they (klan pigs in office) are absolutely against SLAVERY.

In that to some degree SLAVERY has always been outlawed and condemned on the outside, by the hypocritical mockery of chattering (Nixon's) -- lips; but on the inside of people and prisons, where slavery is imbedded and proudly displayed as a western way of life and a privilege by god himself, slavery is condoned on all of its numerous levels. One can see that here on the inside is where slavery takes its toll, and is daily perpetrated by the perpetual deeds and actions of unjust people. Be it collectively or individually, slavery is all the same, an exploiting and oppressing sickness locked on the inside of the imbecilie minds and nefarious hearts or decadent body of the sons and daughters of Abraham Lincoln, Jesse James, General Custer, Al Capone, Adolf Hitler, the ku klux klan, and the past and present slave masters.

HIDING SLAVERY SURROUNDING THE CASE

The klan media is attempting to color Magee as a hideous, ignorant moron, to hide the fact that Magee is in slavery, Slavery is a forced condition of servitude and in this instance presented as law. To hide this and keep the "Magee the Moron" propagandized image before the people, the warden, with membership in and assistance of judge Wilson's gang, is holding Magee incommunicado. Because they don't want exposed how not only in the past seven years has Magee been brutally beaten by both police and prison officials for trying to expose his case.

But also how - 15 days after Magee was shot and underwent major surgery, he was placed in a filthy vermin-feces invested stripcell, which had no plumbing facilities, except a "hole" in the floor for in which to urinate, and to hunch down like a dog to deficate - and a solid slab of concrete upon which he was to sleep. Every morning for months after he was shot, Magee had to get another convict to help him out of bed, so he could try to eat the cold restricted diet, shoved through a hole in the bars to him. His repeated requests for medical care were denied. And if it had not been for a doctor at the Marin County General Hospital refusing to allow prison officials to move Magee, he would have been buried by now. It is the facts of acts like those stated above that the judicial system wants hidden.

Anyone with an ounce of brain favors life to death. Can any rational thinking person honestly believe that Malcolm X. Martin Luther King, John and Robert Kennedy. If they had, had prior knowledge of the exact moment of the assassin's bullets arrival would have waited? We all know the answer to that question is an unequivocal NO.

Yet, no one gives Magee credit for the genius he is. He saw the arrival fast approaching that fatal exact moment. Magee has only done what any other sane person would do in like circumstances. It is undisputable that Magee is in the slave camp for a crime he did not commit. It is further undisputed that he has sought in every court in the land to obtain freedom. (courts of jurisdiction).

Nor is it disputable that when a long train of abuses (7 years of klan racist court denials) and usurpations, pursuing invariably the same object evinces a design to reduce Magee to absolute slavery; it is his right, it is his duty to throw off such abuses and slavery by any means necessary, and to provide new safeguards for his future security.

Instead of being charged with a so-called crime and the attempts to put him in the gas chamber. Magee should be paid homage for exposing the illegal slave government.

The federal and state judges seek to hide the removal proceedings, nor will they search the petitions for removal of any of Magee's records to find out whether or not Magee is illegally enslaved. Because they and the news media have spread false propaganda of the August 7, 1970 SLAVE REBELLION. The question in this paragraph is:

Why the news media never publish information about the 10-minute conference between Magee, McClain, and those 12 jurors, where it was declared that:

(A) Magee has been in prison for 7 years on known fraud evidence, and perjured testimony;

(B) Magee was and is so illegally enslaved, the courts have falsified transcripts, and denied him the right to have and buy a copy of his trial records; and

(C) The prison officials hold him in slavery, secretly stopping his mail and hiding the body -- etc.

Why the silence on what was given the jury to give to the public, about Magee's ILLEGAL SLAVE CONVICTION? -- We tell you why!

Because regardless of circumstances, cruel and unusual punishments are being inflicted. While all along no eye pities, and no hand helps. All in all which amounts to nothing more than SLAVERY. In that anytime one pig (Nixon's so-called good people) is knowingly or unknowingly deprived of any right, it is considered cruel and unusual punishment. While on the other hand, if and when a Black person in America is knowingly or unknowingly deprived of a right - that Black person catches more "hell" trying to get justice, than was perpetrated against him in the deprivation of the right. Even while Magee trys to expose the flagrant racism existing in the Amerikkan executive, judicial and prison system, the klan news media attempts to label him as a person not responsible. Such propaganda is often used by the pigs to hold Magee up to public ridicule, because Magee seeks to expose the judicial and prison system of racism which is rotten to the core.

WE WILL CONTINUE OUR REVOLUTIONARY WORK UNTIL WE BRING THE PRISON WALLS DOWN

One of many in the series of judicial farces (sometimes called "fair trials") is currently going on in Oakland, as four of the brothers involved in the April 6th, (1968) shootout (In which Lil Bobby Hutton was murdered by the Oakland pig Dept.) stand trial. Wendell Wade, John L. Scott, Donnell Langford and Terry Cotton are being quietly railroaded to prison because they were surviving victims of an unprovoked attack by racist Oakland pigs. Each brother has 2 counts of attempted murder, and 2 counts of assault with a deadly weapon: each count carries the sentence of one to fifteen years in prison.

The majority of the "Witnesses" (who really are assassins) are pigs who participated in the shootout. The judge is about the only one concerned with maintaining the smokescreen of "justice for all". He tries to cover up the obvious lies and trickery with a smile and a legal argument, as the D.A. and the pig witnesses blatantly lie, consult and coach each other (In testimony), refuse to subpoena necessary witnesses for the defense, and constantly lose or "misplace" important statements and evidence.

The star of this legal circus is D.A. Vakota who prances around the courtroom like Perry Mason (T.V. lawyer) and mumbles legal language when he is unsure of himself. He dramatically presents so-called "evidence" to create certain effects upon the jury. He refers to weapons alleged to belong to the defendants as "Viet-nam guns." He reminds the jury (at every opportunity) that he has already railroaded Charles Bursey and Warren Wells (also for the April 6th shootout), so therefore, these brothers must be given the same "justice". He continues to try and set the stage for his pre-planned railroad of Chief of Staff, David Hilliard, (also for the April 6th case) who is to be tried next (no date set as of yet). He does this by introducing so-called "evidence" regarding David, who is not involved in this particular trial and who has no lawyer present to dispute the statements which are being introduced into the transcript for use in David's trial.

The jury is composed of non-peers (people not from the same economic or social background as the brothers on trial). They sit there and willingly lap up the lies of the pig witnesses. There are eleven White people and one Black person (a retired, ex-Army sergeant) on the jury. So that they won't be made aware of the brutal assassination of Lil Bobby, it has been stipulated that no mention of him (Lil Bobby) or the actual murder can be made in this trial as it is "immaterial" to this case.

And so, each morning Wendell Wade, John L. Scott, Donnell Langford and Terry Cotton are forced to sit through this legal railroad and wait for their conviction. As Wendell puts it, "Being incarcerated in the concentration camps obviously isn't desirable, but I have come to see it as an important front, a necessary and sometimes desirable area of work". And this is where they will continue their revolutionary work until we can bring the walls down to FREE ALL POLITICAL PRISONERS.

JUAN FARINAS DEFENSE COMMITTEE PRESS RELEASE

New York, Dec. 13 -- Juan Farinas was convicted on three counts of violating the Selective Service Act after trial on December 10-11 in Federal District Court here. An appeal is planned to the U.S. Court of Appeals.

The charges derive from an incident which took place in the summer of 1968, when Farinas attempted to distribute leaflets opposing the war in Vietnam to his fellow inductees.

He was charged on five counts, three of which were consolidated into one, charging failure to cease and desist from speaking, distributing leaflets, and unruly and boisterous behavior. The other two charges were hindering and interfering with the Selective Service System and refusal to report and submit for induction. At the time of the incident Farinas was a member of the Progressive Labor Party. He is now supporter of the Workers League.

In U.S. Federal Courthouse in Manhattan on January 29, Juan Farinas was sentenced to two years in jail and bail was set at $5,000.

At the sentencing the nature of the government's attack was once more being clearly expressed in the courtroom. Farinas' attorney, Sanford Karz, began by explaining that the defendant had engaged in conduct protected by the First Amendment. He had sought to express and explain his opposition to the war. Had this taken place outside of the induction center he would have at most been charged with disorderly conduct and given a suspended sentence or 15 days. Katz asked the court to hand down a suspended sentence and place the defendant on probation. The government's response to this statement showed again the conscious nature of this prosecution. U.S. Attorney Truebner pointed out that Farinas was a Cuban national who had "bit the hand that fed him." He said that the defendant had not shown proper gratitude towards the government, that he should not be paroled but should be held without bail pending appeal. "We have here a Spanish speaking individual," said Truebner. In the eyes of the government this made the defendant more untrustworthy and dangerous. The defendant had applied for permission to travel to other parts of the country, he had many friends, he might disappear, and his speech to the court indicates that he could be a "danger to the community."

Judge Pollack agreed with most of this vicious diatribe against the defendant. He dismissed the defense objection that the prosecutor's statement was a politically motivated attack. He rejected the request for a suspended sentence and probation on the grounds that the defendant showed no repentance, that his statement showed no change or intention to change.

Juan's Statement To The Court:

Today I stand before you to be sentenced for passing out a leaflet against the war in Vietnam. Your government must punish this action, which was completely legal and constitutional, which was a clear and practical expression of my constitutional right of freedom of speech because your government fears the growing movement among workers and youth in this country.

At the trial both the court and the prosecution stated that neither the war in Vietnam nor my political views had anything to do with the trial. But I say that not only did they have something to do with the trial THEY WERE THE CENTRAL QUESTION INVOLVED IN THE TRIAL.

I say that I am being sentenced not for any "criminal" or "illegal" behavior but for my political views, for my opposition to the war in Vietnam, for my being a socialist and for standing up and fighting for those principles. I say that I'm innocent of the charges on which I was convicted and that you had to twist your own laws, you had to take off your pretenses of "impartiality," you had to charge the jury the way you did so as to be able to convict me, so as to be able to justify the criminal war in Vietnam.

You and your government may brand me as a "criminal", but let me tell you this right now, no matter how much you may try to do it, in my eyes and in the eyes of millions of working people and youth in this country and around the world, YOU ARE THE CRIMINALS!

It is your government, not me, which has dropped millions of bombs over Vietnam. It is your government, not me, which during the last fifteen years has waged a murderous war against the workers and peasants in Vietnam. It is your government, not me, which right now is breaking all international laws and sending "civilians" in "private helicopters over to Cambodia. It is your government, not me, which has unleashed a barbaric, illegal and criminal wave of terror against the Black Panthers, militants like Angela Davis and all those who fight against this system. And last but not least, it is your government, not me, which right now is preparing to launch the greatest attack ever seen against the living standards and conditions of workers and youth in this country.

But Nixon and Agnew are not going to find it easy. Already there is tremendous and growing opposition on the part of American workers and youth against the economic attacks already launched against them. It is that growing movement of the working class and youth that you fear. I welcome it and on that basis I intend to continue this fight and appeal this conviction to higher courts.

“TODAY IS ALL THOSE DAYS TO ME” RAYFIELD RENE JOHNSON -- FRAMED FOR BEING BLACK

ST. LOUIS, MO. (LNS)-- One morning in September, 1969 Rayfield Rene Johnson, 22, years old, was on his way to work, He was stopped suddenly by a woman who pointed him out to a policeman stationed nearby. Johnson, Black, a drummer and a poet, was arrested without further ado and charged with a rape which had occurred at least a month earlier in the summer of 1969.

A day or two later, Rayfield Johnson was released on $2,500 bail, $250 of which he was required to post in cash. He hired a lawyer and awaited his first trial. Johnson was taken totally by surprise by the charges brought against him, and according to friends felt that the prosecution caused the postponements due to a lack of evidence. The time stretched to the spring of 1970, Johnson ran out of money and stopped paying his lawyer.

On June 14, Johnson was standing in front of his apartment at about 1:00 a.m. A police car pulled up, questioned him, and then arrested Johnson on a charge of burglary of the premises, where no burglary had occurred. He was placed in a police line-up at the precinct station that night, picked out by Mrs. Nancy P. Stock and charged with a rape which occurred the morning of April 1, 1970. According to friends who were with him at that time, Johnson spent that morning at home. Bond was set at $20,000 this time, the $2,000 necessary has not been yet raised.

The trial which had been postponed several times from the previous fall was scheduled for the following day. Johnson could not appear, as he was still being held in the City Jail for the charges of burglary and rape levelled the night before. It was after being moved to the City Jail the night of June 14 that Rayfield Johnson was beaten and received a head wound which required fourteen stitches. By not appearing in court the next day, he forfeited the bond which he had posted in the fall of 1969.

Due to a lack of funds, Johnson was assigned a court appointed lawyer who has done little other than implement a transfer of Johnson from the City Jail to the State Hospital at Fulton, to undergo a period of psychiatric evaluation. Johnson writes from Fulton that it is cleaner and the food is better there, but this transfer is not doing anything to change the outcome of his case. He faces a 99 year sentence for the second charge of rape.

Johnson has now been in jail since the night of June 14 with no prospect of being released on bail unless $2,000 can be raised by friends. No definite date has been set for a trial for the second charge of rape. The period of psychiatric examination has yet to yield a judgement on Johnson's "sanity." If he is found simultaneously insane and guilty, he will have to serve his sentence in mental institutions. He maintains that he is both innocent and sane.

This is neither a surprising or an unusual situation for a Black man to find himself in, here in St. Louis or elsewhere. It is unlikely that a white man would have been subjected to a false arrest for burglary or for rape on the "evidence" which is being used to hold Johnson.

NIXON PUSHES INDOCHINESE WAR INTO LAOS

The PRG (Provisional Revolutionary Government) in Paris has today issued an appeal to the students and youth conference in Ann Arbor, Michigan and to peace loving people throughout the world to initiate firm, broad and immediate action including massive street demonstrations to condemn U.S. aggression in Laos and to check new plans to invade Cambodia, Laos, and North Vietnam. The PRG confirms that as of February 4, 1971 tens of thousands of Saigon, Thai and American troops have crossed into Laos with motorized vehicles. More than 20,000 Saigon paratroopers, Marines and rangers are involved. At least two regiments of the 3rd infantry division of the puppet Thai army have gone into Laos, in coordination with the puppet army of Laos. The PRG asserts that U.S. ground troops, and not just American advisors are involved and that round the clock bombing to support the ground troops is being carried out by the U.S. Air Force in Laos. This military aggression is the first stage of a still larger aggression being planned. The PRG says that the apparent U.S. plan is to invade all of Indo-China, including Laos, Cambodia and North Vietnam and that 10,000 U.S. troops are now massed on the Laotian border.

The PRG urgently calls on the people of the world to condemn this new escalation of the war and to take actions now that could check the plans for even greater escalation about to occur. The PRG states that there is a world wide news black out on this military escalation and that the American people must bring this news to their communities through every available channel.

ENEMIES OF THE PEOPLE

The Black Panther Party denounces the counter-revolutionary actions of jackanapes Connie Matthews Tabor, her husband, Michael Cetewayo Tabor and Richard Dharuba Moore, which have jeopardized the lives of the Minister of Defense and Supreme Commander of the Black Panther Party, Huey P. Newton and Chief of Staff, David Hilliard, dealt a serious blow to Revolutionary Intercommunal Solidarity Day for Bobby Seale, and caused Joan Byrd and Afeni Shakur to be thrown back into maximum security, jeopardizing the entire outcome of the New York 21 trial.

Connie Matthews Tabor was the primary person responsible for coordinating Huey P. Newton's current East Coast speaking tour to mobilize support for Bobby Seale and Ericka Huggins, currently on trial for their lives in New Haven. The day before she left, Bobby personally asked Connie to testify in his behalf.

On Friday, February 5th, Huey spoke to a group of Black Student Unions at New Haven College. After the meeting, he left for Boston. At this point, Connie Matthews Tabor slipped away with her husband, Michael Cetewayo Tabor, and Eddie Jamal Josephs. Connie Matthews Tabor never communicated again with David Hilliard or Huey P. Newton. She took with her details of the Supreme Commander's speaking tour and stole the European contacts necessary for Revolutionary Intercommunal Solidarity Day, March 5th. These acts could severely jeopardize the mobilization campaign in support of Bobby and Ericka. The East Coast speaking tour and Revolutionary Intercommunal Solidarity Day are key parts of the strategy to defeat the government's plan to put Bobby and Ericka in the electric chair.

The Black Panther Party urges all intercommunal friends and solidarity committees to contact directly Huey P. Newton and Eldridge Cleaver so that Revolutionary Intercommunal Solidarity Day will be a success despite the plans of Connie Matthews Tabor to sabotage it.

If Connie Matthews Tabor has the audacity to contact our intercommunal friends or solidarity committees, contact Black Panther Party Minister of Information, Eldridge Cleaver, immediately.

On Monday, February 8th, Michael Cetewayo Tabor and Richard Dharuba Moore failed to appear for another session of Murtagh's "circus". By their deserting their comrades, they gave the pigs an excuse to throw Joan Byrd and Afeni Shakur, four-months pregnant, back into maximum security. They jeopardized the chances of the other brothers getting bail and they propped up the dying case of pig Phillips against the New York 21. They fled just at the time that the prosecution was finishing parading its pig witnesses on the stand, showing to the world the frame up they were perpetrating to keep the brothers in jail and the flimsiness of this show-case trial whose purpose is to justify pig Mitchell's attacks on the Black Panther Party.

The fact that the incarcerated members of the New York 21 were expelled from the Black Panther Party for their attacks on the Party in their letter to the Weatherman 1 can in no way justify the dirty actions of these dogs, Moore and Tabor toward their "comrades". This vicious, back-stabbing act of Moore and Tabor dwarfs the differences between the New York 21 and the Black Panther Party. The lowest circle of Hell is reserved for those who betray their comrades.

The fact that Connie Matthews Tabor left the Black Panther Party without regard for the importance of the mobilization campaign and that Michael Cetewayo Tabor and Richard Dharuba Moore joined her at this time without regard for the fate of their comrades in New York, shows the low-natured individualism, insensitivity and scheming minds of these jackanapes.

The fact that Michael Cetewayo and Connie Matthews Tabor executed their plan of disappearing immediately after a public appearance of Huey and David gravely jeopardized the lives of our Supreme Commander and Chief of Staff. Besides this extreme act of napery, their disappearance also endangered the homes and offices of all Party members by giving the pigs an excuse (as if they need one) to vamp.

Remember the case of George Sams, his disappearance and the immediate, wide-scale raids on Black Panther Party offices.

In retrospect, it is now clear that this treachery is not a haphazard,

spur-of-the-moment thing. One week ago, at Woolsey Hall, where Huey P. Newton spoke, Richard Dharuba Moore commented to people that they would soon be hearing about him, bitterly attacked Huey and implied that he Richard Dharuba Moore, intended to kill the Supreme Commander, Pending verification of these comments, he was put on temporary suspension.

Connie Matthews Tabor hoarded her European contacts and made personal arrangements for a book she is writing concerning the Black Panther Party.

Connie Matthews Tabor, a Jamaican, raised in Europe where she spent the majority of her life, lived in Europe nearly the entire time she worked with the Black Panther Party. She did important work in helping establish solidarity committees in Europe; however, her isolation and individualism made it necessary for her to work more closely with other Party members. Therefore she was sent to Algiers, Algeria to work with the Intercommunal Section. The Minister of Information, Eldridge Cleaver, transferred her to Central Headquarters in Oakland, because he found it impossible to deal with her individualism and lack of discipline. She had one last chance at Central. She could not stand the struggle, she could not live collectively and she could not work with her sisters and brothers in the Black Panther Party. All of this was too much tax upon her reactionary, individualistic consciousness. She was constantly disciplined for being an alcoholic, for we know that alcoholics cannot hold secrets. She grew more and more uneasy here and could not stop talking about the time she was scheduled to leave in March after Revolutionary Intercommunal Solidarity Day.

Michael Cetewayo Tabor married Connie Matthews shortly after she came to the U.S. this fall. She is much older than Michael Tabor and considerably more experienced in the Revolutionary struggle. Their marriage received considerable publicity in Europe - something neither of them ever stopped talking about. We can only speculate (guess) what motivated Michael Cetewayo Tabor and his loud-mouthed comrade, Richard Dharuba Moore, to desert their comrades at this stage. If this older woman could make Michael Cetewayo Tabor do what the pigs never could - desert his comrades - then perhaps we have to look to Isaac Hayes or Ike and Tina Turner to understand his napery.

MEMORANDUM OF THE CENTRAL COMMITTEE OF THE LAO PATRIOTIC FRONT ON THE ESCALATION OF THE U.S. WAR OF AGGRESSION IN LAOS AND THE SETTLEMENT OF THE LAO PROBLEM

(On the occasion of the 8th anniversary of the of the Geneva Agreement on Laos.)

The 1962 Geneva Agreement on Laos is eight years old by July 23. This International agreement has recognized the Lao people's fundamental national rights namely sovereignty, independence, unity and territorial integrity. But up to now, the objectives set in the agreement have not yet materialized. The Lao situation has become more strained with each passing day. The war of aggression waged by the United States in Laos is going on with increasing fierceness and has spread to the whole of Indochina.

As representatives of the Lao people at the signing of the 1962 Geneva Agreement, the Lao Patriotic Front has always shown its goodwill for peace, and put forward proposals aimed at settling the Lao Issue by political means, but the U.S. and its henchmen have always sought ways and means to reject it.

On this occasion, the L.P.F. Central Committee deems it necessary to the developments in the past eight years and the serious development of the Lao situation over the recent past, and expound the present stand of the L.P.F. on the Lao question.

U.S. INTERVENTION AND AGGRESSION AND SYSTEMATIC SABOTAGE OF THE GENEVA AGREEMENT ON LAOS.

Though a party of the 1962 Geneva Agreement, the U.S. has persisted in its neo-colonialist policy of intervention and aggression with the aim of materializing its scheme to turn Laos into a new-type colony and military base, a long-term scheme against Laos in the U.S. strategy in Indochina and South-East Asia which is itself part of the "global strategy" of U.S. imperialism. For that reason, while the L.P.F. and many countries' signatories to this agreement correctly discharged their duty, the U.S. has acted in the opposite sense.

Before the Ink had dried on the 1962 Geneva Agreement, the Kennedy administration, seeing that it could not wipe out the Lao patriotic forces by peaceful means, mobilized the armedforces of the pro-U.S. reactionaries to launch a large-scale nibbling operation in the strategic Plain of Jars (Upper Laos) under the control of the L.P.F. and, at the same time, to conduct "pacification" raids in the areas controlled by the lackeys of the U.S. in an attempt to suppress the Lao people's patriotic movement, Since then, the "special war" in Laos, a neo-colonialist war of aggression undertaken by the U.S. imperialists ever since the signing of the 1954 Geneva Agreement on Indochina, has been broadened with each passing day.

But the situation has evolved in a way contrary to the sinister calculations of the U.S. The Lao people's patriotic struggle has not ceased to develop. Although the pro-U.S. reactionary forces held a number of seats in the Lao National Union Government which signed the 1962 Geneva Agreement, thanks to the participation of the Lao Patriotic Front and patriotic neutralist personalities, that Government has made some efforts toward the realization of a peaceful, independent, neutral, democratic, unified and prosperous Laos.

The situation had reached a point when the U.S. realized the necessity to create at all costs an administration completely depending on it to serve as a prop for the neo-colonialist policy and an instrument for the U.S. "special war." Therefore, after a series of assassinations of patriots in the tripartite National Union Government, on April 19. 1964, the Johnson administration wirepulled the pro-U.S. militarists to stage a coup d' etat and overthrow the tripartite government. This was a brazen act of intervention in the internal affairs of Laos, and a serious act of sabotage against the 1962 Geneva Agreement.

A month after the coup in Vientiane (capital of Laos). In an attempt to cope with its ever more critical situation arising from repeated failures in Laos as well as in Viet Nam, the Johnson adminstration, in complete disregard of the independence and sovereignty of Laos, the Geneva Agreements and international law, overtly ordered its air forces to bomb and strafe Laos' territory, taking a serious step in escalating the U.S. "special war" in this country. (U.S. air bombings which began on May 17, 1964 against the plain of jars in Xieng Khoang Province, have spread to all the liberated areas under the control of the Lao patriotic force.)

Taking off from the 7th Fleet and military bases in Thailand and South Viet Nam. U.S. jet planes have repeatedly attacked by day and by night pagodas and temples, hospitals and schools… destroying or damaging hundreds of villages, district towns, provincial capitals, and razing to the ground many vast populated areas. U.S. aircraft have used such savage lethal weapons as napalm, phrosphorous and steel pellet bombs and toxic chemicals. U.S. air strikes are also intended to provide support for the nibbling ground attacks conducted by the puppet army. Since then, apart from logistic support, the U.S. has provided a major air cover which is vital to the puppet army. With this U.S. air support, the Vietiane puppet army has launched repeated operations, particularly in the "dry season", involving from two or three mobile regiments to 20 or 30 regular battalions to attack the liberated zones under the control of the Lao patriotic forces.

In 1966, the U.S. bombings in Laos escalated a new rung: strategic B.52 bombers began to be flown against various regions in Lower Laos in the late period of the Johnson adminstration. The U.S. has since intensified the bombing against Laos with an average of over 300 sorties of jet planes a day, dropping over 1,000 tons of bombs. In December 1968. B.52 bombers flew some 35 sorties a day, releasing nearly 1,000 tons of bombs, in comparison to 5 sorties a day in 1967. The higher the rate of bombings, the fiercer and more atrocious the U.S. "special war" in Laos becomes.

To prosecute and direct that war, the U.S. has unceasingly and at the same time illegally maintained U.S. "advisers" and military personnel and secretetly introduced more and more of them into Laos, U.S. aid to Laos went up from 102 million dollars in 1963 to 130 million in 1967, of which 80 million military aid. On the per capita basis, this is one of the highest percentages of U.S. aid to a foreign country. In the late period of the Johnson administration, the number of American "advisers" and military personnel reached 500 disguised under varied labels. In addition, there were thousands of advisers and military personnel of satellites of the U.S., like Thailand, South Viet Nam and the Philippines.

With increasing numbers of U.S. military personnel, the U.S. war command in Laos has daily broadened, blanketing the Vientiane administration. The head-quarters of this command is the U.S. embassy.

In the testimony made public on April 19, 1970, the Senate subcommittee on American commitments abroad noted that the U.S. representative in Laos had obviously gone beyond his role as a plenipotentiary representative of the U.S. affairs in Laos. He has directed the supply and equipment of the Vientiane army, decided the targets for the air strikes, coordinated and commanded the "special mission" of the U.S. and Vientiane troops.

Senator S. Syminton, chairman of the sub-committee, said that the U.S. diplomat in Laos has become a "military pro-consul". The testimony pointed out that the U.S. had violated the 1962 Geneva Agreements.

Scoffing at the provisions of these agreements, the U.S. has set up in Laos military strong-holds and other bases linked together by a network of airfields and radar stations. These are staging areas for ground and air attacks, which have been daily and hourly piling up crimes against the Lao population during several years past. Even on a number of areas which they had unlawfully taken from the Lao patriotic forces, the U.S. and its lackeys have built strongholds and bases as springboards for nibbling attacks. Some of these are important strongholds and big bases like Pathi (Sam Neua province). Sam Thong and Long Cheng (Xieng Khoang province), and Bolovens (Saravanne province). They are provided with modern equipment and commanded by U.S. specialists, to direct aerial bombardments on Laos' territory and organize the rescue of downed pilots. The U.S. has also used some of these bases to direct the bombings on areas outside the Lao territory in service of the U.S. aggression in Laos' neighboring countries.

The U.S. has used the territory of Thailand, a "second Okinawa" of the U.S. 'In Southeast Asia- as a huge base, a springboard for intervention and aggression in service of its "special war" in Laos. Since May 1964, Thailand has become a staging area for U.S. bombings on Laos. The whole network of U.S. air bases in Thailand, including the Utapao strategic airbase are serving the present air strikes. The U.S. air forces in Thailand are taking charge of almost all the air strikes in Laos. For their part, the Thai reactionary ruling circles, doing their best to help the U.S. imperialist aggressors and in close collusion with the henchmen of the U.S. in Laos while pursuing their own ambitions against Laos, have become an accomplice of the U.S. imperialists in the sabotage of the 1962 Geneva Agreement on Laos.

While conducting its criminal war of aggression against Laos, Washington has hypocritically and ceaselessly claimed that the U.S. honors the 1962 Geneva Agreements. It has sought a thousand and one means to hide the U.S. intervention and aggression through distortions and deceptions. Kennedy and Johnson in the past as well as Nixon at present used to pretext the "requests" or "consent" of a stooge administration in Vientiane to justify American activities in Laos in his statement of March 6, 1970 on the Lao situation, U.S. President Nixon asserted that it was the policy of the U.S. to "Continue supporting the government of Prime Minister Souvanna Phouma." This testified to Nixon's obduracy in using the Vietianne stooge administration as a prop and a tool to step up the U.S. intervention and aggression in Laos.

Due to the repeated acts of intervention and aggression of the U.S. in the past years, the 1962 Geneva Agreements have been systematically sabotaged, and the Lao people's fundamental national rights recognized by these agreements have been and are being trampled underfoot.

In his statement of March 6, 1970, Nixon said that the present administration's policy toward Laos was only the continuation of the policy of the previous administrations. This is a contention, aimed at putting the blame on his predecessors. In fact, by continuing the intervention and aggression undertaken by his predecessors, Nixon is obviously himself an interventionist and aggressor. He cannot evade his responsibility.

Moreover, Nixon has not only continued the work of his predecessors. More obstinate in his actions and more perfidious in his words, Nixon has outdone his predecessors.

Nixon is now trying to spread a smokescreen to hide from the American people and the world's people the actual role of the U.S. in Laos. Criticizing Nixon's obduracy and skulduggery, Senator Fulbright, Chairman of the U.S. Senate Foreign Relations Committee, pointed out that the secrecy covering the U.S. activities in the war in Laos which the Nixon administration has taken over without criticism from its predecessors is now being resorted to prevent the American people from knowing about a war which is costing them more and more in terms of money and human lives.

Indeed, realities that have taken place since Nixon took office showed that the war of aggression in Laos has been escalated to a serious degree due to the fact that the Nixon administration is going all out to apply the Nixon doctrine in Laos and is continually escalating this war.

Should the Nixon administration stubbornly continue to escalate its war of aggression and increase bombing raids on Laos' territory, it would have to bear full responsibility for all consequences of these acts. Exercising their legitmate rights to self-defense, the Lao patriotic forces and people are resolved to counter all acts of war escalation taken by the Nixon administration, and will deal more stinging blows at the U.S. aggressors and their lackeys if they obdurately comit more crimes

KATHLEEN CLEAVER DENIED FREEDOM OF SPEECH IN WEST GERMANY

The Afro-American GI's stationed in western Germany, have begun to realize who the enemy really is.

In order to destroy the Imperialistic, barbaric Empire -- Babylon, the brothers understand that the soldiers' role and the masses' role in the liberation of the oppressed peoples of the world is one and the same.

The Minister of Information of The Black Panther Party, Eldridge Cleaver, has said, "Correct information is the raw material for new ideas." This theory is being implemented, and we are receiving very positive responses. Throughout Western Germany the brothers are educating and organizing themselves because to them, it is quite clear that the … MILITARISTIC BEAST, THE WORLD POLICE FORCE -- must be destroyed once and for all ---- "FROM WITHIN." The revolutionary cells in the military have begun to rip-off: ammo-dumps, arms-rooms, motorpools and other equipment that is relevant to the struggle. Of course the military has attempted to black-out all news concerning these revolutionary acts. If executing a rip-off, and the people involved get apprehended, the military pigs, then call in their lying contradictory press. (Stars & Stripes and The Overseas Weekly) to paint the act as evil. Then through the military kangaroo court system, they proceed to make examples of these people, in hopes to snuff-out the revolutionary movement in the military. However this is not the case, as a matter of fact, when the pigs expose themselves for what they really are…. it intensifies our struggle.

The brothers realize that the class contradictions between the enlisted men and the officers, are the same as the class contradictions in racist Amerikkka, between the ruling class and the oppressed masses. Also through political education, they have begun to recognize neo-colonialism in the Army, such as the black NCO's-- mainly 1st sergeants: suddenly springing up all over the place. They compare this with the way black mayors popping up in Babylon, as spokesmen for the ruling circles. It is also very clear to the brothers why the stockades are over crowded, and seventy-five percent of the people in the stockades are Blacks and Puerto-Ricans. Also mostly Afro-Americans, Puerto-Rican Americans, and the Indian Americans are dispatched into Infantry, Armor, or Combat Engineering Units; these are the front line fighting units of the War Machine. To most of the brothers, this is clear indication of the deliberate extermination of these ethnic groups.

The Pentagon and the U.S. military pigs in West Germany are very up-tight over the situation they have on hand. Little do they realize, that it is too late to stop the revolutionary fever, that is spreading rapidly throughout the military institutions in Germany. They have been forced to step up their pacification programs, but this is also in vain.

The pacification programs the military pigs are presenting to the GI's in general, and the black GI's in particular, are not effective at all. About three months ago, the pigs of the Pentagon sent an integrated race relations team to west Germany, in an attempt to pacify the rebelling soldiers. The R.R. team, which was called "THE FLYING SQUAD" received devastating attacks everywhere they showed their pigish faces.

Eldridge Cleaver was invited by the Frankfurt Solidarity Committee and some students, to speak about the repression The BLACK PANTHER PARTY is receiving from the fascist Amerikkkan government. Due to the fact that the Minister of Interior of the west German Government, made the decision he did, Eldridge wasn't able to fulfill the invitation he had accepted. Since Kathleen Cleaver was not considered "Just an Ordinary Criminal" as the Minister of Interior of the west Germany government had said Eldridge was, it was decided that she would come to lecture in west Germany, about the repression and genocide that the poor oppressed people in general, Chairman Bobby Seale and The Black Panther Pary in particular, are receiving from the racist government of Amerikkka.

Due to the limited amount of time Kathleen had to spend in West Germany, we had to organize a publicizing campaign to inform as many brothers and sisters as we possibly could that she was coming to Frankfurt on Thanksgiving Day, to really give them something to be thankful for …. CORRECT INFORMATION. We had to distribute this material (posters, leaflets etc.) all over West Germany by way of car, and we only had access to two automobiles, so we divided the distance equally between our group.

On November 19,1970, one part of the group that was informing the mass of blacks in Germany, about the coming of our sister, was involved in a shoot-out with a puppet-piglet at Ramstein Airbase. The brothers dealt with this piglet in a revolutionary manner, the piglet was hospitalized, two of the brothers were captured, and two escaped to safety. The brothers incarcerated, were originally charged with murder conspiracy, but in order to eliminate a political trial, the charges have been changed to attempted murder.

Kathleen left Algeria on the 24th of November, aboard an Air France flight to Paris, where she was scheduled to change planes, enroute to Frankfurt. When the plane landed in Paris, Kathleen was met by a host of French pigs. They tried to convince her not to enter West Germany, because she was not wanted there. However the revolutionary sister insisted on her rights of intercommunal travel. Several hours later, she was allowed to leave France and proceed to Western Germany -- only to be met at Rhein-Main Airport by some five or six hundred pigs, OINKING! "We don't want you here, you are a threat to our economical relations with our allies." When this is translaed from pig language to human language, it means … "if we let you into the country, the U.S. power structure will cut off our funds."

The German pigs forced her to board the nextflightback to Paris, where Kathleen was once again met by the French pigs and reinforcement. She informed the pigs that she wanted to go to Copenhagen Denmark, not immediatly back to Algeria. The French pigs then contacted the Danish authorities, and informed them of the situation with Kathleen. Denmark being a part of the intercommunal imperialist machinery, realized also that if they didn't go along with the program, their economic life line would be cut off. So Kathleen had no other alternative but to remain in France, and await the next flight back to Algeria.

Although Kathleen wasn't able to speak to the people of West Germany or share Thanksgiving with the brothers and sisters here, everything was carried out as planned. We say revolutionary power to our sister, because she did expose three lackey countries of U.S. Imperialism -- WEST GERMANY, FRANCE and DENMARK. The brothers and sisters over here understood that very well and they stand in firm support of the Black Panther Party.

TENTH ANNIVERSARY OF THE REVOLUTION IN ANGOLA LED BY MPLA MILITANTS AGAINST PORTUGESE COLONIALISM

February 4, 1971 marks the tenth anniversary of the revolution in Angola led by MPLA (Movimento popular de Libertacao de Angola) freedom fighters against Portugese colonialism.

On February 4th, 1961 militants attacked the prisons of Luanda (the capital) to release political prisoners and, thus, launched the armed struggle of the Angolan people for independence. Since that day the MPLA forces of liberation have widened the struggle in this southern African Portugese colony and have succeeded in liberating roughly one third of the country. While carrying on the military struggle, MPLA has provided educational medical, and economic programs for the people in the liberated areas.

In response to the increasing successes of the guerillas, Portugal has brought 60,000 troops, backed up by South African military equipment and supplies, into Angola. In addition, Portugese colonialism in Angola relies heavily for support and continuation on western imperialist interests, both economic (such as Gulf Oil Company) and military. "Our war would have been won long ago if Portugal had not received assistance from the United States and her NATO allies -- many of whom have economic investments to protect in Angola," stated a military leader of MPLA in 1970. The recently exposed use of chemical defoliants by the Portugese in Angola even further implicates American complicity in this war.

THE SOLEDAD SEVEN

Some of the highest contradictions in the daily practice of the U.S. imperialists exists within the institution of the U.S. courts. The courts' mockery of justice extends itself from the trial of Chairman Bobby Seale and Ericka Huggins of the Black Panther Party in New Haven to the local traffic divisions in our various communities.

In late July, 1970, in Salinas, California, seven brothers, all incarcerated at Soledad State Prison, fell victims to their second round of overt injustice. This time it was directed by the dictatorship of a Judge Campbell.

Judge Campbell, a fascist overseer, started the arraignment procedures of the Soledad 7 Case with the denial of the brothers' basic constitutional rights - their choice of an attorney. The brothers, all charged with an alleged conspiracy to commit murder and murder of a guard at Soledad last June 23rd, had chosen seven criminal attorneys from San Francisco to represent them in this case. The judge, disregarding the obvious qualifications of the attorneys (none of whom have been criminal practitioners under the California Bar for less than four years), appointed one public defender and six other attorneys from Salinas. The reason the judge gave for this obviously arbitrary act was that he personally did not know the moral ethics of San Francisco attorneys.

All of the appointed attorneys immediately handed in written requests to be dropped from the case. Their reasons: 1) They were not the choice of the brothers, and therefore could not properly represent them; 2) The judge was not acting in accordance with the fairness due in the issue over the attorneys; that is, he was being unfair; and 3) The attorneys from San Francisco were qualified and vouchers for each one were also presented by the Salinas attorneys.

Judge Campbell again denied all motions and requests. In protest to this intimidating action, the attorneys, on November 11th, refused to appear in court. It was on this day that the official pleas of the brothers were to be recorded. The judge asked the brothers for their pleas. Standing firm on their rights as defendants, the Soledad 7 refused to enter a plea without the presence of their lawyers. Now according to correct judicial procedures, the arraignment should have been post-poned until the attorneys were present. Disregarding all this, the judge, calling each brother separately, entered a plea of Not Guilty for them, as they stood silent.

Like a power-crazed maniac, the judge then proceeded to set the trial date for December 7th, giving the appointed attorneys from Salinas less than four weeks to prepare the case.

Since that time, the brothers have had to go from one court to another, fighting for the right of choice of counsel.

On February 1st, four of the brothers were released from the case after an arbitrary "legal" straw - picking. The alleged reason for this is that according to written law, an arraignment cannot extend over a certain period of time, and charges had to be dropped on all or some of them. So, all charges were dropped on four of them. And the conspiracy to commit murder charge has been dropped on three of the brothers. But these three, Jessie Phillips, Roosevelt Williams and James Wagner are still charged with murder, and still face the death penalty. The date set to begin trial for the remaining three brothers is now tentatively March 29th.

During the course of the past months, the brothers have not only been fighting for their right to counsel, but they have joined with the Soledad 3, George Jackson, Fleeta Drumgo and John Clutchette, in addition to a brother named Talmadger (accused of assaulting a guard on behalf of the Soledad 3), to file a suit to remove Section 4500 from the California law books. Section 4500 stipulates that there be a mandatory death sentence for all prisoners serving life sentences, if they so much as assault a non-inmate. Questioning the constitutionality of this section, they are sueing the District Attorneys of Monterey and Marin County. At this time, there are only eight States left which still have such laws on the books. Since it is a felony suit, the brothers have a right to a three-judge panel, which must make a decision or issue some statement regarding the suit.

The internal procedures of the courts in this Empire, particularly in this case and the case of Chairman Bobby and Ericka are examples of the injustice that is meted out. Our only resort is to relate to the People's courts in the streets, and administer true justice upon criminals like judge Campbell; and sentence them to death by the hands of the People.

What We Want
What We Believe

1. We want freedom. We want power to determine the destiny of our Black Community.

We believe that black people will not be free until we are able to determine our destiny.

2. We want full employment for our people.

We believe that the federal government is responsible and obligated to give every man employment or a guaranteed income. We believe that if the while American businessmen will not give full employment then the means of production should be taken from the businessmen and placed in the community so that the people of the community can organize and employ all of its people and give a high standard of living.

3. We want an end to the robbery by the CAPITALIST of our Black Community.

We believe that this racist government has robbed us and now we are demanding the overdue debt of forty acres and two mules. Forty acres and two mules was promised 100 years ago as restitution for slave labor and mass murder of black people. We will accept the payment in currency which will be distributed to our many communities. The Germans are now aiding the Jews in Israel for the genocide of the Jewish people. The Germans murdered six million Jews. The American racist has taken part in the slaughter of over fifty million black people: therefore, we feel that this is a modest demand that we make.

4. We want decent housing, fit for shelter of human beings.

We believe that if the white landlords will not give decent housing to our black community, then the housing and the land should be made into cooperatives so that our community, with government aid, can build and make decent housing for its people.

5. We want education for our people that exposes the true nature of this decadent American society. We want education that teaches us our true history and our role in the present-day society.

We believe in an educational system that will give to our people a knowledge of self. If a man does not have knowledge of himself and his position in society and the world, then he has little chance to relate to anything else.

6. We want all black men to be exempt from military service.

We believe that Black people should not be forced to fight in the military service to defend a racist government that does not protect us. We will not fight and kill other people of color in the world who, like black people, are being victimized by the white racist government of America. We will protect ourselves from the force and violence of the racist police and the racist military, by whatever means necessary.

7. We want an immediate end to POLICE BRUTALITY and MURDER of black people.

We believe we can end police brutality in our black community by organizing black self-defense groups that are dedicated to defending our black community from racist police oppression and brutality. The Second Amendment to the Constitution of the United States gives a right to bear arms. We therefore believe that all, black people should arm themselves for self-defense.

8. We want freedom for all black men held in federal, state, county and city prisons and jails.

We believe that all, black people should be released from the many jails and prisons because they have not received a fair and impartial trial.

9. We want all black people when brought to trial to be tried in court by a jury of their peer group or people from their black communities, as defined by the Constitution of the United States.

We believe that the courts should follow the United States Constitution so that black people will receive fair trails. The 14th Amendment of the U.S. Constitution gives a man a right to be tried by his peer group. A peer is a person from a similar economic, social, religious, geographical, environmental, historical and racial background. To do this the court will be forced to select a jury from the black community from which the black defendant came. We have been, and are being tried by all-white juries that have no understanding of the "average reasoning man" of the black community.

10. We want land, bread, housing, education, clothing, justice and peace. And as our major political objective, a United Nations-supervised plebiscite to be held throughout the black colony in which only black colonial subjects will be allowed to participate, for the purpose of determining the will of black people as to their national destiny.

When, in the course of human events, it becomes necessary for one people to dissolve the political bands which connected them with another, and to assume, among the powers of the earth, the separate and equal station to which the laws of nature and nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

We hold these truths to be self-evident, that all men are created equal; that they are endowed by their Creator with certain unalienable rights; that among these are life, liberty, and the pursuit of happiness. That, to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed; that, whenever any form of government becomes destructive of these ends, it is the right of the people to alter or to abolish it, and to institute a new government, laying its foundation on such principles, and organizing its powers in such form, as to them shall seem most likely to effect their safety and happiness. Prudence, indeed, will dictate that governments long established should not be changed for light and transient causes; and, accordingly, all experience hath shown-that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But, when a long train of abuses and usurpations, pursuing invariably the same object, evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security.
