RENT-A-PIG KILLS 14 YEAR OLD BROTHER IN HOMEMADE PLAYGROUND

Fourteen year old Calvin Bradley was shot in the heart while playing in an impoverished playground by a rent-a-pig named LeRoy Green. This pig, LeRoy Green works for Industrial Towel and Uniform Company and this company has a history which indicates how a pig like LeRoy Green could be hired, and a situation resulting in the death of Calvin Bradley could take place.

According to witnesses, Calvin Bradley and four other companions were playing on an abandoned mattress in an alley behind 2137 W. Madison, several buildings adjacent to the Industrial Towel Company. One of the company trucks came down the alley and the youths were forced to move the mattress so the truck could continue down the alley. Pig LeRoy Green, who had been drinking all night (while on duty as a security guard) staggered down the alley and cursed at the youths telling them to get the he -- out of the alley. Now dig this, pig Green works for Industrial Towel which is approximately ¾ of a block away from where the youths were playing, and therefore he had no legal rights to tell them to do anything.

After the truck left the youths began playing on the mattress once again. This time pig Green looked down the alley, spotted the youths, drew his revolver and fired at random, striking Calvin Bradley in the heart. One of Calvin's brothers said that had the bullet not struck Calvin it would have struck him.

Calvin's father (Chester Bradley) was on his way home from work, it was about 11:30 or 12 midnight, when he observed the flashing lights of a pig car going by, but little did he know that his son was laying dead in it. When he arrived home, his wife Janie informed him of what had happened. Chester Bradley immediately began to investigate and attempted to put what had happened together. After his investigation, Chester said that he was sure that his son had been murdered and he demanded that pig LeRoy Green be brought to justice.

Pig LeRoy Green was arrested and charged with murder, however the state showed that it had no intention of really prosecuting pig Green, because they gave him a $3,500 bond on a murder charge, and normally you can't even get bond on a murder charge. For Chester Bradley this served to be very educational, because he thought of his uncle who is in jail on a $25,000 bond for assault and battery charges and he was defending himself against an attack at his place of employment. This showed clearly that there is no justice when pigs commit crimes against the people, only more laws to help the pigs commit more crimes.

Chester Bradley came to the Black Panther Party because he understood that he could no longer have any faith in this present system. He explained that he had sent letters to Senator Percy and received no reply no one had come forth except the Black Panther Party and let him know that his son's death will not be forgotten. The Party provided pall barers for the body of Calvin Bradley, and we promised that through our newspaper, which is our voice, we would let the world know what Industrial Towel and Uniform Service and their lacky nigger guard pig LeRoy Green did.

We say that the charge is murder, and that Industrial Towel a long-time capitalist institution which pays slave labor prices, discriminates against women in wages (hires more women in order to pay them lower wages), is guilty of murder along with pig Green.

We have assured Chester Bradley and his 10 remaining children, that the Revolutionary People's Constitutional Convention is for the purpose of setting the machinery which will deal with pigs like LeRoy Green, and capitalists like Industrial Towel. We say that they should be kicked out of our community, and that only death is befitting them.

In order for us to prevent more and more situations like this from taking place, we must move in a collective manner to secure our community from the pigs. When we write a new constitution, we shall not forget Calvin Bradley, or the many other Black youths who have fallen at the hands of the oppressor.

THE FASCIST PIG SLUMLORDS WILL STOP ATTACKING THE PEOPLE IN THE MANNER OF CRIMINALS AND GIVE THEM DECENT HOUSING OR FACE THE WRATH OF ARMED PEOPLE

The people of Charlotte Street in the Broax. New York have to go no further than their front doors to see the ruins of abandoned buildings and what appears to be a disaster area. Maggot infested garbage, garbage shown halls, leaky pipes, flooded apartments, rats, mice and roaches are a common and daily occurrence on Charlotte Street. The children in the community use the garbage piled backyards for play areas. Many days the fire hydrant is the only means of getting water.

The buildings on Charlotte St. have been abandoned by the pig landlord Zisser for over a year, and the junkies and petty thieves have been ripping off the brass plumbing, causing the people to have floods in their apartments and water seeped walls and ceilings. The pigs have made no move to provide the people decent living conditions. Violation forms were submitted and still no move was made to correct the violations. There is no monetary profit for the pig landlord Zisser, or his partners in the state and city government agencies, therefore the people are left to endure indecent housing conditions.

Pig Zisser has shown the people that he has no regard for them, their lives or their health. By allowing unfit housing conditions to exist he has shown the people on Charlotte Street that be cares only for the financial profit. When the buildings got to the point of delapidation, due to the fact that pig Zisser was not on his job, he split. Complaints and violations were called in numerous times and still no move has been made to correct the violations.

Recently, a pig from the building and housing department came to 1540 Charlotte Street and promised to make repairs only if the people will pay rent, and not because the people are suffering from indecent housing. The people have not been paying rent and members of the Black Panther Party's Bronx Housing Coalition and the people on Charlotte Street will not allow the pigs to control or stop the people's righteous struggle to rid themselves of all greedy slumlords. The members of the Black Panther Party Housing Coalition realize the people in the colony do not have the financial means to pool their money to correct the existing violations, therefore the Housing Coalition and the people on Charlotte Street will pool their resources and defend our homes. The people will demand that Pig Altman of the Building and Housing Department knows this and knows the violations exist, yet he has done nothing. The pigs of the Building and Housing Department, and all the many agencies "supposedly" dealing with correcting housing violations are criminals and outlaws according to their own pigs laws. They are breaking the law, they are murdering the people by letting obvious violations exist. They are doing all these things, yet they are not being harassed, brutalized or thrown into concentration camps. When the people protest these illegal violations they are attacked viciously by the local pig police (gestapo), brutalized, and thrown into jails, for demanding their right to decent housing.

The people on Charlotte Street have the desire to control their own destinies. This is evident by the fact that the people have joined the Housing Coalition operating with the Black Panther Party. This Housing Coalition is dedito decent housing by any means necessary. The fascist pig slumlords will stop attacking the people in the manner of criminals and outlaws, and give the people decent housing fit for shelter of human beings (Pt. #4 of the Black Panther Party's 10 Point Platform and Program), or they will face a political consequence at the hands of the armed people.

WE MUST MOVE IN 2's AND 3's - GUERRILLA STYLE TO INSURE OUR SURVIVAL

"Equal protection under the law" is supposed to be one of America's codes of justice. In essence, it is supposed to mean that regardless of one's race, creed, etc., and economic status, the "law" applies equally to everyone; the "law" will not give more leniency to one individual than it would to another individual under similar circumstances. This is part of what the phrase is supposed to mean, but looking at the historical experiences of Black people, it is very clear that "equal protection under the law" is a farce.

For approximately the last two weeks, Black students of Helms Jr. High School, in San Pablo, California, have been subjected to daily brutal, racist attacks from the young White racist students, their parents and other family members, and mad dog, racist pigs from the San Pablo pig pen. On October 9th, these attacks culminated in a near-fatal attack on Kasim Jefferson by a Richmond High racist: the brother's ear was nearly torn off by a blow from the racist's claw hammer.

On Tuesday, October 13th, some brothers decided it was time to put it on the minds of the racists of Richmond High that the savage attacks on Black students would no longer be tolerated.

As the brothers were preparing to righteously deal with the psychopathic racists, two bootlicking rent-a-pigs, Frazier and Greenhouse, intervened in behalf of the White racist students. These two low-lifed niggers tried so hard "to do their job", they both attacked one brother. The brother, who was defending himself against Frazier's unjust attack when Greenhouse punched the brother in the back, asked who hit him, fat lackey Greenhouse oinked, "I hit you." Greenhouse later told a sister that he would hit the brother again if he had the chance. The brothers and sisters of Richmond High having thoroughly recognized Greenhouse and Frazier for what they are, bootlicking, racist-protecting pigs, stated that those two puppets have an extensive reputation for brutalizing students.

Right after the brother was attacked by the bootlickers, the racist pigs from the San Pablo and Richmond pig pens came on the scene. About five pig mobiles converged on Melvin Mason, who was about to defend himself from an attack by the racist who attacked Kasim with the hammer. Brother Melvin was arrested for disturbing the peace but his attacker remained free because the pigs "didn't see him squaring off." A sister, Pat Wilson, who was near Melvin was also falsely arrested for disturbing the peace. Not so surprising was the fact that the father of the racist hammerman was arrested and released on the spot even though he was cursing Pat's mother because she asked him why was his son attacking people.

Now the pigs went into their act. They began ordering the students to "clear the streets in two minutes or go to jail." It was clear by the way the pigs were harassing the brothers and sisters that they (pigs) were attempting to escalate the situation, thus giving the pigs reason to crack skulls and jail people.

Quickly analyzing the situation, Black Panther Santa Rita, and Community Worker Carl Colar, decided to try to clear the streets before the pigs began massacring the Black students, Carl and Santa Rita pointed out to the people the obvious shortcomings of trying to deal with pigs while being in the streets in large numbers. The people, listening to the brothers, and noticing how the armed gestapo were itching to brutalize them, began to clear the area. As long as Santa Rita and Carl were moving with the people out of the area, they were constantly being harassed and/or threatened by pigs Martin and Neimela of San Pablo, and pigs Gale and Leiberman of Richmond.

After it was clear that the people were going to leave, Santa Rita and Carl got into their car to take anyone home who needed a ride. As the brothers were leaving, pig Martin oinked, "I sure would like to kick a Black Panther's behind." The reactionary fools were furious because the two revolutionaries had seen to it that there was no mass brutalization. So, true to their nature, the fascist dogs (Martin, Neimela, Gale, Leiberman, and others) stopped the car the brothers were in and charged them with resisting arrest and failure to disperse.

Both Carl and Santa Rita were searched, handcuffed, and put into a pig wagon; the brothers' car was being extremely and illegally searched. The pigs wouldn't give the car keys to another Panther, Joan Kelley, when she came to check out the reported arrests. Shortly afterward, the brothers were taken to jail and then released, after posting $125 ransom each.

We must fully understand that Black people have no rights that White racist pigs and bootlicking nigger pigs are bound to respect. The people of North Richmond (the colony) have realized again that although they are being victimized by racist aggression, they are being treated as the aggressors. The people see that the so-called protectors of the peace are in fact the promoters of confusion.

The people must now come to the realization that the only way for us to insure our rights to just treatment is to begin dealing death blows to the racist, gestapotroops and their bootlicking colleagues. We must move in 2's and 3's -- guerilla style -- to insure our survival.

FREE PRISON BUSSING PROGRAM

(Chicago) - The Black Panther Party, in implementing its free prison bussing program will be making it possible for parents, relatives and friends of inmates in the Pontiac and Dwight branches of the Illinois State Penitentiary to visit them Sunday October 28. The bus will be leaving from two locations here in Chicago. Westside: 2350 W. Madison at 9:30 a.m.: Southside 253 E. 35th St. at 10:00 a.m.

We are asking that those people who would like to visit inmates there, have previous visiting arrangements made (necessary visiting papers) but this is not absolutely necessary for those just wanting to see the prison. For those who would like to join us on our trip to Pontiac and Dwight, Illinois call (312) 738-0778 - 9.

Pontiac is a maximum security prison located in Pontiac, Ill. about 150 miles from Chicago. It holds young adults ages ranging from 17 to 29 years. The most revolutionary age group - those most likely to rebel. Dwight reformatory on the other hand is an institution for women in Dwight, Ill. about 120 miles from Chicago.

The bussing program in its second month here in Illinois is moving at a rapid pace and getting more response from people concerned about their relatives in prison, who they haven't seen since they first left the streets of Chicago. Busses have run to Joliet, Statesville, Pontiac and Dwight. All branches of the Illinois State Penitentiary system. Plans are being made to visit prisons further downstate, such as Vandalla, Vienna and Menard. We are planning to run busses weekly to Joliet. We are appealing to the community to help us in our efforts to implement this program to the maximum benefit for the people. If you have transportation (bus, truck or car) or if you know of any school, church or organization that has transportation, contact us. WHY THE TENANTS OF 35 AND 29 MT. PLEASANT WILL BE AT THE CONSTITUTIONAL CONVENTION

On Thursday, October 8, 1970 Mrs. Helen White and Shirley MacField were summoned to Roxbury District Court to be railroaded into the streets of Babylon.

The majority of residents at 39 and 35 Mt. Pleasant Street. Roxbury, have been on a rent strike and have been struggling against their greedy dog slumlord for 3 months. Now they are struggling against his Black lackey, technically. On the eviction notice Alfred Cohen was the lawyer (the owner of the building), James (lackey) Lee, Jr. was supposedly the owner, and the constable who served the notice was Sidney Cohen, Pig Alfred's brothers. So it looked like an airtight railroad.

When Mrs. White and Shirley MacField entered the courtroom Thursday, October 8, they did not enter alone. The people at 39 and 35 Mt. Pleasant also came with them, to testify to the conditions of the buildings, with a peoples lawyer. This show of people in force blew the fascist judges' mind. The judge tried to side with the slumlord with technicalities, but that didn't work when the people's lawyer ran down the conditions of the building and then handed him a housing inspectors report. When the judge asked Mrs. White if she knew the laws about paying rent, she said, "yes" then he asked her if she was ever going to pay the back rent and she said, "so I'm not going to pay the rent!" This again blew the judges' mind, totally. He then told the people involved in this case to leave the courtroom; a decision on the eviction would be sent through the mail. The next day October 9, 1970, a decision was made in favor of the tenants.

The conditions of Mrs. White's apartment are the conditions of all the apartments in the two buildings owned by the slumlord Alfred Cohen at 35 and 39 Mt. Pleasant Street and his other buildings throughout the Black community. Mrs. White's apartment has had two windows out in her kitchen for over 11 months. At night cats come into the kitchen looking for food. In the hallway, leading to the kitchen there are no lights, the plumbing is completely inadequate throughout the whole building. In Mrs. Whites' bathroom, the ceiling has fallen out, because of a 1 month old leak in the apartment above her. When Mrs. White called the landlord to have her toilet fixed, the so-called plumber repaired it with a coat-hanger.

These conditions exist throughout the unfit housing buildings and projects that Black people are forced to live in. "We want decent housing, fit for the shelter of human beings," of the Black Panther Party Platform and Program is being answered in the Revolutionary People's Constitutional Convention and the tenants of 35 and 39 Mt. Plesant Street and Babylon will be in Washington D.C. to see that this need of the people's will be met.

PIG HARASSES SISTER

One sight familiar to any Black community in Babylon is the racist pigs riding through the colony "looking for a sister" to kidnap. Since time immemorial these pigs have always felt the need to assert their superiority by using sisters at their will.

During the so-called slave era the slaveowners were able to do this quite openly in terms of the repercussions from their other slaves. Today the facts remain the same, the only difference now are the tactics.

Today we find these dogs sliding around our communities after dark waiting for a chance to kidnap a sister off the streets. Sometimes these pigs even receive help from the illegitimate capitalists -- the Black pimp who betrays his people for the lustful greed of capitalism.

It was shortly after midnight. Wednesday, September 16th when a sister living in the Orchard Park Housing Project of Roxbury returned from work and decided to walk her dog before going to bed. As she was leaving the building she saw two pigs approaching her -- it seems there was some sort of disturbance in the apartment next to her's, and someone called the pigs. One of these dogs had the nerve to approach her with some madness about "keeping her company" while she walked her dog. About one hour later, as she was sitting in her living room, a knock came on the door. When she asked who was there a voice said "It's the police."

This sister lived alone and was still under some unfounded illusion that the police were basically in our communities to help us. Thinking they had returned to further investigate the disturbance next door, she did not hesitate to open her door. However when she did, this low-lifed dog forced his way into her home and started spouting some madness about how much he needed a sister. This pig went so far as to remove his gun and lay it on her T.V.

Becase of this sister's illusions about the police, her home was unequipped with the necessary tool of self-defense and she found herself at the mercy of this mad dog. But she soon became aware that the pigs have no mercy for Black people. After about ½ hour of being intimidated this pig was forced to leave because the disturbance started up against next door.

This sister had to learn the true nature of a pig from direct experience. What we must realize is that what happens to one of us happens to all of us.

DOMESTIC FIGHT LEADS TO PIGS VS PEOPLE MELEE

On a Friday night in July on Geneva Avenue in Roxbury, Grove Hall area, an argument broke out between two Black families, relatives and friends included. It came to blows between a brother and a sister. The people in the street and up in the Hall gathered to see the fight. Some friends of the family jumped in.

In a matter of seconds down Geneva Avenue came the fascist Boston Pig Department Station #9 to the scene on cycles, in cruisers and wagons. 28 pigs were on the scene. Out of their cars they came with black jacks, pistols and mace to restore so-called "law and order". Not even investigating the situation, one pig got right out of the car walked over to the people who were fighting and sprayed the brother and a few others in the face with a mace can. Another approached the crowd with pistol drawn, ready to kill, their primary instinct. The people continued to argue, and the pigs got very anxious. Then the pushing started and black jacks came loose from Black pig's pockets. It all ended up with the brother and sister getting busted and held with charges of "disturbing the peace" and "assault on a pig."

We couldn't even politicize with the people they were too busy fighting with each other. The pigs could have shot up the whole street but they wouldn't have been able to deal with the situation. Malcolm said, "If you want to argue go in the closet don't do it out there in front of the oppressor." In this case, we have to stop fighting each other and deter our energy and begin recognizing the real enemy. It's not your other half or your sisters or your brothers. The power structure has put us here in the Black communities like caged animals causing friction and spreading mistrust and hate among us so that we will fight, kill and rob from each other thus not giving us a chance to know who is really behind the whole thing. So I'm spelling it out for you. Don't be fighting with yourselves when-the bullets start flying and the tanks are rolling down the street. We can rise up together and face the real enemy and be waiting for him when he vamps; armed for self-defense from house to house, door to door, united facing our real oppressor, not ourselves, but the pigs!

THE SURVIVAL OF HUMAN BEINGS CANNOT BE DETERMINED BY CAPITAL AVAILABLE

Oppression, economic or racial, is meted out by the pigs of Babylon in many different forms. Because our everyday life is a political education class, we see and learn to resist many of the atrocious forms of oppression exemplified by the fascists of Babylon.

As we walk down the many streets in ghettos across America, we see all the forms of oppression of people of color. We see blatant murders of our youth by drugs or from the barrels on .357 magnums; we see many families who are sheltered in housing unfit for humans; we see children who are under-nourished because their families are unable to make that big "buck" to get the proper foods. Regardless of the types or forms of oppression in America they all lead to a harsh and many times a short life for the oppressed.

Mrs. Joan Watkins of 228 Seaver Street in Boston, a mother of a 4-month old child, like the majority of other Blacks in Boston, saw the viciousness of a greedy pig on October 9, 1970. Mrs. Watkins is a welfare recipient whose gas and electricity was shut off because she didn't have enough money to pay the bill. Mrs. Watkins after finding her utilities not functioning, called the Boston Edison Company. She explained to them that without gas and electricity that there was no way for her to sterilize her young baby's bottles or to feed them. The secretary at Boston Edison responded only with the sounds of dollars and cents that Mrs. Watkins owed on the bill. How can the very survival of a human be compared with money owed? After listening to this madness Mrs. Watkins called many more times to Boston Edison requesting to speak to a larger pig there. Each time she was refused and twice the phone was hung up in her face.

Being a welfare recipient, Mrs. Watkins called the welfare department to get money to pay the utility bills. They refused her the money. This whole incident showed Joan Watkins that America doesn't care for its people and that through forms of oppression such as this, that in fact the rulers of America (the businessmen who own companies such as Edison) are leading fascist America to its doom.

To counter this plan of the American pigs we now have the Black Panther Party which says in the Voice of the People that we no longer belive that our lives are meant to be lived in the inhumane fashion of our 400 year history here in Babylon. And to change these conditions we have nothing but a slave's life to sacrifice for our freedom.

MRS. JENKINS, LLOYD AND WILLIS McKINLEY ARE BUT ONE REASON WHY THE BLACK PANTHER PARTY CALLS FOR A REVOLUTIONARY PEOPLE'S CONSTITUTIONAL CONVENTION

On Thursday, September 24, at 4:30 p.m. Mayor Daley's gestapo troops saw fit to once again make an illegal raid on the Black community. Without any regard for life or property, they vamped on the home of Mrs. Cora Jenkins of 6917 S. Lowe. Mrs. Jenkins related that before her home was vamped on, she was going about her daily routine, cooking her children's dinner and having a general conversation with two friends of her's, Lloyd and Willis McKinley, when all of a sudden two pigs burst into her front door, two more came in through the back entrance, oinking some madness about, "Everyone is under arrest." When they were asked to produce a search warrant, they said that they did not need one and then proceeded to tear Mrs. Jenkins' home apart.

They went into the children's bedroom and overturned the bed and the mattress while some of the children were still sleeping on it. Then they advanced to the living room where they broke everything their foul eyes could see. Through all this madness, Mrs. Jenkins, Lloyd and Willis McKinley kept asking to be shown a search warrant or at least be told what the charges against them were. They were finally told that someone named Al had implicated all of them in a robbery.

Mrs. Jenkins told them that they were lying, and that the people in her apartment did not even know anyone named Al, and that they were just using some fictitious name and phony charges as an excuse to raid Black folks homes and brutalize and murder them.

When the pigs saw that Mrs. Jenkins had seen through their lies, their excuse for attacking her home then became, "You always have a lot of company in your house at night, and your Hi-Fi set (which they saw fit to break) was always too load at night." She then told them that she very rarely had company at anytime as she has five children to take care of, and she did not play her Hi-Fi at night, and if she did, her neighbors would have complained to her personally and not to the police department.

Mrs. Jenkins has five beautiful children: Vanessa, 14; Andre, 11; Cynthia, 9; Keith, 8: and Rico, 5. The power structure has no respect for Black people period! So it comes as no surprise when the pigs started cussing and yelling at the children, who were all awake by that time. Mrs. Jenkins told her children not to believe a word that was said against her and her friends, that they were not guilty of anything except being Black, and that most certainly is a crime here in Babylon.

Willis and Lloyd McKinley were then taken downstairs and their car was searched, two bullets were found in the car and the pigs ran back upstairs to the apartment screaming. "Where's the guns, where are the guns." They went through the apartment like a hurricane, the end result being that they found no guns at all. Lloyd and Willis told them that if any guns were in the apartment, that the house would not have to be torn apart to find them, that intruders would have known immediately if any guns were in the apartment.

Everyone in the apartment was taken to jail except the children. Now check this out, all the adults were taken to jail and the children were left in the apartment alone! Mrs. Jenkins had asked if she could call a friend so her children's welfare would be taken care of, and her answer was all kinds of obscenities being shouted at her, letting her know without a doubt, that fascism could care less about the welfare of Black children.

When everyone had been taken downstairs to be transported to 11th St. Station, the pigs noticed a pick-up truck parked next to the building in which Mrs. Jenkins lives. The truck belongs to a Mr. Gloves, who lives directly across the street. But it was said the truck was used in some robbery and that Mrs. Jenkins was the get away driver. Mrs. Jenkins can't even drive a car, she has no driver's license, and yet these filthy dogs had the nerve to accuse the mother of five children of driving a get away pick-up truck from the scene of a robberty that in all probability never occurred.

Mrs. Jenkins, Lloyd and Willis McKinley were taken to 11th St. Station, and were held there for twenty hours before they were released due to the lack of sufficient evidence against them.

Mrs. Jenkins said that the conditions at the jail she was placed in were deplorable. She was incarcerated in a very small area with a hell of a lot of other sisters. So many in fact, that none of them were able to move around. The toilet facilities were backed up to the point where the stool could not be used at all, and its contents were spilling out onto the floor. We can judge the degree of civilization of any given society by entering its prisons and if you know anything about the penal system of Babylon, you can readily see that this society has yet to become civilized.

What happened at Mrs. Jenkins home is not an isolated incident.

The same thing and worse is happening all over this decadent country. Our people are denied the right to exist, we are forced to live in indecent housing, denied proper medical attention, and on top of all this those who seek to change the conditions we live under are being murdered or sent to prison.

Mrs. Jenkins, Lloyd and Willis McKinley are but one reason why the Black Panther Party calls for a Revolutionary People's Constitutional Convention. The present U.S. Constitution has never applied to Black people and it never will apply to us. The people must move as one and write a constitution that will safeguard the rights, and adhere to their needs and desires.

Then the people must move as one to insure their new constitution's implementation. The people are the only ones who can halt the progression of fascism in this country.

We must deal the final death blow to the Nixon-Agnes-Mitchell regime and to all those who would have us be slaves.

The Black Panther Party calls for Black and progressive people to come to the Revolutionary People's Constitutional Convention tentatively scheduled for late Nov., 1970 in Washington, D.C., so that collectively we can get down to the business of creating a new and better world.

TALES OF TERROR

According to all the fables told about the American way of life, all citizens of this "democratic" system have certain human rights which can never he violated. But, after one recognizes a fable for what it is, a make-believe story, one comes to the realization that poor and oppressed people in general and Black people in particular have no rights, human or otherwise, that are inalienable as far as the fascist rulers of this country are concerned.

Miss Gloria Benton and her mother, Mrs. Jones, have analyzed this "fable" and correctly see it as a horror story. Here are their accounts of the gestapo raid on their house on September 29th, which resulted in Willie (Peedy) Turner, Jr. being kidnapped by the racist Richmond Pig Department, and then charged with killing a security pig two nights before, Gloria.

"I was in my bed watching T.V. when I heard a commotion. I heard a brother say. `Everyone be cool; they might shoot.'

I stood by the door calling my mother. She was saying, "My daughter is in the room: don't shoot.'

I got in front of the door to open it when he (a pig) kicked the door and it hit me causing me to black out. When I came too I found myself pushed against the wall, with my chin against the wall. One (pig) had a .38 in my back, one was holding a rifle, and one was handcuffing me.

They moved me to another bedroom where they had two other brothers handcuffed. I asked him (a pig) to uncuff me; he said, `No.' I told him that I had a bad headache; he told me to sit still and not to say anything else. At no time did they offer me first aid or offer to take me to a hospital. (She was not taken to jail.)

I went to bed around 2:30 a.m. but I only slept for about 30 minutes. Then I got up; I was having severe head pains. My mother took me to the hospial where x-rays were taken, and I was admitted for further treatment at 4:30 a.m.

I saw a brain specialist who told me that I might have a concussion. I also had nightmares almost every night concerning the door being kicked in. I was released on Friday only to be re-admitted on Monday, with a high temperature.

On Tuesday I was given a brain-wave test, and later told that I positively had a head concussion." Mrs. Jones

"I was riding with a friend when we were pulled over. A policeman asked me my name; I told him. Then I waited in the car until my friend finished walking a line on the sidewalk. Then I was asked to step from the car; I was handcuffed and told that I was under arrest for being drunk, which I wasn't. When I asked why was I handcuffed, he (a pig) said, `It's for extra precautions.'

At the station I was never advised of my legal rights. A detective said, `She's not drunk but we want to question her anyway.'

He said, `We think there is a gun in your house,' then they started asking if I knew a lot of different people. About now I found out that they (pigs) had told the man who was arrested with me that I had said he murdered the guard. Of course this was untrue. Finally they asked if they could search my house; I said they could.

Eventually they brought me back home. Two of the officers entered my house before I did. Then others began to come in, all with guns in their hands. They would not let me pass the living room to see my injured daughter.

When I was finally released I checked my daughter to see how she was. Then I went into my bedroom and found them (pigs) searching everything, dresser drawers, coat pockets, etc. (Ed, note, the pigs were supposedly looking for an AR-15 rifle.) When I went into the kitchen they were searching my refrigerator and cabinets.

Even though I never saw the gun they supposedly took out of my house, they continued to search the house for an hour after the gun had been supposedly removed, Then they left."

Illegally taken (kidnapped) from the house were four brothers, one of whom was charged with murder. So to those of you who think things are getting better, that we are making progress, you had better take a closer look at what is going on around you. The only way things will get better, the only way we will win our freedom along with the "inalienable rights" is to completely wipe out the fascist pigs of Babylon (America) -- all the pigs, from the Rockefeller clique to the lowly slime of the local pig departments.

SCHOOL ADMINISTRATION… HAND IN HAND WITH THE OPPRESSOR

The administration at the Woodrow Wilson J.H.S. in Dorchester, Mass, has joined the ranks of the physical oppressors in this country. This chool has lately been the scene of heavy racial tension. The kind that is frequent throughout the deep south. On September 22nd, two sisters were walking home from school when a middle-aged pig racist jumped from his car, and started to beat this 13 year old sister. When he thought he had had enough fun, he called his son (who is in his twenties) onto the scene to join in on the fun. The other sister then picked up a chain and righteously started to defend her comrade and herself. These two pigs had to retreat from the scene. A so-called routine investigation went on and the local precinet hogs (under pressure from the Black community) picked up a suspect and notified the mother of the molested girl, they didn't want to know the mother's address or anything like that. In other words, they really weren't interested in apprehending and convicting a true criminal.

The next two days at this school were stirred with racial violence. There have been beatings of brothers and sisters by gangs of racists that just lay in the streets waiting for the opportunity to go "nigger baiting". Everyday after school is let out the streets are lined with racists just waiting for their opportunity. They antagonize people and just generally try to run amuck over these brothers and sisters.

The administration hangs the blame on the small population of Black students. They question them, trying to intimidate false statements out of them. This is purely gestapo style! These pigs are showing Black people that they really aren't interested in the education of students, regardless of ethnic differences, but only in the repudiation of fair school at their own interests.

The precinet pigs in this community are just letting these racist local hogs run amuck over our Black comrades. Showing us all disregard for any rights that people are supposed to have. People have the right to an education. When pigs start infringing on those rights, it is the duty of the people to deal with all of these swine.

BOSTON'S SOUTH END… HOME OF THE LUMPEN, A SETTING FOR PIG BRUTALITY

The South End is the place you will find most of the hard core street niggers in Boston's Black section called Roxbury. The hustlers, pimps, and street sisters hangout on these corners making it the best way they know how.

This is the setting. Given this setting, it is quite easy to understand why the so-called upholders of "Law and Order", "The Keepers of Justice" -- the Boston Police Department, find the South End such a good area to display their complete violation of Black people's constitutional rights.

About three months ago, a brother by the name of Milton Blue was framed for a so-called stabbing of a man and his son. In reality, what happened was the man and son, along with some of their friends had jumped Blue, and Blue got some of his friends to retaliate.

A month and a half later, the Boston pigs were at it again. This time planting 11 bags of scag on this brother. Blue was charged with possession of narcotics, but has since been released on bail awaiting trial.

Milton Blue was instrumental in setting up this Drug Program for brothers and sisters who want to "kick the habit". The program is quite a success. For this reason, there is no doubt that pigs planted the scag on the brother because as I said before. Blue was instrumental in trying to stop what is commonly called "the plague", drug addiction.

Blue is not the only brother involved with this program that has been attacked. Charles Barton, and Hal Adams, two brothers who are actually in the program were ambushed by some of Mayor White's finest from pig sty #4. Seems that Charles and Hal were walking in the community (area around Mass Ave. -- Columbus Ave.) on September 18, 1970 at 3:00 a.m. in the morning. The lateness of the hour is due to the fact, not only are these brothers in the program, they work in the community organizing others. The brothers noticed these pigs harassing this sister, so naturally they approached the scene to check it out. All of a sudden there were pigs coming from everywhere oinking. The only thing the brothers did was to ask what the harassment was about. The pigs said something about the sister was honking her horn too loudly. Then the pigs threw everyone in jail-Hal, Charles and the sister.

The charges were as follows: The sister, it is still not clear what sort of charge can come out of honking your horn too loudly. For Hal and Charles, what else, assault and battery.

Why were these people's constitutional rights violated? First of all, the sister is Black. Hal, Charles, and Blue in addition to being Black, these brothers are putting up a force to oppose the dope pushing in our Black community, trying to get brothers off of what I mentioned earlier as being "the plague". Pigs don't like this. A brother who isn't nodding on the corners is much more able to deal with these pigs when the pigs choose to run through areas like the South End brutalizing our people.

So we say Right On Milton Blue, Right on Charles Burton and Right On Hal Adams.

COMMUNITY CONTROL OF PIGS IS ANSWER TO ENDING BRUTALITY

On Friday night, October 9, 1970, one pig was killed and two wounded, during an attempted robbery in Oakland, California.

The attempted robbery took place in the downtown section of town. One suspect was killed and another fled to the Lake Merritt section (where police reports state he later took his own life). The Lake Merritt Section is considered a nice, clean place. It is separated from the Black community of West Oakland by factories and businesses, freeways and traintracks.

If this incident had taken place in West Oakland we know from past experience that storm troopers would have come into the community 200 to 300 strong with automatic weapons, terrorizing the community, but how gentle and discreet the Oakland cops and Highway patrol were of the white middle class residents. They were middle class residents. There were no innocent old people terrorized, there were no mothers and babies who got their front doors kicked in, no window glass shot out, broke out, every inch of the luxury apartment housing where the suspect was `holed up' was left in meticulous condition. There were no tear gas grenades or tracer bullet holes. The cops did not even call the firemen to burn the suspect out, even though one cop was dead. I state the above to say this, on that spring night of April 6, 1968, when our brother `Lil' Bobby Hutton, age 17 years, was murdered, by Oakland cops and the Alameda County posse, the 1400 block on 28th street ran blood. Yes blood from brave Black men, no cop lay dead, yet every house on that block contained bullet holes. Many old people, and mothers with their children were teargassed and terrorized. Many Black people's homes were commandeered by the cops who made war on all the Black people of our community, while they unmercifully proceeded to murder `Lil' Bobby Hutton and attempted to murder several brave Black men. The elderly owner of that house on 28th Street still cannot live in her home. It is bullet riddled and half burned out by terrorizing brute cops who totally ignored all Black human beings while they (the pigs) pursued their genocidal occupation of our community.

It is such a contrast, when on October 9, 1970, the same cops with one of their own dead at the hands of white suspects, kept an almost silent vigil. The manners were gentle and above-board just the opposite of how they act in the Black community. These cops patiently waited for the suspect to surrender. Not even the manicured lawns were disturbed by the cops. No tear gas, no busted windows or kicked in doors, can't you see the contrast? I do, and I reiterate Point #7 of the Black Panther Party's 10-point Platform and Program:

We want an immediate end to police brutality and murder of Black people.

We believe we can end police brutality in our black community by organizing black self-defense groups that are dedicated to defending our black community from racist police oppression and brutality. The Second amendment to the Constitution of the United States gives a right to bear arms. We therefore believe that all Black people should arm themselves for self-defense.

Community Control of the Police is the answer to stop the police from terrorizing Black people in the Black community, while they treat white suspects with kid gloves in the white middle-class community.

FARNHAM COURTS IN NEW HAVEN COULD BE A HAPPY PLACE

Farnham Courts is a housing project isolated from the rest of New Haven way off in the Eastern end of the city. It was systematically separated from the rest of the New Haven community under the guise of Urban Renewal, Model Cities, all of which we all know as urban archetical genocide (for Black and other poor people).

"We want decent housing fit for shelter of human beings." For many of the residents of Farnham Court, they are fully aware of what our Point number four is all about. The outside appearance of the project in some areas looks like a bombed Vietcong hamlet. Glass covers much of the play area and trash lines the walk ways. We say that the New Haven Housing Authority pigs would like you to believe that the people are totally responsible for the appearance and the conditions described, but the people must understand who creates conditions for the people where they have to live on top of each other and are daily exploited in every aspect by this system.

It was apparent that our Party needed to extend our services to the people of Farnham Court. We went into the project, did door to door contact with many of the people and asked them what kinds community. The response was a need for a Free Breakfast for School Children Program and tutoring or Liberation School for the children. After that we began to relate to some brothers and sisters who lived in the project, where we developed a small cadre of workers. The first thing that we did was to mobilize some people and start cleaning off the glass filled play area. We approached the housing manager to borrow some rack shovels etc. but we were denied the tools. So we exposed the contradiction to the people, who in turn donated their own equipment. I then contacted a local group who lent us enough supplies to use. When the people saw us out there working, brothers dropped their bottles, children came and many other people began to pitch in to help make this a safe place for the children. As we cleaned up, we pointed out to the people that we were doing the city's job, and that just goes to show how the pigs have no intentions of relating to the needs of poor children when they would allow these kinds of conditions to exist on or in an area designated as a children's play area.

We had to set an example for the people because for too long, the people of Farnham Court have been denied the basic necessities which they have a right to as residents of that project. Revolutionary Art now plasters the outer project for all to see and relate to. We are gathering petitions for the Free Breakfast for School Children Program and we will struggle to organize the people around getting their basic needs met as well as educating them to the need for a new constitution. It has been said that grants will be pouring into the area to help the people, we plan to expose to the people exactly what those grants are about to and in whose interest they serve.

There are millions of Farnham Courts all across fascist America. Separated from each other by expressways, parkways, new industrial buildings designed for and by the capitalist. It is our responsibility to mobilize the masses of people who live in these concentration camps, raise their political level through our practice and service to them. It is our responsibility to expose a system which breeds these genocidal hovels where drugs flow freely, where poverty, disease and death are systematically destroying our people. Therefore, it is our responsibility to call for a People's Revolutionary Constitutional Convention to change these existing decadent exploitative concepts and ideas.

THE PEOPLE MUST REVOLT AGAINST THE PROFIT MOTIVE

We know that the pigs are and have long been on the prowl for us, huting, crippling and murdering us whenever they've chosen to do so. It should be enough that we are confined by the shackles of poverty, slavery and hopelessness. But no matter what the level of our depravity, the pigs seek always to push us farther down into the pits they've built for us. And for some people, some of the victims of this oppression, this is hard to understand. They fail to understand why the pigs, having already taken all there is to take, still persist in wringing their lives dry.

We must first understand that the very nature of pigs is greed. The thing that puts the oink in a pig is his greed. And we must also understand that our predicament here in America stems from our being exploited by pigs. We must understand fully that we have never, for as long as we've lived on this soil, been absorbed into the design of this country. Why?

Because the country is operated by the machinery of capitalism. That enemy, capitalism, is defined by Webster as "a system under which the means of production, distribution and exchange are in large measure privately owned and directed." Webster says further that capitalism is "the concentration of capital in the hands of a few, or the resulting power or influence." What Webster doesn't say (neither does the school text-books) about capitalism is that it can only thrive on the misery of other human beings. Capitalism, in order to maintain itself, must have a reservoir of people to exploit. In America Black people have made up the bulk of that reservoir. Our entire existence in America has been for the furtherance of capitalism. And that is why we have not been absorbed into the design of the country.

Webster is correct when he says that capitalism is a system under which the means of production are privately owned and directed. But again Webster isn't telling it all. He doesn't say that the "means of production" hinge on an abundance of natural resources, which are supposed to provide for the needs of the people, and which rightfully belong to all the people.

Though the capitalist pigs would have us believe otherwise, the earth is rich with natural resources: oil, gold, iron, copper, wood, silver, diamonds, lead, rubber and many others. And by owning these (after having taken them by thievery, cheating and murder) the pigs are able to control the world and all of the people of the world. For the natural resources are what the people depend on for their survival. By owning and controlling the natural resources (means of production) the capitalist pigs are able to manipulate the lives of the people.

The people's task then, is to reclaim that which is rightfully ours. The natural resources of the world are the property of the people of the world. They were never meant as "reward" for a few scheming individuals. And the only way for the people to reclaim their birthright is by means of violent struggle, the end of which must be the establishment of a new form of government, a new form of government whereby all the people share equally in those things that are basic and necessary to a decent standard of living.

"Revolution is the only solution."

The people must revolt against the profit motive: they must revolt against the hunger, the rats, roaches and the deaths that come from being ill-clothed and out of doors. The people must revolt against the educational systems that support and condone capitalism and its evil consequences, and they must revolt against the laws for the same reason. The people must revolt against the idea of private property because it is an idea that is against the best interests of the people. In short, the people of America must revolt against every system, agency and institution that is holding capitalism together.

We must attack this giant with vicious blows in all of its parts, and when it falls we shall plow it under and build new cities on its grave site.

JAMAICA PLAINS PROJECTS: BLACK COMMUNITY UNDER SIEGE

The Bromley-Heath area, known to the Black colony of Boston as jamaica plains projects is a living example of the effects of capitalism and racism upon a Black community. The projects are made up of 42 buildings, rat traps, with 1244 separate apartments. It's made up of the old projects, built during WWII, three stories high and the "new" projects are close to 4,000 people 99.99% Black and a small number of Puerto Ricans and poor Whites. With over 150 vacant apartments used by junkies to shoot up and continue their addiction (which Michale Tabor of the N.Y. 21, has defined as the "plague").

The avaricious slumlords of public housing, the Boston Housing Authority rips off over $75, 000 a month from the people and provides them with absolutely no services in return. Walking around the projects becomes an exercise in caution: with years of old piles of glass and garbage littering the walks, and when you dare look up, all you can see are broken windows the B.H.A. is still "coming to fix". The playgrounds look as if someone came through with an ax chopping up all the stone symbols of a so-called children's play area and it seems as if the B.H.A. goes out of its way putting broken glass in both the younger children's play area and on the basketball courts so that the Black school children can't miss getting cut or bruised or their clothes torn. And out of the told population of the projects at least half are under 18 years old, so naturally they will be playing around outside in the broken glass and garbage. The B.H.A. does nothing to remedy the situation and in fact, the maintenance men, the majority of whom are White and live outside the area, are hostile and downright arrogant when the people ask them to clean up. Besides, half of them have what we'll call a "drinking problem".

In a vain attempt to keep the people off their backs, the B.H.A. has followed the historical pattern of putting in a Negro manager, who acts as the go-between, the overseer, between the people and their oppressors downtown. The man knows he has absolutely no, 1-power to back up his position, he knows he is the manager, after 15 years as a maintenance man, because he has proven to be a faithful lackey. He knows this, but he still keeps the job and attempts to pacify the rightful demands of the people.

Even the supposedly simple act of sending the children to school has become a major problem for the Black parents in J.P. Ten days ago, a Black child was brutally attacked and beaten by racists on his way home from the Curley Union H.S. The next day there were more racists to run the Black school children home with clubs. When school reopened after the weekend, the Black school children successfully defended themselves against yet another racist attack. The following events were almost predictable. Boston's gestapo, "the boys in blue", followed a group of brothers walking back home from school and suddenly attacked them. They managed to kidnap one young brother Larry Palmer, 13 years old and beat him with blackjacks and billy clubs on the way to the pig pen #10. They told him, "Mr. Nigger, we're going to throw you into Jamaica Plain Pond, and no one will know the difference." After booking him and making him sign all different kinds of papers, these racist rednecked crackers told him "If you tell anyone, we'll tie you to a tree where the White people live and let them stone you to death."

That night, Larry's friends in the projects started breaking car windows to show their anger. 50-75 young Black school children (ages 9-16) decided to inflict their version of a political consequence. Once again, Boston's Tac Squad showed up and immediately they started shooting. THESE PIGS TRIED TO KILL OUR CHILDREN IN COLD BLOOD. FOR 10-15 MINUTES, THESE PIGS CARRIED OUT ATTEMPTED GENOCIDE UPON THE CHILDREN OF JAMAICA PLAINS. Fortunately, no one was hurt. The next day, the Curley School was so surrounded by pigs that the scene reminded one of Little Rock, or the University of Mississippi. Pigs were everywhere along the whole route from the projects to the school. If it wasn't for a group of older brothers from the J.P. Neighborhood House, a massacre would have been inevitable. This week, there was a meeting called by the principal, parents, businessmen, and the White racists who live in the area. No Black parents were informed of the meeting although five mothers accidently found out about it and went. It turned out that the businessmen were buying guns and arming themselves. In true capitalistic fashion, the pig businessmen were ready to kill Black school children to protect their "prvate property". Armed vigilante groups of the fascist majority were set up to patrol the area along with increased pig patrols. That well known rotund (fat) racist, Louise Day Hicks representing the Boston City Council told the group, knowing that the Black parents weren't even invited, "It is obvious by the turn out that some people care about their children and others don't."

For the people of Jamaica Plains Projects, this whole incident explodes for once and for all, the so-called "constitutional rights" to free public education. Subjected to bad housing conditions at home, parents cannot even enjoy the "human right" to feel safe sending their children to school. Pigs of all kinds have clearly shown that they will terrorize, intimidate and even kill. Such is the nature of the combination of racism and capitalism for the Black residents of j.p. projects. J.P. has become a Black community under 24 hour siege.

The rights which the Babylonians constitution supposedly "guarantees" are flagrantly disregarded and denied the people of Jamaica Plains Projects. Profit minded slumlords steal the money out of our pockets while pigs hold guns to our heads, or rather the heads of our children. Such is the reality of the daily life of the people of Jamaica Plain Projects, a Black community in the doomed and falling empire of Babylon, October, 1970.

15 YEAR OLD BROTHER ESCAPES RACIST SCHOOL

A little 15 year old brother walked into the Black Community Information Center and said that he had just run away from the racist Hagen School in Dorchester and he didn't want to even go back home. He said he couldn't stand the racist teachers and the racist atmosphere of the school in general. And while he escaped from the school he was beaten by a rent-a-pig. After rapping with the little brother, I found out that the cause of all his problems was the fascist Youth Service Board. He was sent to Youth Service Board for two years and was told to stay there for two years or go back to the fascist Y.S.B. for six months after he had already been there for nine months.

He was sent there for beating a sister up and the fascists added some other crime that the little brother didn't commit. The fascist pigs know how little brothers and sisters sometimes get into fights but this is just an excuse to take a young revolutionary off the streets. Potential revolutionaries are ripped off across Babylon as they try to survive in Black concentration camps, and many of the young brothers are ripped off for crimes that they don't even commit. For our young revolutionaries there isn't even such a thing as a trial since a fascist pig judge is the one who decides our younger brothers and sisters fate.

The young comrade told of the verbal and physical abuse he received from the moment he stepped foot inside the Youth Service Board at Bridgewater, and he noticed how many other brothers were there. The fascist guards love to call the brothers "boy", "nigger", and other racial slurs. And when the brothers speak for their humanity they are viciously beaten and brutalized, sometimes these pig guards beat them to satisfy their sadistic appetites. If the young brothers speak up for their rights too loud they are thrown in a dark, empty room to sleep on the cold floor for the night.

One time this young brother tried to escape from the hole and the door was slammed on his hand. Then he had to take care of himself (which isn't unusual since the inmates hardly ever get any medical care). The doctor only gives out pills or cough syrup and an inmate has to be on the verge of death before he is taken to the hospital. The living conditions are inhuman with the young brothers put into small rooms and forced to clean up the filth that the pigs have let build up. The young brothers have nothing to do but play basketball and pool all the time and are given no education the time they are in, which is the same for our youth on the outside, in minimum security prison.

But the fascist tactics that are used on our brothers and sisters only heightens their revolutionary consciousness (like Brother Chip Fitzgerald) the same as the penal institutions do for our men and women. Our youth will have a revolutionary ferver equal to that of the youth of the Viet Cong and other young guerillas. None of the kidnappings, brutalizations, and the attempts to stifle the minds of our youth will work because YOUTH MAKES THE REVOLUTION. The young brother knew where to go after he escaped from the fascist pig pen, because he wants to be a REVOLUTIONARY.

WELFARE… YOU CAN WAIT!!

In Boston, Mass., most stores usually close by 10:00 or 11:00 p.m. and that's on special evenings. This also includes drug stores. So, if you need a prescription filled after 11:00 p.m. you're out of luck. But there's one drug store that stays open all night. Phillips Drug Store on Charles Street is the only nearby drug store opened. So, for those that need medication, Phillips Drug Store is available.

I had to have a prescription filled and because it was late, I had to go to Phillips. I had the money attached to the prescription, so when I took the prescription out of my pocketbook, the money was visible too. I gave the prescription to the pharmacist, he told me it would only be a few minutes wait since there was only one person ahead of me waiting for a prescription.

While waiting, two women came in with prescriptions to be filled. The pharmacist told them they'd have to wait at least an hour. An elderly man also came in with a prescription and he was told the same thing. Since the pharmacist only had two prescriptions to fill before they came in. it seemed like a long time for them to have to wait. A couple of people came in after them and the pharmacist told them their prescriptions would be filled in a few minutes. Another woman came in and the pharmacist told her she would also have to wait an hour or more. Before she left the store, I asked her was her prescription going to be paid by welfare, she told me yes. She had given the pharmacist a card like the other three people who had to wait for an hour.

When the pharmacist told me the prescription I was waiting for was ready, I asked him were the people who had to wait so long having their prescriptions paid by welfare? He said they were. Then I asked him why they had to wait so long, he said because the ones that "pay" should be taken care of first. I asked why? He then told me because the ones that "pay" deserve to be taken care of first.

This is the overall attitude of store owners, doctors, and anyone else who comes in contact with welfare recipients. So, the people who receive welfare suffer though no fault of their own, are made to wait or they're told to go elsewhere. The housing available for welfare recipients is not fit or decent: the food is over-priced: the education is in competition with the decrepit buildings housing rats, broken windows and overcrowded classes; the clothing of the cheapest materials that are too expensive, and the justice is unheard of.

The basic necessities are overlooked by the present government. The voices of the people go unanswered by the present administrators. It's the ones who can "pay" who enjoy the basic necessities of life. That's not the way it should be, but that's the way it is. These are some of the reasons, some of the very, very good reasons why a new constitution must be constructed.

A constitution that serves the needs of the people, not the needs of a selected few. A constitution not for show, but a constitution that will be put into practice. A constitution written for survival and not for profit. There should be no excuses in the constitution for murder or for the brutalization of the people.

The Black Panther Party is calling for a Revolutionary People's Constitutional Convention. It's time that the people receive their inalienable rights. Its been too long coming. The time is now. There's no turning back, but there is a future, tentatively scheduled for late November, in Washington, D.C. The people will decide their destiny. The people will decide what goes down. The power will be with the people.

WE WANT AN IMMEDIATE END TO POLICE BRUTALITY AND MURDER OF BLACK PEOPLE

On Thursday, October 12th, the pigs of the Oakland community shot a Black brother in cold blood. A couple of days later the Berkeley pigs kicked down the door of the slain brother's house and beat and kidnapped his 14 year old brother and 15 year old cousin. Because we know that constitutional rights have never been applied to the rights of Black people, we are no longer surprised when a brother is murdered by the pigs and have it called justifiable homicide; we are no longer surprised when armed pigs kick down our door and kidnap our people without legal papers for search and seizure. We are not surprised because we know who the low natured beasts are, and we know that ultimately it will take the armed wrath of the people to drive them from our community.

The following is a statement made by victims, brother and sister, at their Berkeley residence tonight, October 12, 1970.

"Last Thursday on Fruitvale, David Kirkendall was killed by some police. David had been on LSD for the past six months or more, and although he had stopped he has never been straight. He would break in places and sit for long periods of time or write on walls, etc. He was attracted by odd things, he would stare a lot."

"While sitting in a closet in a cleaners on Fruitvale the pigs came and they said he came out of the closet with a 3 foot reinforcement rod. They shot. This happened at 9:00 p.m. and he died at 4:30 a.m. at Highland Hospital. X-rays showed the location of the bullet. David was administered no plasma, or nothing. The coroner performed the autopsy. He said the body had not been touched by any surgical needles. We knew of no doctors who had seen David while he spent all this time in the hospital. The medical report received only states that X-rays were made. No call was made to notify us as what had happened, and I am his brother, the next of kin. The next evening a friend called us and she had read it in the Oakland Tribune. We read it at 3:00 p.m. in the Oakland Tribune. We were never notified. This friend went to identify the body. The Tribune stated David died in surgery: We know for a fact that no surgery was ever performed. The Death Certificate only says that David died at Highland Hospital.

"David wasn't stealing. He had had an incident not too long ago about breaking into a record shop. He didn't steal anything there, either. He was just playing records. After this he went to Santa Rita, but was released because they had no past record to keep him on. His brother wanted him committed, but the authorities said that they would have to wait until he did something else. Herrick Institution wouldn't take him."

After he was killed, the sister called back and told them what had happened. The lady-doctor there expressed that it was a shame and that the family should write to the institution about the Petri Mental Hygene Laws. (Which states that no family member can have another member committed. The pigs have to catch someone doing wrong, and they recommend commitment.)

The Coroner said it was a 38 special magnum bullet. It was projected thru the lower abdomen. The sister feels that they just wanted to shoot somebody because David wasn't violent. He was described as being guiet, somewhat withdrawn, and didn't like to be around people. She also questioned why they would keep him for six hours without any medical attention. His blood is type A which is easily accessible and no dextrose or plasma was administered until blood could be . She also said it was a lie said he died in surgery. Even the Coroner says so. He was never in surgery. Berkeley and Fremont pigs (Fremont pig Shirley) have said that David never gave them any trouble. They can see no reason for shooting David, even if he did have a rod raised over his head, (about which there seems to be doubt). Ralph Torigiam, the owner of the cleaners (Scotch Cleaners and Dryers 2231 Fruitvale) assisted pig James Est (who fired the shot) and pig Thomas Lee in investigating the report that the cleaners had been broken into.

David had $600.00 worth of clothes with him that were never returned or even reported by the pigs. But the sister says that he had them with him when he was murdered. He was always well dressed because he had no wife or kids and spent all of his money on his back.

Three days later the same sister came by the center about 10:00 a.m. and gave un another eyewitness report of roving bandits (pigs) brutalizing and kidnapping more members of her family. First it was the Oakland pigs and now it is the vicious acts of the so-called best Police Department in the country -- the Berkeley Police Department.

"This morning I went to the store about 9:10 and when I returned there were 4 or 5 police cars parked in front of my house. This was less than 10 minutes later and there were no cars in sight when I left. I ran up to my front door and the police who were inside told me that I couldn't come in. I told them that this was my house and for them to let me in. The door was opened after I kicked on it and beat on it a while arousing the neighbors, but the officer told me to stay back or he would arrest me for interfering with a police officer. He pushed me up against the door and tried to keep me from coming in. There in my living room were two policemen beating up on my son Vernon. One had his knee in Vernon's back and they had his arm twisted around behind him. I went into the bedroom in the back and the same thing was happening to James. They had him handcuffed through his legs (meaning that his handcuffed wrists were cuffed underneath his knees) causing him not to be able to stand up but remain in a sitting position. He had been dragged out of bed and the police had even put some trousers on him, because when I left for the store he was still in bed in his shorts. I asked why all this was happening and what it was all about but they just told me to shut up or I would be arrested. The back door had been forced open and they had come in through the window. It seems if one pig knocked on the front door and Vernon went to answer it, one of them used some type of bar to force open the back door and one came in through the front window. Vernon told them not to be coming in through the window so they jumped on him and began to beat him. They tried to provoke him by pushing him around, but that didn't work so they began beating him again. The police said they were looking for James and a stolen bike. The brothers told them that James was not there and that he was not James, but this meant nothing. (James was there, however, and beaten too.) Yesterday, Wednesday, two police came by the house and asked me about a stolen bicycle. One of them gave me his card and it read "Mr. Ingle". He was one of the police who had busted in the house but this was not his name. I told them yesterday that I knew nothing about a stolen bike and that there was none at my house. They reported that they had seen James riding the bike and that he had stolen it. James told me that he bought the bike from a boy for $10 and everyone around my house rode the bike, even my husband, not thinking for a minute that the bike could have been stolen.

My house was completely ransacked and as the police left they told me nothing. I asked what the boys (14 and 15) were being charged with and what they were being held for and where were they taking them? But they only said "You just clean all this junk up." My young daughter said that they told her to shut up and get out when they were brutalizing the brothers.

Frank (a White neighbor) questioned the pigs about arresting the brothers etc. and they told him that they didn't have the time to go through the legality of arresting suspects. When she and Frank left the house to take the young children to her mother's house, there were still two pig cars on the block.

The brothers were being held at the Berkeley Pig Department and they had told the sister that they would not be released soon. Friday morning was the day of the funeral of her other brother, David, who the pigs shot and let die last week. These two relatives, James and Vernon would not be able to attend the funeral.

These vicious acts of brutality are part of a long train of abuses suffered by Black people at the hands of the pigs who occupy our community, just as the imperialist American pigs occupy the Vietnamese community. This violence is necessary in order that the pigs maintain the fear instilled in us for a period of 400 years. This violence is institutionalized and made a permanent part of our lives. Hunger is violence; inadequate medical attention is violence; unfit shelfter is violence; and all this violence is perpetrated by a vicious economic system (capitalism) which grinds and molds human beings to fit into designated areas. This violence is geared to break our spirit, to bend our knees, to make us submissive to the bandits who have kidnapped us, placed us in labor colonies, and maintained us in this position thru acts of violence. In one word -- genocidel!

We must understand these acts of violence and raise the level of awareness of brothers and sisters in the community to the point where we challenge the very machinery that is our most visible sign of oppression. When we say "All Power to the People," we have to think of functional and practical machinery which can make this a reality. Empty words are hollow with no substance, the rhetoric of power to the people will not get us our freedom. What will, is the uncompromising support of all our people in our just struggle for liberation.

In Berkeley, the Community Control of Police Petition will be on the April Ballot and if passed it would mean that the people in the Black community would be in a strategic position to take the struggle to a higher level. If passed, the people of the community would immediately elect a neighborhood council composed of 15 councilmen who would then elect a police commissioner and all policemen from the communities from which they live. This would mean that the office of Police Chief would be abolished and all personnel would be chosen from the Black community. It would mean that the people in the form of neighborhood councils would decide standards of conduct, policy, and not some city manager who is not an elected official, but appointed by the financial interest of Berkeley. On paper this would mean that the people would have the necessary power to check the conduct of those who act in the manner of murderers and madmen. They would have complete recall powers to discipline anyone who kicked down a sister's door and brutalized her kids or murdered her brothers.

But of course we know that a petition, or any piece of paper which guarantees us our freedom will be ignored. And of course we know that the only way in which we will win our just struggle is to do as the MPLA in Angola; NLF, in North Vietnam; and the Palestinian Liberation Front in the Middle East, to pick up the gun, to increase our fire power and move against the world empire -- Babylon. So it's up to the people in the Black colony to support the petition, exercise their constitutional right by hearing a shot-gun in every home, and when the pigs say we ain't got to implement the desires of the people, we will say, "We have a deed which says we can do anything we want to do!!

STATEMENT TO THE PRESS FROM WOMAN'S LIBERATION

presented at press conference Oct. 6, 1970

Women from Women's Liberation are here today to protest the racist, unjust jailing of our Panther sisters, Shelley Bursey and Brenda Presley. We believe these jailings are part of the systematic attempt by federal, state, and local governments to wipe out the Black Panther Party.

It is clear that newspapers and television distort the actions and goals of the Black Panther Party and other revolutionary groups. At the same time, the government is trying to stop the Black Panther Party from communicating to the people the truth about what really happens, a right which the Constitution guarantees in the First Amendment.

The Grand Jury Investigation and the jailings of our Panther sisters today are a direct attack not only on our Constitutional rights to free speech, but on the day-to-day survival of the Party, the Black Community, and all oppressed people.

As women we're speaking out because we know that our oppression comes from the same racist, sexist, capitalist power structure that is trying to wipe out the Panthers. We also know that the rich men who own this country maintain their rule by dividing the people - by dividing White people from Black and Brown people and by dividing men from women. But we refuse to be divided. We unite with our brothers and sisters of the Black Panther Party, knowing that together in strength, we will be able to combat the attacks of the oppressors and win our liberation.

I have seen you in your day to day work so I know your concern for the minds - bodies - spirits of the suffering people. And how you miss the people and how all of us, who are committed to fight to the end with you, miss you.

Wherever you are, know that people are working as never before. The Peace movement is being driven by the example of the Black Panther Party across the old class and caste lines toward the G.I.'s, the labor insurgents, the barrios, the ghettos - toward, at last, the people.

We know now that old John Brown was right: "The cost of repression is always greater than the price of Freedom".

We embrace you from afar and we work side by side. In the revolution, those who belong together need not be glued together. And we are all together as never before.

PIGS KEEP CHECK ON BOSTON BLACK COMMUNITY WITH ELECTRONIC CAMERAS

Early one morning, or late one night, pigs infiltrated the section of Boston's Black community, commonly known to everyone as "The Hill." When they left, electronic surveillance cameras were occupying "newly found" homes on telephone and light poles, as well as trees, Nobody knows exactly when the pigs were able to pull off such a degrading act, but right now all that is secondary. Our primary goal (in relationship to this latest pig maneuver) is to render this part of the enemy's information arm, inoperable. Granted, the pigs are using the best technological equipment available to man, but it is to no avail if these fools think they can so belligerently carry out their fascist methods of work, without some sort of response from the masses.

On Blue Hill Avenue, these cameras have already been put into service, between Edgewood and Stanwood Streets, an area of about five blocks. It is also in this same area, that the main body of Lumpen brothers and sisters off the Hill coordinate their daily activities. We see the hook-up the pigs are attempting to make with their brand spanking new "fortress" they had the gall to build on the transportational lifeline of the colony, Dudley Street Station. We see from jump street, the diabolical plot being hatched against the peace-loving peoples of Roxbury by the criminal Boston Police Department. Later for these frenzied mad-dog antics you are propagating. The niggers on the hill are quite capable of disposing of your spy boxes, the only question being…. should the people use them for struggle for national salvation of a very dispossessed people. No matter how it goes down, these cameras won't work for pigs, and that's a people's promise, made from the bottom of our hearts.

PEOPLE SAVE BROTHER NEAR DEATH FROM DRUGS

On Tuesday, September 29, about 6:30 P.M. while community workers from the Boston Chapter of the Black Panther Party were on their way home from a day of serving the people, we came across a strange and almost startling sight. There on the steps of the church on Warren Street was a brother from the community that we all knew. He was lying there in a sprawled out fashion motionless, and rigid. On further investigation his eyes were in a fixed state, he was very cold like he had been there for a long time; he had a very weak pulse and did not answer to his name. At first some of us suspected he had passed out from alcohol; others suspected drugs, anyway we all decided that we had better get him off the steps before the pigs did. We picked him up and began to walk him towards the community center. The blood could hardly stand up on his feet. We kept telling him not to worry, that he was with the people and everything was cool. We brought him inside and layed him down and covered him up with a warm blanket. I checked his heart beat and it was way below normal also his breathing was strange sounding. One of the brothers knew about drug effects and suggested that he not lie down because this would further slow down his breathing and heartbeat, that we should walk him around. We took him outseide an walked him up and down the street very fast checking his vital signs at frequent intervals. Someone said check and see if he is clean. When we stopped and looked in his pockets, we found a very large number of "ups" and "downs". We saved a sample of each and immediately took the brother to the People's Free Health Center. On the way we shook him constantly to make sure he did not go into a deep sleep. When we arrived at the clinic, they were having some difficulty with the generator that supplies the electricity for the lights in the center, so we walked the brother around a while longer. Once he was inside the doctor gave him a quick exam that showed his heart rate had increased somewhat. He was given some special medication, mailene and some dextrose and water, by vein. The brother was still only responding to deep stimulation like a pinch or a slight slap on the face. As the night progressed he did get better.

The point I would like to make is that we in the Black community have to be more concerned about each other. It doesn't matter if the brother was drunk or whatever. He is a brother and he needed help. What if he had died or the pigs picked him up and probably beat him up and took him to one of their racist hospitals. This attitude of "I don't want to get involved" or let the police handle it, has to end. If we don't look out for each other and care for each other then it will be our doom because no one else is going to. So the next time you see a brother or sister in need, help them out. You might even have saved their life. Don't look at the situation as just another drunk or addict but as your brother or sister.

WASHINGTON D.C.: THE OCTOPUS OF WORLD FASCISM

Washington, D.C., as the octopus of world racism, fascism and imperialism has tightened its closent tenacle around the necks of the city's Black residents with a strangling grip. Here, the Black population is both politically and mentally in bondage. As a very young sister said to a brother on the corner the other night, "There are still chains on you -- but they are invisible." Many of the Black inhabitants on Nixon's plantation dare not think anything which challenges the White wall-to-wall carpet decorum of middle class America. And those who do are offered one of the master's shiny trinkets and told to be quiet. Many of these sellouts function under "Black and Pride" disguises, while actually waving the red, white and blue; thus perpetrating madness among the masses of Black people. So the oppressed people have watched so-called liberators come and go with an understanding, "I told you so" attitude.

The political oppression is covered up with such nonsense as a non-elected "mayor", a presidentially (Nixon and his goons) appointed city council, and NOW they have the audacity to offer us a non-voting delegate to Congress. How in the hell can someone go to represent you at something if he doesn't have the power to vote. Meanwhile, back on the plantation, the "Black" mayor, Walter Washington, continues to condone and reside over this state of absurdity with a beaten dog look.

If any group of people need a new constitution, the people of Washington, D.C. stand at the top of the list. Under Article I, Section 8, of the present document, the executive and legislative authority for the District of Columbia is vested in the racist Congress. Although the 1802 charter gave Washington residents the right to control their local government, this right was recinded in 1878 by that same Congress. This, incidentally, was the year after the famous Wormley Hotel Conference where that baffoon demagogue. Rutherford B. Hayes, bargained away the political and human rights of all Black citizens in exchange for the U.S. presidency. He followed this action with the appointment of Frederick Douglass as Marshall of the District of Columbia. This same form of tokenism continues today creating the illusion of progress and justice.

Of those who sit at the government's table, the White racist ruling class dines first with a full course meal, the mostly White working class proletarian class eats second on the left-overs, and then the Black and other oppressed minority groups come in to clean up. So what this new constitution would do is re-arrange the dining order and giver everyone an equal chance at the table -- except those who insist on being greedy.

To continue under the kind of oppression which Washington, D.C. has inflicted upon its residents, as well as the freedom loving people of the world, is to condone slow racial genocide. This is the process one sees in a junkie's eyes on a street corner, in a welfare mother's figure from too starchy a diet, on the face of a Black school child whose White mis-education belittles and confuses him, in a government clerk's materialistic hang-ups which keeps him at the mercy of the avaricious businessmen in hopes that a new stereo will relieve his anxieties, or in the 120% American attitudes of the mod squad nigger pig agents. NO LONGER FUNCTIONING WITH THE B.P.P.

The Black Panther Party will always strive to maintain a level of practice of serving the people. In order to do this the Harlem Branch of the Black Panther Party has purged two individuals whose bad habits and half heartedness does not meet up to the revolutionary standards

Cheryl Foster was functioning out of the Harlem Branch of the Black Panther Party. She was purged for showing a lack of dedication and her bad habits, she was also dealing with Distribution, the books have never balanced. Embezzling is the charge for monies not being turned in.

Ronald D. Hester, is no longer a member of the Black Panther Party, by constantly showing a desgard for the principles which guide our party, he has proved beyond a doubt that he is not worthy of being a part of our branch. His comrades attempted to give him another chance to prove himself by putting him on working suspension. He failed to abide with the principles of the party, thus resulting in the violation of rule no. 4 of the Black Panther Party. Be on the look out for these fools because they have run out on the people at a critical point in history and must be recognized for what they really are ….. Cowards.

TOURE'S DEATH MOTIVATED MANY TO EMULATE HIS PRACTICE

The Black Panther Party has seen approximately thirty of its revolutionaries go down in the name of freedom and liberation since its inception. In the Southern California Chapter, eleven brothers have sacrificed their lives for the people and the struggle. Last year at this time, a beautiful revolutionary, a dedicated worker, and a true servant of the people, had his life snatched away by members of the local, reactionary pig force. This brother was known to all his comrades as "Toure". Toure, in his brief period in the Black Panther Party, exemplified the courage, steel-willed determination, and love and concern for his people, that every revolutionary should possess. No sacrifice was too great for this beloved brother - and he gave the ultimate sacrifice - his life.

Toure joined the Black Panther Party after his release from Tracey State Penitentiary in March of 1969. He had been in several youth camps most of his life because he was never able to comply with or condone the evils of this society which oppresses and exploits us. He chose, instead, to resist this power structure, which consequently led to his lengthly incarceration. While in the penitentiary he read the writings of Nkrumah, Mao, Fanon, etc. and acquired an ideological foundation which sustained him during his incarceration. He also became acquainted with the Black Panther Party and decided to join its ranks and make the Party and the struggle his life, after his release.

Toure displayed initiative and courage from the time he joined the Party until his death. He set some beautiful examples, for instance, increasing the paper sales from 7,000 to 10,000 within a few weeks while he was Distribution Officer for this Chapter. He realized the necessity of the "voice of the Panther being heard throughout the land" and worked very diligently towards increasing the circulation of the paper.

These racist pigs quickly recognized Toure's strength and devotion, and saw him as a threat to their security. They wasted no time in murdering this brother, mistakenly thinking that by killing a strong revolutionary, they would kill the desire for freedom which burns in the hearts of all oppressed people. But once again it was proven that you can kill a revolutionary, but you cannot stifle the desire for freedom.

Toure's sacrifice and contribution to our just struggle for liberation will never be forgotten because his ideas are manifested within the people. From the blood that spilled from his body that October night, sprang new courage and determination on our part to intensify the struggle. The pigs suffered a defeat when they murdered Toure because many people, brothers and sisters off the block, loved him and related to his practice. His death motivated many to try and emulate his practice and join in the struggle. As David Hilliard, Chief of Staff of the Black Panther Party, said at Toure's gravesite, "There will be tens of thousands of Toures" and we will never stop struggling until victory is ours.

PIG AGGRESSION

The Baltimore Pig Department once again showed its vicious and animalistic nature toward Black people on Tuesday, October 13, 1970. The people of the community were demonstrating against the racist dehumanizing prison system which brutalizes and oppresses so many of our brothers and sisters, not only in Baltimore but all over America. The people were marcing and singing to give support to the brothers and sisters in the Maryland Penitentiary, and to show that they care and understand the debasement to which the inmates are being subjected. Most of the brothers and sisters in the minimum security prisons are subjected to more pig brutality than the rest of us in this minimum security prison (America). In addition to this, most of the brothers and sisters are being held on trumped-up charges, at unreasonable balls which amount to ransom, and have not been tried by a jury of their peers. Although it is well-known that the conditions of the Maryland State Penitentiary (pig sty) are atrocious and that the pig guards who maintain this system are both racist and brutal in their treatment of the prisoners, this and other oppressive institutions are allowed to continue this madness unchecked.

The rally on that Tuesday, began at about 4:30 p.m. and proceeded in single file and in a peaceful manner from Eager Street, around the community. About 50 pigs, including head-pig Captain Grover, had been called out to maintain "law and order" at the demonstration. Because the rally was so peaceful and orderly, the pigs created an excuse (as usual).

One foul pig started it off by having the audacity to put his slimy hands on brother James (Carl) Owens, pinning the brother's arms behind his back and shouting, "alright, break this up, break it up." The brother proceeded to inform the pig that he could not break it up because it was not his rally, it was the people's rally. The low-natured beast took this as an excuse to begin viciously beating and clubbing the brother. Minutes later a group of pigs attacked sister Angela Hatten, beating her in the face and back with their clubs. After this the sadistic appetites of the animalistic dogs were really stirred up and they went wild. A group of pigs viciously attacked and brutalized brother Baloti, beating the brother to the ground. At this point, head-pig Grover gave the order, and the rest of the 40 or so pigs began to beat and chase other members of the rally, and also innocent by-standers in the community. The pigs resorted to this low, brutal form of bestality even though women, old people, and little children were involved in the rally.

After the crowd had been dispersed, the pigs rode around the community in their paddy wagons, picking up anyone who they found still in the area. This is why the incident resulted in 22 arrests.

It must be pointed out that the constitutional rights of all of the people brutalized and arrested that day were flagrantly violated.

(1) If this government were truly of and for the people, it would not be necessary to demonstrate for human rights and dignity which the people expect. These things would be given naturally as normal constitutional guarantees.

(2) The people have a constitutional right to peaceful assembly and to demonstrate without being harassed and brutalized by the pigs.

(3) 25,000 ransom was imposed on all of the 22 people arrested at the rally. The constitution explicitly states that unreasonable bail shall not be placed upon a citizen after arrest. This high bail is unreasonable because the average poor person would never be able to raise it. This is why we the people of Babylon feel the need for a new constitution in this racist land, which will take our desires and needs into consideration. Our present constitution, as it is implemented by the pig power structure protects only the rights of the wealthy, bourgeoisie class in this society. The poor man has no rights which the pig power structure is hound to respect.

As if this insult to the brothers and sisters were not great enough, the following day the pigs continued to perpetrate their vile madness. These dogs kidnapped three brothers, Paul Coates, James Green, and Eric Smothers, as they sat quietly in the eastern district courthouse, attending the trial of the brothers and sisters illegally arrested the previous day. They were thrown in jail and charged with the same trumped-up charges that all the other sisters and brothers were charged with on the day before:

(1) inciting to riot (2) disorderly conduct (3) resisting arrest (4) assault and kicking (5) deadly weapon (6)assault with a deadly wea-assault and kicking. How could the brothers have committed these crimes while sitting quietly in the courtroom? (5) deadly weapon (6) assault with a deadly weapon and (7) failure to obey and officer.

That same night another page was added to these ugly incidents when two more brothers, Larry Sorrell and Will Joyner were kidnapped by the pigs from the corner of Gay & Biddle Sts., as they stood talking to two other brothers. They were thrown in jail and charged with the same trumped-up lies and held at the same unreasonable bail (ransom) of $25,000. This madness must cease. The pig power structure and its lackies must learn to respect the legal and human rights of all our people or face the wrath of an armed people.

COLUMBIA POINT, MASS.: AVARICIOUS STOP & SHOP: EXPLOITER OF THE PEOPLE

WE MUST RE-WRITE THE CONSTITUTION AND PUT IT INTO PRACTICE WITH OUR LIVES!

The greedy, profit-mongering capitalists of Stop & Shop food stores are robbing the people of Columbia Point Housing Project just as if they have guns to their heads. Food prices leap up suddenly when it nears the first and the fifteenth of the month. This is the time when people who are supported by state aid and social security usually receive their checks. The avaricious hogs of Stop & Shop are well aware of this and greedily try to take all the money that Black people and poor oppressed people have and give them little or nothing in return.

The Stop & Shop also demands that young brothers and sisters bring notes from their parents in order to enter the store alone. They claim that theft among this age group is high, but we are aware that this discriminatory practice is only directed toward the Black and the poor. The Stop & Shop is a monopolizing capitalistic enterprise who hides behind the facade of so-called mini-pricing to rip off the people. Mini-pricing is in reality, maxi-pricing and these extortioners have no regard for humanity except as a source to reap profits. In order to completely fool the people in their hold up practices, Stop & Shop has hired a nigger reat-a-pig who packs a .357 and does not hesitate to harass and intimidate the shoppers all of course with the approval of the management.

A few months ago the people of Columbia Point organized themselves in order to move against the practices of Stop & Shop. When the capitalists heard that they would definately be boycotted unless their behavior changed, they quickly oinked that it was unnecessary to move in that manner and that they would repent, change their ways and from then on give only fair prices to the people. The lies that came out of the mouths of these pigs are clear for all to see because the new policy of fair prices did not last long and now Stop & Shop is up to it's old tricks again.

Well Stop & Shop, let it be said that you have fair warning that unless you cease your profit mongering at the expense of the masses, immediately, the people will inflict a death blow and take your ugly head.

NOTES ON THE TRIAL OF CHAIRMAN BOBBY SEALE AND ERICKA HUGGINS

On Oct. 6, 1970, the fascist Superior Court of New Haven opened the case of Chairman Bobby Seale and Sister Ericka Huggins on the beginning of the trial motions for pre-trial motions for arguing. The defense, Katy Roraback for Ericka and David Rosen acting attorney for Bobby asked that charges be dropped on grounds of the foul publicity that the case received in the past year from the news media. The defense subpoenaed newsmen from various news media and they were asked to bring in past article texts on broadcasts etc. that related to the Black Panther Party, the trial of Lonnie McLucas or the trial of Ericka and Bobby and others of the New Haven (9). News reporters from radio WELI, New Haven Register, Waterbury Republican, Hartford Courier ect. were called to the stand. After their testimonies, it was proven that these news medias have the power to inflict their bias on the entire country at any given time.

Then the defense called Pig Chief James F. Ahern to the stand. Ahern was asked about the past statements he made to the press relating to the Black Panther Party or connected with the Connecticut 9. Ahern denied making any statements, then admitted to one. He said that he hadn't made a statement about the Party since May 1969. Then David Rosen asked him about a statement that he gave to a WAVZ news reporter during the time of the trial of Lonnie McLucas. (Another member of the Connecticut 9 who was convicted on August 21st and sentenced to 12-15 years maximum security.) Ahern denied the statement that Rosen showed him. Then the defense presented motions:

1) The defense asked that other co-defendants in and out of custody (Rose Smith, Frances Carter, Peggy Hudgins, Lonnie McLucas, George Edwards, Landon Williams and Rory Hithe) be present at the trial. This was denied without prejudice (which means that it would be reconsidered at any given time the defense chose to re-introduce the motion.

2) A motion to sequester the jury. Denied without prejudice.

3) A motion to sequester witnesses. The defense requested that the motions be held in abeyance until it can be discussed with Charles Garry (Bobby's lawyer).

4) A motion to have information on all witnesses (in case the state has information that the defense doesn't). Denied.

5) A motion to question the questionnaires returned by jury candidates. Granted.

6) A motion to have some of the information on police wire tapping, bugging ect. Denied without prejudice.

The subpoenaed Chairman of jury committees, were mostly from the suburban area on New Haven, Connecticut, Guildford, Milford, Waterbury, and Ansonia. They were asked questions how they picked juries. One man said he used a computor. One woman said she uses her own initiative, and people just came up with all kinds of crazy answers. They were asked were Black people in their communities. They all answered no, most with racist attitudes. At the end of each day the handful of spectators would race to the pig parking lot and see Ericka and the Chairman off.

Thursday, Oct. 8th, defense continued. As the day before, they questioned jury committees. Defense called Yale psychiatrist Dr. Miller to the stand. He was asked questions on the propaganda the news media put out relating to the Party and how it would affect the people. Dr. Miller said that it would definitely turn the people away from the trial and that nothing could overpower it. Defense lawyer Katy Roraback showed Dr. Miller a news clipping of an old article from Yale President Kingman Brewster saying that, "It is a fact that Black revolutionaries cannot get a fair trial in the state of Connecticut or any other state in this country." Katy used this and asked even after that statement from the Yale president did he think it could over power the bias from the news media. Doctor Miller said, "impossible". Katy then said this pushes motions for the charges to be dropped. State's Attorney Arnold Markle cross-examined Dr. Miller and asked him did he feel that if the trial was moved to a town where no one knew about it, that the trial could stand -- Dr. Miller said he guessed so. Judge Mulvey denied the defense motions.

Friday, Oct. 9th, the defense continued to cross-examine the questionnaires from the jury committees, which were the same as the rest of the week.

We all know the power structure is trying to destroy our Party and our leadership, but we say the pigs cannot destroy the Black Panther Party because the spirit of the Party is manifested within the people. The people demand that our Chairman and Sister Ericka be set free NOW!

RANDY WILLIAMS DENIED BAIL

(Oakland) - October 20, 1970

In April of this year, the pigs of Oakland kidnapped brother Randy Williams off the streets and framed him on the charge of intent to commit murder. This kidnapping was the culmination of two years of activities by District Attorney Jensen and the Oakland pig department, to remove this beautiful brother from among us, where he was waging a tireless struggle in behalf of our people here in imperialist America. Ever since that time, Randy has been held in maximum security in Alameda County Jail on a ransom of $75,000.

And now after 6 months of hard work to raise the ransom, on the part of the people and the Black Panther Party, (of which Randy is a member), after raising the ransom and going down to the courthouse and paying the bail, getting a court order to demand this righteous revolutionary brother's release, pig Jensen oinks and says "that the procedure we went through to get the brother out was unconstitutional".

Can you imagine a pig who has condoned the murder and brutality of the people here in Oakland, a pig who has violated all the constitutional rights of our people, now saying that our attempts to free one of our people from their foul clutches is unconstitutional.

The only fitting answer to this fascist could be that we will have our freedom, or Babylon will be destroyed in our attempts to gain it.

THE PIGS HAVE NO RIGHT TO PERSECUTE RONNIE

Early Wednesday morning, Sept. 9, 1970, a "scouting team" of so-called policemen approached the doors of the East Coast Distribution Office of the Black Panther Party at 101-16 Northern Blvd, with their guns upholstered and with the intentions of shooting their way into our office. These pigs are supposedly looking for brother Ronnie Morris, who has disappeared because he could not relate to being railroaded to jail for the next 7-15 years. Ronnie Morris, is the innocent victim of a racist back-biting frame-up and the fascists and their guard dog judges are now working overtime to confine this revolutionary brother to their dungeons or murder him in the streets.

Because the pigs are unable to find Ronnie they may be desperate enough to "justify" a raid on our offices, and kick their way and shoot their way into the masses of the people of the community. We say that the series of events leading to the possibility of an attack on our offices began when pigs or agents of the pigs shot into the East Coast Distribution Office last week and then fled before they could be dealt with. We also raise the issue that if these butchering bandit police or their agents wish to search our offices, they can do it only if our lawyers are present and a "search" warrant stating specifically who they are looking for is shown to us. If the pigs can't relate to these conditions, and insist on crashing into our offices, then we will take all necessary steps to defend our homes and lives. The pigs have no right to persecute Ronnie Morris and they have no right to expect him to just sit idly by and be dragged off to some filthy prison. The brother has moved to a different stage of the struggle and has no intentions whatsoever of being a foot-stool for political repression and fascism, and to that we say Right On!

TOLEDO PIGGERY CONTINUES

As if the vicious enemy attack on the Toledo N.C.C.F., headquarters early Friday morning was not enough, the Toledo Pig Department displayed another show of Toledo Piggery at its worse. Dorr St. was kept blocked off for an unreasonable length of time, and pig security was entirely too heavy. The pigs harassed and threated with death all Blacks who came near or tried to walk down Dorr Street. We have homes, stores, churches and a ballroom which are the peoples. The fascist fools were trespassing on the people's property, disturbing the peace of the people. Blacks were abused with heavy racial insults and arrested on the most ridiculous charges. Some in which brute force was used.

Two members of the Toledo N.C.C.F. (brothers Conrad and Kenneth) were kidnapped, while on their way to the office, and illegally held for eight days in the Toledo Pig Pen. The brothers were unable to make a phone call to let anyone know what had happened to them.

Their rights were violated time and time again, and they weren't allowed to call or see an attorney.

We say that "We want an immediate end to police brutality and murder of Black people."

It has been a week and a half since the vamp by the pigs on our headquarters. They are still holding Brothers Mike Cross on a $20,000 bond, and John McClellan is still facing a first degree murder rap. The pigs say he killed the racist pig William Miscannon, who was known for his racism and hatred of all Blacks. He was hated by all the lumpens.

The Toledo N.C.C.F. members and people of the Black community say: "We are not going to let them kill our brothers on no trumped up charges."

THE PIGS RATHER CLASSIFY US AS CRIMINALS THAN HUMAN BEINGS

On the night of Saturday, October 10th, there was an outburst at Edgecombe Rehabilitation Center. Some members of our branch went to investigate the situation. When we arrived on the scene we found the area already staked out by an estimated one hundred pigs, all of whom were prepared to deal with the addicts in their normal brutal way.

The pigs were already talking with the addicts inside the barricade, but they wouldn't allow anyone else to communicate with them. Two hostages were taken by the addicts, but they were released within the hour. One of our members, Ronald, and myself talked with the hostages. Russell and Kelley. They told us that they were not treated badly at all, but they were shook up. However, the pig media claims they were injured by the addicts inside the center which proved to be nothing more than a prison.

The men inside the center are fenced in and there are security guards watching over them seeing that they don't get any further than the front door. The men are put there by the courts and very few of them are there on their own. What these men who went there on their own found was not a drug addiction center, but a prison in a Black community and they were subjected to prison-like treatment.

An official for the security guards, a Black lackey by the name of Frank Williams claimed that the guards are there to help these addicts. But we were informed by some of the people in the community that some of the addicts have been brutally beaten. Addicts are placed in this so-called center until the courts decide if they are drug addicts. It is the courts who decides who gets treatment for drug addiction and who goes to jail for crimes they are charged with.

There is no separation between those addicts who have volunteered for the aid they thought they would get at Edgecombe, and those who have criminal charges against them.

This once again goes to show us that the pig power structure has no respect for poor and oppressed people and they would rather classify all of us criminals rather than human beings. We can no longer tolerate the kind of treatment that the pigs are bestowing on us. We know that the piggish power structure is responsible for the dope in our communities and it is another form of genocide in the Black communities. We know that it is the duty of the people to unite together as one and deal with these vicious pigs and those bootlicking Black lackeys who are perpetrating genocide on us through the use of this deadly poison known to us as DOPE.

VOICES OF BRANCH QUEENS

To the people of all communities; bear what the bloods have to say about this mad system. The fascist pig system of justice and equality for the bloods here are somewhat contrary to what knowledge the community has of the pig's media. This is what the pigs call justice and equality for the bloods here; rising with the dawn to reach the court premises in the late afternoon and never reaching the court room, this is our justice? What of our equalities? there is no such thing as quality or justice in the pigs institutions for the bloods waiting to be tried. This is why the revolutionary brothers MaGee, Williams, Mclain and Jackson took that stand against the gestapo system, the pig system! This is also why the brothers in the (Tombs) were very rebellious. Still there was no justice and equality. This is why the people of the communities must hear the voices of the bloods within these walls, for without the support of the people there will never be no justice for the oppressed people incarcerated by the mad "pigs". Speaking of justice, well this is what Hitler called justice for the Jews; putting them in gas chambers, well this is what the "PIGS" are doing to all the brothers and sisters throughout the country; but the techniques are somewhat different but the form is still mass genocide.

The Bloods here are trying through the Black Panther Party to reach all bloods that are incarcerated by the "pigs" within all the concentration camps that the time is at hand to rebel against the "pigs" system and bring it to its destruction. So now we ask the people of all communities to give us support by letting our voice be your voice and let it be heard throughout the communities and I will assure you that with your support that we will bring this mad "pig" system to its final analysis. So we ask the people of the communities shall we wait four hundred more years for justice and equality from this fascist system, or shall we take arms against this mad "pig" system and rebel, as Jackson, McClain, Williams, and MaGee etc. We too are ready to die! For it is not, death that we know life? Is it not hard to live? Shall it be easier to die?

I remember sitting among hundreds, a man speaking with a heavy voice, and on his chest he wore many buttons, saying people we have no choice, I remember a woman weeping over her child, as he laid face-down, but there were no tears in the woman's eyes. Was it a happy death? I wondered why? I remember my own blood, saying pick up a gun or die. Why did he say this? Then again I wondered why I am seeking the answers, I could not find even with eyes. I must have been blind. But most of all I remember when the man with the buttons, the weeping woman, and my own blood were killed by the "pigs" known as the fuzz. I remember not wondering why, because it was for me that they had died. The awareness grew and never stopped. Through revolution that's how it's done! I remember! and I'll never forget, it's revolution or we're all dead.

REVOLUTION 1970

America has turned another screw on the rack of oppression by declaring the Black Panther Party subversive. It is time to completely dedicate our efforts to waging the war for survival until the masses relate to the struggle as theirs. The logic for our situation is simple and clear. Black people in this country were originally designated a cheap labor force. We served that purpose for over 300 years in this country. Black people were in overt (outward) bondage for over 300 years. In the past 105-110 years since that shackle slavery. Black people have served as a labor force capable of accomplishing the tasks of advanced civilization only by freeing our hands, feet, and backs. There has even been a freedom granted our minds by way of our historically recent cultural enlightment. Yet we cannot lose sight of the overall cunning of this vicious, corrupt system, as Malcolm X called it. We cannot be fooled into thinking that the power structure has just overlooked us with the exception of the Black Panther Party. There is a plan. There is a disposal plan. As Black people have served their purpose they are no longer needed. How long do useless items collect in your house? Is 105-110 years long enough? Maybe there has been no facility for disposal. Maybethere has been no time. Well now is the time. The plan for genocide is clear, the time to oppose it is now.

I say again, Black people in this country are no longer needed as a labor force. A capitalistic system requires the implementation of the principles of conservation of resources. Black labor is expendable; therefore, Black people are expendable. The disposal, known as genocide, is being implemented by monopoly capital's economic exploitation and the institutionalized education of the masses to racism. Racism and capitalism are the tools of our planned execution.

The Party is doing all it can to educate Black people to our present situation and hopefully progressive White people will realize that their poor masses are next. If this was just a Black people's problem we might be doomed, but imperialism must oppress all the masses. Black people only manufacture 50 billion dollars for consumer use and this is petty cash. You will remember that White people have been killed too. They have only been allowed to think they belong to a privileged class. The masses of Black people have not been so fooled. Our oppression has been more open and now the pigs are moving to eliminate us. We have no choice but to Seize the Time. All Power Belongs to the People!

A CHRONOLOGICAL HISTORY OF THE NATIONAL GUARD

(A MILITARY INTELLIGENCE SUPPLEMENT)

PART 2

1921 The militia in Newport, Ky., brought in a tank to suppress strikers in order to enforce a curfew law during a strike. The strike lasted for seven years.

1922 Another year of great industrial terror. Outwardly, these strikes appeared as disputes over wages or hours of labor. Fundamentally, however, they were revolts against a powerful campaign waged by industry to destroy unions. Strikers fought these battles primarily to hold on to organizations they had built up through years of painful struggle.

TEXTILES: A strike began in the Pawtucket Valley and rapidly spread to other textile districts in New England. 100,000 workers in cotton mills joined the fight against wage reductions and the attempt to lengthen the working day. Employers were well prepared and had organized scabs and private armies in advance. The militia was quickly ordered into strike areas with instructions to shoot to kill. Mills became small fortresses, with machine guns on roofs and police armed with shotguns, Several strikers were killed. After more than seven months, workers forced a compromise in most places, although in some cities the strikers were completely defeated.

MINING, 500,000 members of the United Mine Workers (UMW) and 100,000 unorganized miners in West Virginia and Pennsylvania struck after owners' violated their contract. The government, anticipating the strike and more interested in protecting owners' profits than in upholding the law, mobilized forces before the strike was even called. Governor Sproul called a conference of all sheriffs in Pennsylvania and instructed them to "suppress revolts before they start." Great quantities of guns and munitions were shifted from the southern part of Ohio to the National Guard which had promised to help owners crush the strike. In West Virginia, constables were drilled for strike duty many weeks in advance, and a federal judge issued an injunction against the UMW making it practically illegal to strike in the state. In Brownsville, Pa., 1200 mounted police attacked 8000 miners on parade, wounding many. The Governor sent 1100 soldiers into bituminous fields to guard workers who were expected to flock back to the mine, but didn't. In every city affected by the strike, virtual martial law was declared and strikers and their families were attacked, terrorized and beaten. Owners' attempts to operate mines with scabs resulted in open clashes. In Herrin, Ill., scabs were armed and guarded. A group of unamred strikers approaching the mine to discuss the strike were fired upon by the mine superintendent and others, killing two strikers. Miners from all over the country marched on the mine seeking revenge and the resulting gun battle killed 19 hired gunmen. The coroner's jury found the deaths due to direct and indirect acts of officials of Southern Illinois Coal Co. But a savage campaign against the strikers resulted in the arrest of 214 workers. President Harding failed to break the strike with federal troops and appealed to 28 state governors, requesting them to urge mine owners to open their mines with such men as were willing to work, promising them full protection. Governor Sproul sent 1100 soldiers, the Governor of Indiana sent 1000 and governors of other states did the same. But the strike continued for months, until John L. Lewis, head of the union, signed a compromise agreements, the worst part of which was a separate contract for bituminous and anthracite miners, further dividing the workers.

RAILROAD: Nationally, 400,000 railway shopmen and 100,000 workers in related jobs went on strike against reductions in wages and the company rescission of all concessions grated the unions before the war. California, Indiana, Missouri, Mississippi, Kansas and Illinois mobilized their National Guards to protect scabs operating the railroads. In other places, United States marshalls were used and the appointment of deputy marshalls was authorized in several states in the West and Southwest. In almost every railroad center, virtual martial law was declared. The strike was crushed and the unions almost entirely abandoned.

1926 Workers at the Botany Textile Mill in Passaic, N.J., belonging to a United Front Committee were fired for demaning that employers rescind a wage cut. 6000 mill workers went on strike and other factories joined in until 16,000 striking workers brought Passaic's textile industry to a standstill. Mass demonstrations and picketing were organized in support of workers. Firemen and gas bombs were used to stop the picket lines. Alter almost a year and after textile workers had joined the more conservative AF of L, Botany mill owners hagave in to some union demands, and other companies followed, settling the strike.

1927 6000 Colorado miners struck under the leadership of the International Workers of the World (IWW). The state government used machine guns and other forms of terror, killing and wounding many strikers. The strike was crushed and the IWW with it.

1929 Textile workers of the Gastonia, N.C., Manville-Jenckes Mill struck under the leadership of the new National Textile Workers, Union against wage cuts and firing of union members. Five National Guard companies were called out. Strike headquarters was attacked and the strikers' relief store destroyed. The tents housing strikers evicted from company houses were fired upon by police. The workers defneded themselves and in the struggle the Chief of Police was killed. Strike leaders were immediately arrested and charged with first degree murder, which was lowered after a storm of protest from all parts of the country, but the Gastonia strike was crushed and the union forced underground.

Elizabethton, Tenn., rayon workers walked out but were defeated by widespread terror set loose by employers and local police. Textile workers of Marion, N.C. walked out against a wage cut, under the leadership of the United Textile Workers (UTW). Sheriffs and deputies fired point-blank into a peaceful picket line of unarmed workers, killing six, crusing the strike. Streetcar workers of New Orleans waged a militant strike in July but were defeated by attacks which left one worker dead and many wounded.

V. The National Guard Suppresses the Unemployed

1931 An Army General addressing the National Guard Association (NGA) stated "This organization needs to be stirred up a bit as to its history." He had been unable to learn anything about it.

1932 Army Chief of Staff Douglas MacArthur told the NGA. "Your influence has contributed powerfully in combatting the rising tide of pacifism."

20,000 World War I veterans gathered in large contingents across the country, seizing trains for transportation, and marching to Washington to fight for immediate payment of the bonus promised them by the government after their request had been turned down by the Ways and Means Committee. Vets refused to obey an order to evacuate Camp Anacostia and police attacked them, killing a member of the Workers' Ex-Servicemen's League and another veteran. When vets repulsed the attac President Hoover called out the Army. Gen. MacArthur, Col. Patton, and Maj. Eisenhower led their troops in driving the vets from their encampment to the ground. Guardsmen were used in several states to prevent violence as the "Bonus Marchers" came through.

Major Hamilton, who doubled as company doctor for the Inland Steel Co., and chief recruiting officer for the Indiana National Guard, used his authority as a doctor to pressure workers into the National Guard.

THE BLACK PANTHER PARTY MEETS THE BASIC NEEDS OF THE PEOPLE

The people of the Fillmore Community of San Francisco came to the Black Panther Party to get something that the pigs deprived them of from the day they were born; food, a necessity to live.

The Black Panther Party has contributed to bringing an end to the robbery by the merchants of our Black community by implementing programs, such as Free Breakfast for School Children Programs, Aid and Loans to Welfare Mothers, Free Food to the Black community. This covers Breakfast, lunch and dinner.

No more do the people of the Black community have to spend that dollar to buy a whole meal in the pigs' market because as long as the Black Panther Party has free food for the people, we'll cut that dollar bill in half and we will move on such a level that the dollar bill will be trivial (small) as a speck of dust.

The National Distribution Office of the Black Panther Party gave free food to the Fillmore Lumpen community of October 6,1970, at 7:00 p.m. The people from the community heard about the free food that the Party was giving away and made it to the office of the Black Panther Party to get their share.

There were people there ranging from age 4 years old to 60 years old and over. Little brothers and sisters came on bikes, elders came by foot or car.

The pigs oink that the Black Panther Party as being a violent group of Black people. All the Black Panther Party consists of is a group of Black people who are defending oppressed people from lack of employment, from robbery, from indecent housing, from a mis-education, from a military non-functional for Black oppressed peoples, from pigs who are killing Black people in the community and from unfair trials. The Black Panther Party consists of people who give other people of the oppressed colony a right to live.

I say that if feeding hungry school children, helping welfare mothers, giving free clothes and food to the community, and giving free medical services to oppressed people is being violent, then everybody get on up and let's get violent.

Regardless of what these pigs oink about, we will go on serving the people and we will most certainly go on creating new ways to serve the people.

NCCF OPENS IN WASHINGTON HEIGHTS

Year after year thepoor people of the oppressed Black community have been going from bad to worse to unbelievable. The reasons for this isn't because Black-people don't care but rather because the seventysix families who run this country don't care about the needs of poor people. Seeing the need for change that will bring about freedom and the power to determine their won destiny, a group of brothers and sisters from the on Heights (upper Harlem) area joined ranks with the liberation fighters from the Black Panther Party and opened a new branch of the National Committee To Combat Fascism. For too long the Washington Heights community has been neglected and left to be picked bare by the avaricious (greedy) businessmen (so called legitimate and illegitimate) corfupt pigs and the bootlicking poverty pimps. The people of the community realize that there are many different problems which are degrading, humiliating and genocidal to our people. The people realize that there are many pigs running amuck in their community the only problem is that they are not yet united to fight these pigs.

On some blocks drugs are so heavy that up to 80% of the lumpen are strung out. The corrupt pigs as usual turn their backs on this because they are so busy collecting payoffs and harassing the innocent people of the community. Instead of serving the people in the community by keeping the drugs out of the community, these slimy pigs are running around collecting enormous sums of money from the illegitimate capitalists (dope pushers, number men, pimps) in the community. Seeing the need to organize all elements of the community we talked to the number community some of the money they were taking out, the pigs also spoke to them suggesting that they don't put any money in the community.

There is another type of pig running loose in our community, the poverty pimps, the pigs who make their money not off women, but off the poverty of the people. The job of running these pacification programs aren't given to the lumpen who understand the needs of their people but rather to those who have petty-bourgeois aspirations. The people with these petty-bourgeois aspirations are the ones who think they understand the needs of the people because they read about it in college. Instead of starting programs that will teach people their role in the present day society, these lackeys start programs that will so what their bosses, the ruling class, want them to do and that is to pacify the niggers. In almost every instance you'll see people whose only interest is running for office, running for office in the name of the people when their only interest is in increasing teir own individual wealth and power while the majority of the Black community are still in the need of the basics of life which are land, bread, housing education, clothing, justice and peace. No tonly doesn't the people of the community run it's programs, but know that there is money available which belongs to them, the people never find out about the invisible programs and accounting of funds that never get passed the poverty pimps hands. The so called public meetings to give criticism of the way the programs are functioning are held more than five miles from the community they are supposed to serve this is too far away for the niggers off to block(lumpen) to be going. The poverty jobs and programs are used as political presents for those people who are willing to sell their people out for 30

The N.C.C.F. in Washington Heights plans to show the people how to combat these enemies. We will soon be opening breakfast programs, liberation schools and a medical clinic. We will also be registering people for the Constitutional Convention in Washington, D.C.

Political Education classes for the community will be held on Monday nights at 7:30 P.M. and Saturday at 3:00 P.M.

BLATANT FASCISM … VERY EVIDENT IN THE PATTERSON HOUSES

Within the past few months, the pigs of the New York City Housing Authority and their fascist friends of the 40th precinct in the Bronx, have intensified their war on the brothers and sisters of the Patterson Houses at 145th St. and 3rd Ave. in the Bronx. Since July, 1970, there have been at least 15 arrests on trumped up charges, ranging from "obstructing governmental procedure" to "possession of narcotics".

Teddy Medina and Miquel Marrero, are two bloods from the project that have been educating the bloods in the project. Teddy and Miquel, along with a group of revolutionary brothers calling themselves the Babylonian Liberation Party, have been arming the brothers and sisters with Chairman Mao's Quotations and The Ideology of the Black Panther Party.

Several months ago Teddy went to Miquels house to pick up some books he had left there. Following in hot pursuit, with violence in his eyes, a NYCHA pig by the name of Miller (a bootlicker) saw fit to bust into Miquels house and arrest everyong in the pad. Nigger pig Miller gave no "excuse" for this action, showed no warrant or cited the brothers rights. Pig Miller then took the brothers to the lobby of the building and had them line up against the mail boxes and "frisked" them. By this time pigs from the 40th pig sty arrived on the scene and took the brothers to the pig sty. At the sty, the pigs attempted to harss information out of the brothers concerning the Babylonian Liberation Party, who had just before the incident, began conducting political education classes in back of the Black Community Information Center. After this attempt failed, the brothers were released with a warning to be cool.

Guy Fisher, is a brother that lives in the Patterson Houses that was subjected to an unwarranted attack by Pig Miller. The brother was standing in the project one afternoon with his foot resting on the chain that fences in the grass. Pig Miller approached the brother and told him to get his foot off the chain. Knowing he was breaking no law, he refused. Lackey pig Miller acting like the animal he is, brutally attacked the brother. Guy suffered a busted lip and minor bruises and pig Miller went unpunished.

While attempting the arrest of Alcides Hernandez, a brother from the community, pig Miller was approached by brother Dogo Askari, who was investigating what was going down. Pig Miller began to harass Dogo and then challenged the brother to a fight. Dogo explained that he came over to investigate the reason for the brutality being perpetrated upon brother Aicides. While pig Miller diverted Dogo's attention, Miller's accomplice in crime, Pig Hienz, snuck up behind Dogo and grabbed the brother and arrested him. The brothers were taken to the 40th pig sty. Alcides was charged with "possession of narcotics", which was never found, and Dogo was charged with "obstructing governmental procedure".

On Friday, October 2, 1970, a brother by the name of Burgos was sitting on a park bench across the street from the projects. Pig Miller, being on the scene, as he usually is, with his growing obsession to unjustly attack every young blood in sight, approached Burgos and told him to get up off the bench. Knowing he was not breaking any law, the brother refused. This was Miller's "cue" to attack. After harassing and brutalizing Burgos he arrested him and took him to the 40th pig sty.

Bootlicking Lackey Pig Miller has rightfully achieved the reputation of being a sadistic, warped minded pig. Pigs like Miller are running amuck throughout the Black communities of oppressed people all over fascist America. It is time for the masses of the Patterson Houses in particular and all oppressed people to implement defense groups and deal with the racist dog police and their overseers in the power structure. It is time to throw off the chains of slavery, for the oppressed masses in Babylon have suffered too much for too long. Defend yourself against the fascist pigs in your community, by any means necessary.

REVOLUTIONARY ART

The primary thing about a revolutionary artist is that he is a revolutionary first. The question confronting Black people today is not whether or not he or she is "Black", but whether or not he or she is a revolutionary. We have many brothers and sisters who are exceptionally good artists, but without the proper politics to guide the brush. And as a result leading them to proclaim their work "masterpieces", when in short our Minister of Culture, Emory clearly states, "The people are the masterpieces."

With politics guiding the brush, and the gun protecting them both, the potential Black revolutionary artists could rid themselves of their tendencies of cultural nationalism that often appear in their work. We have many brothers and sisters who are under the impression that first and foremost they are artists. Of writers who state they are writers first. The result being classic examples of art for art's sake. Something that would not meet the basic needs of the people. And writers who write for the sake of words and rhetoric. However, when you take an openminded look at the situation, putting the proper politics into context, you can understand that your art couldn't possibly be greater than the reality of your life and the situation our people are forced into.

Guidance by politics is (as you probably by now realize) constantly being filtered throughout this article. Why? Because people like Emory, Elaine Brown, Eldridge Cleaver (a talented author, editor etc.) are revolutionaries first. They have a clear, precise understanding of the political situation they and their people have been placed in. And recognizing this situation as being a decadent, racist, and capitalistic society, there is no time to be abstract. Because their talents are geared in behalf of preparing for revolution, they aren't involved in dealing in life style but rather projecting the future and offering solutions.

The essays, the songs and the art are not intended to deal with sensitivity, but rather our survival.

There are many forms of art that the people might relate to. The problem though is that generally it gives no direction. The reason being that it might be to abstract to even begin to understand or that the context of the picture couldn't possibly be related to the situation of Black people.

Emory will tell you over and over about the urgent need for a unity of revolutionary aritists. That means "cats" who work for the pig advertising agencies, even brothers who layout, print, deal with production in art and anyone affiliated in getting out information. Let's put counter-revolutionary art down so we will be able to serve the people. Because when the question of "who the art is for?" It's a definite fact that white-washed bootlicking magazines and newspapers in general aren't for us.

Huey P. Newton once said, from observation and participation that "The Black community basically is not a reading community." So comrades, let's become political, be revolutionary and interpret Huey's essays, Eldridge's writings, and Emory's teachings of revolutionary art, and put them into pictorial form. This is one way we can be sure that Mrs. Mae has a lovely day.

LOS ANGELES: BUFFOON PIGS IN THE NAME OF EDUCATION

It becomes necessary in this present day society for Black people to recognize the oppressive forces of the omnipotent administrators. We must be aware of all avenues of the oppressive forces, such as in the educational system.

This is a message to the administrators and scurvy lifted pigs that control the campus of Manual Arts High. It should be understood by lackey principal Peters that the students of Manual Arts and the people of the community will not stand much more of the madness these pigs are perpetrating on this campus and in our community. In the last few weeks the students of Manual Arts have been going wild because of harassment by fool teachers and the crazed bootlicking pigs, who walk around the campus with .38 revolvers, harassing and intimidating the students.

The school is reminiscent of a prison - high fence, gates, pig guards, and jive administrators who condone this madness. The tool used to keep students divided and fighting among themselves is red devils which are poured onto this campus. It is clear that this Black principal is only a puppet for this system because he has not taken a sincere interest in trying to eliminate this problem.

Teachers are threatening to leave because they can't control the students. Therefore, puppet Peters tells his pigs to bring more repression upon the students. The students are feeling the evils of oppression in the Black community by being forced to go to this institution in search of an education. But instead of becoming educated, they are being inflicted with more direct oppression from the school system.

This week the same students who have been dropping red devils to escape all this oppression, destroyed three classrooms and some equipment at the school. They will continue to strike out at their oppression until some relevant changes which are geared towards meeting the needs of the students are made.

To puppet Peters, the pig guards, and the pill pushers at Manual High we say that as long as they continue this madness they will be exposed to the students and the people of the community for what they really are…enemies.

INTERNATIONAL NEWS: THE SKY'S THE LIMIT

REPRINTED FROM LEVIATHAN FALL 1970

This article is an edited version of an interview made with Leila Khaled, after the 1969 hijacking, in Beirut, Lebanon.

On August 29, 1969, a TWA Boeing 707 jet airliner on its way from Rome to Athens was hijacked by two Arab commandos from the Popular Front for the Liberation of Palestine. Leila Khaled, who commanded the mission (dressed in a trouser suit), and a companion, Salim Assari. They ordered the pilot first to fly to Tel Aviv, then commanded him to take them to Damascus, Syria. All the plane's passengers except for two Israeli men were allowed to leave the following day. The two Israelis were held in Damascus for three months and then returned to Israel in exchange for some Syrian pilots who had landed at an Israeli airfield by mistake earlier in the same year. The Syrians did not bring to trial the two hijackers but held them under house arrest for forty-four days.

I did this because it is the strategy of the popular front. We have to hit the imperialistic interests and this is one way to hit them. By hijacking an airplane we can tell the American government that the Palestinian resistance is aware of whatever the American government is doing to support Israel. We know that the American government is supporting Israel in everything and this is what makes Israel so powerful, what makes Israel work against us. At the same time we are hitting tourism in Israel we want that to be stopped. I think that I can say that the people who were on that aircraft will think about what's going on in the Middle East, and about the Palestinian cause, and these people will go out and tell others.

I didn't undertake the mission before I was trained in navigation, so it was hard for the pilot to trick me. At the same time, I was told that I may die in that mission because we were headed for occupied land and we thought that maybe the Israelis would shoot us down or maybe the pilot would have gone down so that we would have to explode the airplane. So I thought it was my mission to do it and that's all I had no objection to face death or to face arrest or anything because I knew that this was the strategy planned that we are carrying on.

Before my mission my comrades told me. You have an outside mission to do. I said, Okay, what is it? They told me I had to go to Rome and learn how to command a TWA aircraft. I was astonished, really, because I thought, how could I do that thing? But they told me I would be trained. I hadn't a very long time to get ready. Of course I can't say how I was trained, but I can say it was really very easy to carry on that mission because I believed that this mission can do something for my cause. This was my first outside mission.

We got on the plane as passengers. We wanted some time to see the cockpit door open and we took hand grenades to the cockpit door. My friend told them, Don't move, listen to the new captain. And in reality the new captain was me I hadn't eaten that day. I had my pistol in my pants, and it slipped down in my trousers. It was so funny when I was taking it out from my legs, out of my trousers. And I then told the captain that I had taken the safety pin out of the grenade and he could take it as a souvenir. But he wouldn't take it. I put it in front of him and told him that he had to obey my orders. He was astonished really to see me, a young lady in front of him with her hat and her elegant suit, but I told him to never mind now, because I read that in his eyes, he was so astonished. And really, I didn't want to do anything to hurt him because he wasn't my enemy. The only one I meant to hurt by that job was the US government. So I told him, If you listen and if you obey my orders, everything will be okay. He was so good really. I told him to proceed to the airport near Tel Aviv; we wanted to challenge (the Israelis). We come over the land and they can't do anything.

By the way, I asked the engineer how many fuel-hours did he have to keep flying and he said two hours and he was lying, because I know exactly how many hours he had. And I said, What're you doing? You are lying. And really I was angry. And I told him. Don't lie because I know you have three-and-a-half hours. And then the co-pilot said. Let's count it. I told him, Don't count it, I know everything about it.

So then we reached the occupied land (Palestine). I asked the pilot to descend and he descended. Oh, it was something fantastic. Then we reached Tel Aviv and there I asked him to circle around and ask the Israelis to permit us to descend to the level I wanted at Tel Aviv. (The controller) shouted and I didn't answer. I asked him to say the name of the airplane. He didn't answer; he just cried "TWA" and I said, "This is the Popular Front. Free Arab Palestine." And that was the new name of the plane. He was shouting and telling me they would "send you our planes." I said, Oh, send anything you want! What can you do? You can't do anything! And then I opened the phone for the passengers and I told them, Listen to what they are saying. And I told the station down at the airport. You are responsible for the lives of all those people. We, we fighters, we want to die over our land but these people, we don't want these people to die because it's our problem, not their problem. We left after giving our message in Arabic for our people there and for the Arab prisoners in the Israeli prisons, that we would be back again. Because I want to go there again. Not by air, not by sea, but by land. We reached Damascus and I asked the passengers to evacuate the aircraft. We didn't want any horrible thing to happen at that moment maybe from the people because they were so frightened. I went over the aircraft to see if anybody was there and I and my friend went into the cockpit area and threw a grenade. I wasn't nervous. I thought I had to do it and why should I be nervous? I felt that to be nervous meant that something horrible will occur and I wanted the crew to be calm so I had to be calm myself.

We waited near the gate because they were evacuating the airport. The passengers were just looking open-eyed and I was releasing them and giving them a brief explanation. Of course I didn't have much time and I just asked of those who were going to Israel. Why don't you go to Viet Nam as tourists there? And then I answered. Because you know that there is a war there. And I want to tell you something: there is a war here too. There is a revolution here. We are the ones who are making it. And there is little difference between the revolution in Viet Nam and here in the Middle East. Maybe in the Viet Nam war you may reach Viet Nam, but here you cannot reach it because we are going to cut off the routes. And, at the same time, because the US government is helping Israel, supporting Israel, and I asked them do you think peace comes by Phantoms and rockets? We don't think so. Peace can't be established by force. Really, this is our land and we want to go back and everyone who helps our enemy is our enemy too. I am eager to see those passengers and that crew again and not by hijacking, no. but to tell them and to have them as our friends because they will be our friends in the future if they understand our point of view.

There is nothing to be told about myself before I joined this Front. I think that I had lost every meaning of life when I was driven out of Palestine. We were driven from Haifa with my family after 1948. I can't remember much about that year. I was so young. But my mother has told me about it. We were obliged to go out under pressure of Israeli weapons. We just had to carry our bags and clothes and to run away. We thought it would just be days before we could go back we were tricked by that. I didn't go to a refugee camp. I just lived with my parents here in Tyre. I attended the American University in Beirut for one year. I left AUB because it was too expensive for me to afford and afterwards, in 1963. I went to Kuwait to teach there and stayed for six years to help my family. After the fifth of June I think I was born again. I joined the Popular

Front and I gave up everything I gave up my family because I want to hold arms. So I went off.

In our camp we don't have only weapons but political education too. While I was teaching I was involved in the Original Arab party, that is the literal translation of it. And the Popular Front for the Liberation of Palestine is now the military part of this party. I can say that because the Popular Front for the Liberation of Palestine believes that not only weapons are the way to liberate our country. We believe that socialist thought, scientific socialist theory, is the way to the liberation of Palestine and that popular liberation war is the only way to win Palestine.

The Popular Front is Marxist in the theory, revolutionary in its theory. We don't think that importing a theory is the way to go about liberating a country. We learn from Russia, China and Cuba and we can benefit in our war. We think that our work here, our revolution, is part of the world revolution as well as a revolution by itself. We are going to build bridges with other movements in the world.

After the Fifth of June, we had our military groups in the occupied land and after the meeting of the whole leadership of our popular front we made studies about the enemy and had to state which was the camp of our enemy and the camp of our friends. And from this point of view I can say that we have been able to see the whole thing about our revolution. We think that not only Israel is our enemy. We think Israel, Zionism, the imperialistic part played by the US and the reactionary Arab regimes are part of the enemy camp. And when we say "all the enemy camps" then we have to hit these enemies. So we have this strategy to hit hard at the imperialists' interests, either outside our country, in the Arab world, wherever our enemy is we want to fight there.

We don't mean to hit the Jews as Jews. We are not against the people. We are against only the Zionists because they support Israel with people, with weapons, with everything.

In Zionist propaganda it is said that Arab women have nothing to do except to cook, to marry, to have children and that's all. That is her job. But it is different. We Arab women can do whatever Arab men do. And we have many examples, especially in the occupied lands. Many women who are imprisoned now and one of the women who is now in the most horrible prison in Israel is half paralyzed as a result of torturing. We had a girl whose name I have taken as my name in the mission. She is one of our martyrs killed by the Israelis.

I can say that we have many women inside and I am preparing to go inside but I don't know if I'm going to go on doing my operations secretly. Now I am known and can't. Of course I may risk death or prison, it's the same for me. I'm not afraid to say this is my end anyhow. Either death or to be in jail. This is revolution. Anyone who is doing such a job expects all these things. Death or prison, there is no difference. Except that death is better than to be in an Israeli camp or jail.

Those young people in America, If they can see the facts from all sides, I think we can have them as our friends and they can see our cause. Because they are now seeing our problem from the Zionist point of view and they are not seeing anything from our point of view. To be a scientific person you have to see the problem from all points of view so that it's not a matter of what I want to do or what anyone wants to do. The Zionist propaganda says that in Israel there is a democratic socialist government. But I want just to ask a question. Where is this democracy? And where is that socialism if you want to drive the people out of a land?

The Black Panther Party in America has come out in support of the Popular Front and the Fateh resistance movement. If you were now talking to the black revolutionaries in America, the Black Panther Party, what would you say to them?

I'm with those people because they are defending their rights as human beings and the worst thing you or anyone can face is when you are not treated like a human being. And I'm with them in their revolution against what is called a democratic government in the US. It's not at all a democratic government. So those people, I hope they can have their rights, and they can't have their rights except by force. That is the motto of this century because force is the only way they can be had.

A WAR OF INTERNATIONAL DIMENSIONS

Recently a world conference was held in Rome, Italy in support of the Portuguese colonies and the three fraternal liberation movements of FRELIMO, PAIGC and MPLA fighting Portuguese colonialism aided and abetted by U.S. imperialism. The conference brought into sharp focus imperialist complicity in Portugal's repressive wars and stressed the responsibility of all progressive forces throughout the world to mobilize massive solidarity actions. Delegates from nearly all liberation movements and progressive governments of the world were present. The Black Panther Party was represented by Connie Matthews. International Co-ordination.

The following is a report of the political commission:

REPRINTED FROM SECHABA SEPTEMBER 1970

Since the Khartoum Conference, the rich and multi-furious aid and support given to the liberation movements by the Socialist countries has continued and even further developed. This aid is considered by all to be of decisive help in the fight against imperialism and for the liberation of the oppressed peoples.

On the other hand, in the capitalist countries, in the first place in Western Europe, a growing number of movements, political parties and trade union, youth and women's organizations have placed the problem of active support of the struggle of the populations of the Portuguese colonies on their agendas. New solidarity committees of a very broad nature have been set up.

All this is doubtlessly a result of the successes gained in different fields by the PAIGC, the MPLA and FRELIMO in the armed struggle and also in the organization of the liberated areas where the foundations of a new society have been laid. All this is most encouraging and confirms our absolute faith in the final victory. But whereas we do see that efforts have been made in the domain of solidarity, it must also be stressed that this solidarity is still far from corresponding to the needs of the struggle.

That is why this Conference, by drawing up a balance sheet of what has been done so far represents a very important phase, provided that it is followed by practical activities in each country.

Many speakers stressed that the colonial wars of Portugal are part of an imperialist chain of actions against the forces of progress and freedom all over the world. By supporting Portugal international imperialism aims at motivating its system of oppression and exploitation and even to strengthen it. To do this, in view of the success of the liberation movements, it has internationalised these wars: This does not mean that the general imperialist strategy is not beset by many contradictions which reflect the various capitalist interests, and from which we must profit in each country. But they nevertheless arrive at a common understanding against the freedom of the peoples, whether it be the peoples of the colonies or of their own countries. That is why there exists, quite objectively, a common interest between the people of the capitalist countries and the peoples fighting against colonialism.

In view of the internationalisation of the war in the Portuguese colonies, it is necessary to create a united front of the Socialist countries, the liberation movements and the democratic and progressive forces of the capitalist countries, for it is a fact that on the success of this struggle depends not only the future of the Portuguese colonies but also the future of other oppressed peoples, since the anti-colonialist struggle is only one aspect of the general struggle against oppression and exploitation. For this very reason it concerns all mankind, bring down the walls of silence.

Concerning the sector of the struggle in the capitalist countries, the Conference calls upon us to develop our actions within the imperialist areas. To do this, it is above all necessary to mobilize the masses, which means, initially, to inform them.

The commission demands that everything possible be done in the various countries, in order to bring down the wall of silence upheld by the mass media of the monopolies. The initiatives taken by the various parties and movements, the information they provide their members and those whom they influence, will facilitate a growing public awareness.

By enlightening the public about the reality of these dirty wars and the monopolistic interests hidden behind them, it will be possible to increase the number of sympathisers among the masses and to facilitate their mobilization for action for political and material solidarity.

MILITARY ISOLATION OF PORTUGAL

The Commission is unanimous in hoping that united action can be developed to achieve:

- a final end to the direct supply of military material to Portugal by certain countries, in particular France and West Germany:

-a final end to the training outside Portugal of military cadres for the colonial war:

-a final end to the collaboration between the ground, air and naval forces of America and the different Western European countries and their Portuguese counterparts.

Concerning NATO, various suggestions were proposed, but the speakers were unanimous in demanding that the governments within this organization should stop delivering arms to Portugal. This conforms with UN resolutions on decolonization.

The regular use of NATO-supplied weapons in the Portuguese colonies is a complete exposure of the stated defensive character of this organization, by implicating it in offensive wars which make all the member countries of NATO accomplices in the aggression committed against the people of the Portuguese colonies.

Finally it is urgent and essential that in each country action should be undertaken to ensure that soldiers of the national liberation movements who are imprisoned by the Portuguese army are treated entirely in accordance with the Geneva Convention and that torture and arbitrary execution are stopped.

POLITICAL ISOLATION

Condemnation, at international assemblies of Portugal's colonial policies and of the aid given by different imperialist countries, led by the United States, is considered imperative. We must aim at the political isolation of Portugal and her moral condemnation. Public pressure on these powers from parties and organizations must force them to forbid participation by financial companies from their countries in investments in the Portuguese colonies. It is essential that the trade

unions in particular expand their activities further, and unite and mobilize the workers in order to emphasize both moral and material solidarity. The political commission approves the plan of USPA and WFTU to organize an International conference in support of the workers and people of Africa in particular those from the Portuguese colonies and Southern Africa.

Any joint action should likewise press for the exclusion of the Portuguese government from all meetings of international organizations, UN and specialized agencies so long as her policies of colonial domination and discrimination continue. The commission congratulates UNESCO, among others, which has taken the decision not to invite any longer Portugal to its international meetings.

ECONOMIC ISOLATION

Economic sanctions must be taken by the different governments against the Portuguese government. These should include:

- consideration of the advantages gained by Portugal from her membership of the European Free Trade Association;

- refusal to allow Portugal to enter the Common Market and that this should not be discussed before the colonies are independent;

- ending the granting by the American and European governments of long term credits to the Portuguese government;

- stopping industrial or agricultural investments in the Portuguese colonies.

The Commission congratulates the victory won by the progressive and trade union forces of Sweden, Italy and England and by the direct intervention of the East African countries which have led to the withdrawal by financial groups from these three European countries from participation in the Cabora Bassa project. This success is encouraging and should serve as an example to bring about the withdrawal of West German and French trusts and which would be a tremendous victory.

It is stressed in numerous interventions that the struggle for independence in the Portuguese colonies is inalienably linked with the struggles of the African peoples in South Africa and Rhodesia. The inter-connection of interests and actions of the governments of those countries and the government of Portugal in the military, political and economic fields is obvious. Furthermore this struggle cannot be dissociated from the other anti-imperialist and anti-colonialist struggles going on in other parts of the world.

PART XIII

APPELLANT'S (BOBBY) CONVICTION SHOULD BE RESERVED AND THE CITATION FOR CONTEMPT DISMISSED IN THE INTERESTS OF JUSTICE

Because of the serious and provocative misconduct of the trial court and the prosecuting attorneys in the instant case, this Court should exercise its supervisory power to reserve appellant's convictions and dismiss his contempt charges.

Unlike ordinary criminal charges, the decision to institute contempt charges lies with the federal courts rather than with the United States Attorney (214). Those courts have recognized that contempts should not be prosecuted when it would be contrary to the interests of justice. Thus in Ex Parte McLeod, 120 F. 130 (N.D. Ala. 1903), where the alleged contemnor had assaulted a United States Commissioner, the district court concluded that although the assault constituted criminal contempt, no contempt order should issue:

It is not the duty of the court to notice every contempt. Many contempts may well be left to be rebuked by the good sense of the people, and the respect they entertain for the institutions of their country, without in any way impairing the authority of the Court. Courts will punish for contempts only when the ends of justice will be best secured thereby. (130 F. at 143) (215)

Similarly, in the well-known case of United States v. Barnett, 346 F.2d 99 (5th Cir. 1965), (216) the Fifth Circuit decided to dismiss contempt proceedings against the Governor and Lieutenant Governor of Mississippi for actions taken two years previously designed to prevent integration of the University of Mississippi. The court noted that defendants had ceased to obstruct the court's orders, and the Civil Rights Act of 1964 had settled the "Law of the land." (217)

The decision by a United States district court to institute criminal contempt proceedings must be subject to full review by the appropriate court of appeals. Compare in re Brown, 346 F.2d 903 (5th Cir. 1965). Decisions to prosecute criminal charges of any kind have traditionally been subject to careful review by the highest officials of the branch of the federal government responsible for bringing such charges.

Thus the prosecution of ordinary criminal offenses by United States Attorneys is subject to review and control by the Attorney General, 28 U.S.C. **519, 547. Similarly, a recalcitrant (refusing to obey authority) congressional witness cannot be tried for contempt until the full House or Senate has reviewed the alleged misconduct, as reported by the offended committee, and has voted to authorize a contempt proceeding; its decision is in turn reviewed by a grand jury which must consider the evidence of contempt before an indictment can be returned (218). The court of appeals is the only institution that can review a district court's decision to constitute criminal contempt proceedings and it would be an extreme anomaly (abnormalty) if it did not exercise such power. The review procedures regarded as essential for fairness within the executive and legislative branches of the government ought apply, a fortiorari, to the judicial branch. Such review is especially necessary where contempt of court is involved since the trial judge already possesses such broad power over potential contemnors. Compare Green v. United States, 356 U.S. 165, 188 (1958). Review of the institution of contempt proceedings is appropriately made under this Court's supervisory power, which looks beyond the "ascertainment of constitutional validity" to ensure the implementation of sould public policy and "civilized standards of procedure," McNabb v. United States. 318 U.S. 332, 340-341 (1943); La Buy v. Howes Leather Company, 352 U.S. 249, 259, 260 (1957); Thomas v. United States, 368 F.2d 941, 964 (5th Cir. 1966). (218) 2 U.S.C. **192, 194; kinoy v. District of Columbia, 400 F.2d 761 (D.C. Cir. 1968): Wilson v. United States, 369 F.2d 198 (D.C. Cir. 1966). In Wilson the court interpreted **192 and 194 to require "additional scrutiny within the legislative branch" of a committee's charge of contempt. "a scrutiny that would at least embrace examining the sufficiency of the statement of facts of alleged contempts, and consideration whether the incident constitutes the kind of willful contumacy (disobedience) contemplated by the statute…This construction of the statute does not contemplate an empty ceremony…Congress may well have felt, in enacting 2 U.S.C. *194, that some sort of `check' on action by a committee in instituting contempt prosecutions is appropriate." 369 F.2d at 204.

Such witnesses could also be jailed until they answered the questions at issue or until Congress adjourned Although this power, which has been little used for several decades, was analogous to civil contempt, a vote of the full House or Senate was required for its exercise. See Watkins v. United States, 354 U.S. 178, 206-7 (1967); Kilbourn v. Thompson, 103 U.S. 168 (1881).

Therefore, regardless of whether appellant was actually guilty of contempt, the extensive and egregious pattern of misconduct engaged in by the prosecuting attorneys, the trial judge, and the United States Marshals under the judge's supervision requires that the charges be dismissed.

United States Attorneys are subject to the standards of conduct set out in the American Bar Association Code of Professional Responsibility and the Canons of Professional Ethics, but their responsibilities are even greater than those of ordinary lawyers (219). The conduct of the United States Attorney and his two assistants in the instant case falls far short of the requisite degree of probity and fairness.

The record reveals consistent pattern of verbal abuse by the prosecution directed toward both defendants and their attorneys, referring to them in a derogatory manner, impugning (to challenge as false) their motives, and employing on innumerable occasions unwarranted abusive language (220). Much of this extremely prejudicial conduct occurred in the presence of the jury. The prosecution joined with the court in seeking to force a waiver by appellant and the other defendants of their objection that the trial was held before Garry was able to attend; indeed, the prosecution admitted that it would object that attorneys Tiger, Roberts. Kennedy ad Lefcourt had withdrawn by telegram only if the defense refused to waive any objection to Garry's absence (221). The prosecution also contributed to the atmosphere of intimidation by constantly suggesting to the court that the contempt power be used against the defendants and their counsel (222).

The standard of behavior required of federal district judges is even higher than that of prosecutors. "The trial judge has a duty to conduct the trial carefully, patiently, and impartially. He must be above even the appearance of being partial to the prosecutor." (223) The judge "must remain the judge, impartial, judicious, and, above all, responsible for a courtroom atmosphere in which guilt or innocence may be soberly and fairly tested."

The trial court on a number of instances abused counsel even more seriously. It ruled that attorneys from as far away as Los Angeles and New York had to come to Chicago merely to withdraw from the case and ordered the arrest of four attorneys who had not so appeared on the same day as that ruling, denied them bond, and permitted them to be treated as common criminals. The court signed contempt citations against at least some of these attorneys without holding any hearing or discussion whatever, and was only dissuaded at the last moment -- possibly by the openly expressed outrage of many leaders of the bar-from imprisoning all four. (228) The intimidating effect of these rulings was obvious; their irrationality constitutes strong evidence of bias (229). On repeated occasions the court sought to coerce appellant into expressly waiving his claim that Garry should have been present at the trial. (230)

(230) On September 26, after attorneys Tigar and Lefcourt had been brought to Chicago pursuant to the court's arrest warrants, a discussion ensued as to the wording of a stipulation permitting them to withdraw. The court rejected the first such stipulation offered, remarking.

The defense here has been equivocating about whether or not all of these defendants have lawyers of their own choice. I think they have. But I am not going to let two lawyers go here until they assert that they have without equivocation…. (TR 147)

When Kunstler objected the defendants were being asked to sacrifice their Sixth Amendment rights to obtain the release of the two lawyers, the court merely ordered them into the custody of the marshal. (Tr 154)

On October 28, when Kunstler asked permission for one of the defense attorneys to be excused from the trial for one day to visit Garry in California, the following occurred.

THE COURT;…Only under these conditions: That each and every defendant consent to the absence of either yourself of Mr. Weinglass and consent to the one who remains here to represent his interests during that day, and on this further condition, that you live up to your oral and written representation to me that you represent Mr. Seale.

Mr. KUNSTLER:…Is the condition of my going that Mr. Seale acknowledge that I am his lawyer? Is that what it amounts to?

THE COURT: I have stated it pretty clearly.

Mr. KUNSTLER: The defendants want to know this.

THE COURT: You have acknowledged it in writing and on the record already, but I want you to do it again. If you don't want to do it again, I will deny your motion as made. (TR 4392-96)

The court also threatened to revoke bail for the other defendants because they supported appellant's claims TR 4723 (See also the court's subsequent action listing as a condition of defendant Hayden's proposed trip to California that he make no speeches on the "wickedness" of the President, TR 4961-65.)

What We Want
What We Believe

1 We want freedom. We want power to determine the destiny of our Black Community.

We believe that black people will not be free until we are able to determine our destiny.

2. We want full employment for our people.

We believe that the federal government is responsible and obligated to give every man employment or a guaranteed income. We believe that if the white American businessmen will not give full employment, then the means of production should be taken from the businessmen and placed in the community so that the people of the community can organize and employ all of its people and give a high standard of living.

3 We want an end to the robbery by the CAPITALIST of our Black Community.

We believe that this racist government has robbed us and now we are demanding the overdue debt of forty acres and two mules. Forty acres and two mules was promised 100 years ago as restitution for slave labor and mass murder of black people. We will accept the payment in currency which will be distributed to our many communities. The Germans are now aiding the Jews in Israel for the genocide of the Jewish people. The Germans murdered six million Jews. The American racist has taken part in the slaughter of over fifty million black people therefore, we feel that this is a modest demand that we make.

4. We want decent housing, fit for shelter of human beings.

We believe that if the white landlords will not give decent housing to our black community then the housing and the land should be made into cooperatives so that our community, with government aid, can build and make decent housing for its people.

5. We want education for our people that exposes the true nature of this decadent American society. We want education that teaches us our true history and our role in the present day society.

We believe in an educational system that will give to our people a knowledge of self. If a man does not have knowledge of himself and his position in society and the world, then he has little chance to relate to anything else.

6 We want all black men to be exempt from military service.

We believe that Black people, should not be forced to fight in the military service to defend a racist government that does not protect us. We will not fight and kill other people of color in the world who, like black people, are being victimized by the white racist government of America. We will protect ourselves from the force and violence of the racist police and the racist military, by whatever means necessary.

7. We want an immediate end to POLICE BRUTALITY and MURDER of black people.

We believe we can end police brutality in our black community by organizing black self-defense groups that are dedicated to defending our black community from racist police oppression and brutality. The Second Amendment to the Constitution of the United States gives a right to bear arms. We therefore believe that all black people should arm themselves for self-defense.

8. We want freedom for all black men held in federal, state, county and city prisons and jails.

We believe that all black people should be released from the many jails and prisons because they have not received a fair and impartial trial.

9. We want all black people when brought to trial to be tried in court by a jury of their peer group or people from their black communities, as defined by the Constitution of the United States.

We believe that the courts should follow the United States Constitution so that black people will receive fair trials. The 14th Amendment of the U.S. Constitution gives a man a right to be tried by his peer group. A peer is a person from a similar economic, social, religious, geographical, environmental, historical and racial background. To do this the court will be forced to select a jury from the black community from which the black defendant came. We have been, and are being tried by all-white juries that have no understanding of the "average reasoning man" of the black community.

10. We want land, bread, housing, education, clothing, justice and peace. And as our major political objective, a United Nations supervised plebiscite to be held throughout the black colony in which only black colonial subjects will be allowed to participate, for the purpose of determining the will of black people as to their national destiny.

When, in the course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume, among the powers of the earth, the separate and equal station to which the laws of nature and nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

We hold these truths to be self-evident, that all men are created equal; that they are endowed by their Creator with certain unalienable rights; that among these are life liberty, and the pursuit of happiness. That, to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed; that, whenever any form of government become destructive of these ends, it is the right of the people to alter or to abolish it, and to institute a new government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their safety and happiness. Prudence, indeed, will dictate that governments long established should not be changed for light and transient causes, and accordingly, all experience hath shown, and mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed But, when a long train of abuses and usurpations, pursuing invariably the same object, evinces a design to reduce them under absolute despotism, it is their right. it is their duty, to throw off such government, and to provide new guards for their future security.
