PIGS ASSASSINATE BROTHER AND SISTER IN ROBBINS, ILLINOIS

Earlier this week, two Black residents of the Robbins community were shot and killed by members of the Robbins pig department. The two people killed in related incidents were 16 year old Barbara Franks and 28 year old Ronald Lee. According to witnesses, both of these shootings were a clear case of open murder.

In the first incident, witnesses say there had been some random gunfire in the projects and that sometime thereafter the pigs arrived on the scene. At this time Ronald Lee who had just gotten off work as an ambulance driver at the time of the shooting, was leaving a friend's house on his way home. The pigs claimed that they called for him to halt, and that he refused so they opened fire on him. Witnesses say that it was impossible to tell that the men who did the shooting were pigs because they were wearing plainclothes. Also it was reported that Ronald Lee had fallen to the ground and began pleading for his life prior to being shot.

A little more than a week before his death, Ronald Lee had agreed to testify against Robbins pig chief Porter McClammy. Last summer a young black woman of the Robbins community was brutally beaten by the chief pig. She had been beaten so badly that she required hospitalization and the ambulance driver was Ronald Lee. The woman told Ronald Lee what had happened to her and it was obvious from her condition that she wasn't lying. Charges were later brought against the Chief of Pigs and several other members of the Robbins pig dept. Just prior to his death Ronald Lee spoke to officials in the State's Attorney's office and said that he had talked to McKammey and was afraid for his life. Ronald Lee, a potential witness against the pigs, is dead and we can say from the facts presented, that he was assassinated.

Barbara Franks was shot the same night, November 2. The pigs in their effort to justify shooting Ronald Lee, thought that by shooting some more people it would look as though they were just shooting people randomly to defend themselves, and that Ronald Lee was shot in that manner. Barbara Franks was riding with her boyfriend when a plainclothes pig stepped from between some parked cars and fired on the vehicle she was in. A bullet struck her in the base of the skull.

Further investigation reveals that the pigs involved in both of the shootings have a history of this type of criminal activity against the people. One pig, Fred Pennix, had previously shot and killed a brother who he allegedly was attempting to service a warrant on. People say that Pennix had no intentions of serving a warrant, that his original intentions were to shoot and kill brother James Tucker. Tucker's wife stated that he was shot in his pajamas as he answered the door…

Two years ago another pig who was involved in the murders, Sgt. Melvin Jessup, was investigated for reported mistreatment of inmates at a jail where he was a guard.

Both Pennix and Jessup along with a 3rd pig, Eugene Grant, and Chief pig Porter McKammey have been suspended until an `investigation' of the murders can take place. On the same day that the suspensions were announced, 3 other pigs resigned and the Robins pig dept. was literally cut in half. One of the resigning pigs stated that a patrolman in the suburbs is paid $325 a month and has to work overtime without pay, additional days off or vacations. In Robbins the age old pig tactic of temporarily suspending an officer after he has killed a black person to appease the community isn't going to work. Even the pigs are refusing to go along with the sham and fill in for their partners.

Two innocent people have been gunned down by mad fascists, and the people of Robbins are demanding reciprocal justice. The weapons used by the murdering pigs were a 9 mm machine gun, 30 caliber carbine, extra load riot pump, and several service pistols. The people of Robbins are moving to take the necessary actions to defend themselves against future use of these weapons. However, even more important that defending themselves when attacked, the people of Robbins must move to enforce community control of the police with an armed offensive. Now while the pig department is at half staff is a prime opportunity for the community to deal a death blow to the entire fascist regime of Robbins.

FOOL-PIMPING THE PEOPLE

In the October 30th, issue of the Oregon State University (at Corvallis) newspaper there was an article talking about a Black Panther Party Captain who was speaking on the campus. A man by the name of Manuel Ray, Manuel Gray or Manuel Ray Diaz (all one in the same) was addressing insignificant classes with a white population and fraternaties and sororities All of these speeches centered around the Free Breakfast Program and Liberation School for the children of the migrant workers on Corvallis. More importantly all of these speeches stressed the need for donations to sustain these programs. Because Manuel compromised the Party's political positions and undermined our ideology in his speeches, his fund raising was successful. Manuel Ray Diaz is not a member of the Black Panther Party nor has he ever functioned in any capacity in any of the Party chapters. Any money that Manuel Ray Diaz has collected in the name of the Party has not come to the Party nor any of our socialistic programs.

The Black Panther Party scorns anyone who dares to pimp the Party, the people. To pimp the people is to capitalize on the deaths of millions of Black people during the past 400 years in Babylon, to perpetuate the institutional slavery and exploitation of the millions of Blacks in Babylon right now the Black Panther Party is waging a tireless struggle for the liberation and salvation of our people. Revolutionary justice will be meted out to anyone who is caught pimping the Black Panther Party, the people.

THERE AIN'T ENOUGH BOOTLICKING OPPORTUNISTS TO DRIVE US OUT

I have lived here in New Haven for over six years. Since I began to work for the people of the community, I have been arrested many times, brutalized harassed, set up to be murdered by pig chief James Ahern and his fascist pigs, I am well equipped with a working knowledge of how the pigs and "Negro" bootlickers and others are one and one with the power structure working to continue the oppression of Black people here in New Haven and Connecticut.

During the last five years the capitalists of the pig power structure have spent millions of dollars on double talking pigs like chief James Ahern and his Gestapo who brutalize and terrorize the poor and Black communities; on states attorney Arnold Markle and the racist courts who railroad large numbers of Black and poor people into the jails and prisons; and on political flunkeys like gangster Mayor, Bart Guida.

They have spent millions of dollars to control the Black community. Through the manipulations of the Black community organizations" headed by bootlickers, Uncle Toms and numerous other traitors of Black people's struggle for liberation, including pimps, fools and low-lifted scurvy profiteers of dope operations who hide behind anti-poverty funded programs.

These are some of the more deceptive exploiters and profiteers of the Black and poor communities sufferings and hardships. Out of all the millions of dollars they have received in anti-poverty "grants" and other pay-off funds from the capitalists ruling class sources, they have not opened up one free breakfast for children program one Free Health Clinic, one Free Clothing program nor any other concrete program to serve the basic needs and desires of poor and oppressed people.

Since the birth of the New Haven Chapter of the Black Panther Party in the spring of 1969, the capitalist pigs have increased their financial aid to the reactionary forces of New Haven. The fascist and racist police dept., and courts, the demagogic corrupt politicians, bootlickers, Uncle Toms, "Yard niggers", fools and profiteers have been operating like a unified pig army against the Black community the Black Panther Party and the Party programs for the people. Because the Black Panther Party is a revolutionary party with revolutionary politics and concrete programs to serve the people and because the Black Panther Party will educate the people by exposing those who oppose progress for the people, the unified and occupying pig army has been working overtime trying to turn the minds of the people away form the liberation struggle and against the Black Panther Party. By an overt, subversive propaganda campaign of bootlicking rumors and fascist lies, the pig army is continuing to occupy brutalize murder, exploit, victimize and jail the people and those of us who serve the people. That's why I was a political prisoner.

Now I am saying to my people of the Black community, tose of us who plead guilty, did not plead guilty to anything we did but we plead guilty to a substituted phony charge after the more serious and capital phony charges were dropped because we knew as Black revolutionaries we could not receive a fair trial. This was just another method, after surviving a year and a half in the fascist pig pens, which the Party chose to free the three of us, Rose, Peggy and myself from fascist racist railroad. I want you to know that I am back to work with all my fellow revolutionaries.

Being aware of some of the lies the pigs have told the people about the trial and myself and the other brothers and sisters who are still in jail (Bobby, Erika, Landon, and Rory), I'm totally inspired to relentlessly work and move with the Party to mobilize the masses of people to come out against Markla and the others who are practicing genocide on Black and all oppressed people in New Haven.

We are saying to the unified pig army. "There ain't enough pigs, lackeys, bootlicking opportunists, yard niggers and fools in New Haven to drive us out!" As long as there are hungry childre, indecent housing, fascist pig brutality and other oppressive forms of suffering in the Black community, the Black Panther Party will be here to serve the people's needs and desires, to wage the people's liberation struggle, to free Brother Bobby Seale, Sister Erika Huggins, and all Political Prisoners. The Black Panther Party will be here to show the peopo how to wage relentless people's struggle that will smash this fascist racist system and end oppression so a society of love and peace for all can be built.

FREE PRISON BUSSING PROGRAM IN BOSTON

The Boston Chapter of the Black Panther Party is implementing a bussing program so that family, friends and loved ones can visit brothers and sisters being held captive in the fascist penitentaries and jails in Massachusetts. The response from the community has been right-on. The brothers and sisters can identify with this program and are moving to take an active part in it as they have in the Free Breakfast for School Children Programs, Free Health Centers, and Free Clothing Programs.

Several other organizations have offered vans and drivers. The brothers and sisters have been very responsive and have offered their support to the program as drivers and in bringing people from the community up to visit the lumpens in jail. Political Education classes are given to the people on the way to the prison so they can learn the truth about this oppressive system, enabling them to take the correct steps to change the capitalist system in this country.

At the present time we are just visiting the brothers in Norfolk State Prison, but we have plans to expand this program to Walpole and Concord State Prisons and also the Women's Reformatory in Framingham, Massachusetts. Most of the brothers and sisters in the prisons and jails are young, between the ages of 17 and 29 and have a keen insight on the problems that Black and oppressed people face here in Babylon, and how to go about solving these problems in a Revolutionary manner.

The bussing program is serving to strengthen the ties between the community and the prison in letting the brothers and sisters know that they are needed and wanted. In doing this it cuts down the bitterness that grows inside a person in jail. In the past Black men and women have sat in the prisons and jails across this racist country, isolated from the community from which they came.

We are appealing to the community to help us in our efforts to implement this bussing program to its fullest. THE SPIRIT OF THE PEOPLE OF NEW ORLEANS LIVES ON

After the vicious attempt to murder the people's servants in their attack on the N.C.C.F. Headquarters in the Black colony called "Desire", the New Orleans pig department has failed to break the people's spirit. The pigs, under the misguided and malicious leadership of the bourgeois nigger's Mayor, Mayor Moon Laundries, have been kidnapping brothers daily on trumped up charges in a futile and fatuous effort to show who is "boss". But, what they fail to realize is that Black people don't relate to that boss concept anymore. In fact Black people never did! The pigs are only making fools of themselves and they are aiding the revolutionary cause by exposing themselves to the community for what they really are gutless hogs. Their cowardly assaults on the National Committee to Combat Fascism here only serves to pull the cover off the racism. The many Black people who campaigned and voted for pig Landrieu can see now that once again they've been tricked by still another lying, clown politician. This idiot actually believes that by ripping off the young revolutionary workers he can stop the people's struggle for self determination! Such a silly fool to think that he can frighten freedom loving people into submitting to continued oppression. Such actions only intensify our will to fight! The people will emerge the victors! Moon Landrieu does not have the power to lock up or kill a revolution. Neither does any other political criminal who might refer to themselves as President, Governor, Senator, Mayor or just plain undecorated pig!

The people must not be fooled by the pigs propaganda about "Human relations" or "Police community relation. "How can they preach about human relations and at the same time strip us of our humanity? How can they talk about a "Good community"? A child can see through their game. The people know what they see and what they experience everyday. They know that pigs are enemy occupants of their communities. They know that they must rid the oppressed territories of the oppressor in order to survive. The people know that the members of the N.C.C.F. now incarcerated by the political system of this city are not guilty of attempted murder or criminal anarchy as charged. The people point the finger of justice in the direction of city hall. The finger is pointed at Mayor Moon Landrieu and the people are going to do something about it. The N.C.C.F., the people's servants accuse racist Pig Landrieu and his bootlicker, pig Chief Clarence Giarusso of conspiracy to murder in their cowardly, multiple assasination attempt of September 15th and the people will find them guilty.

INCREASED POLICE PROTECTION FOR THE RESIDENTS OF CABRINI GREEN

Carbini Green projects, a 13 year-old housing development, on Chicago's near North Side, will soon be plagued once again by an increased number of Gestapo troops, under the guise of increased police "protection". Financed by a 3-million dollar allotment from the Chicago Housing Authority, this action will undoubtedly entail stepped-up operations of harassment, intelligence, beatings, murders and counter-insurgent (fascist) maneuvers.

Earlier this year, the Carbini Green projects were invaded by scores of fascists, toting an arsenal of high-powered automatic weapons, employed for the sole purpose of annihilating residents of Cabrini Green. This act was the reactionary response to the killing of two pig says operating in Cabrini Green; camouflaged by the Chicago Police Department's "Walk and Talk" program. The house to house search for weapons by these trained fools in blue uniforms resulted in numerous beatings and arrests. Since then the Black Panther Party has reopened the Free Breakfast for Children program, and has initiated actions for the preparation of a new Free Medical Care Center. The pigs have tried to offset both of our programs by starting a half-free breakfast at the local school and promises of a medical center for the residents. But they have seen that their efforts have been futile in preventing the Black Panther Party from serving the people.

The Black Panther Party calls for Community Control of Police in which the police will be made up of residents of the community, rather than of racists and fools from outside the community who have no respect for the people there. The Black Panther Party calls for armed self-defense groups to carry out the protection of the Black community. We must understand that acting in this way is our only chance for salvation.

"We want an immediate end to police brutality and murder of Black people,"

More "police protection" is not the answer to bad housing or badly needed medical facilities, nor is it the solution to the police brutality and murder inflicted on the people who live in the wretched conditions that are allowed to continue by the CHA. The solution to the problem is land, bread, housing, education, clothing, justice and peace to be initiated with guns and backed up with guns. What the people do need is increased medical facilities, increased free clothing programs, increased free breakfast programs, and increased power to the good sniper.

The $3,000,000 was allocated for more armaments and walkie-talkies, but could very well be utilized in removing those intolerable conditions in those projects, or to transform one of those concentration camps into a hospital to serve the medical needs of the people in the community. The funding of these pigs clearly shows where the priorities lie. The priority of murdering the people vs. allowing the people to live as human beings. Cabrini residents have shown their distrust (but moreover their disgust) with the canniving trickery of these pigs. No one in the CHA even bothered to ask the people if they wanted "police protection" nor did anyone offer a suggestion of more health facilities until the Black Panther Party initiated the program. The nature of these pigs makes them move and make decisions in such an arbitrary manner that they ignore altogether the people's right to determine their destiny. This is the true nature of the pigs; to give you what you don't need and to prevent you from getting what you don't have.

The Revolutionary Peoples' Constitutional Convention must set this fascist machinery to eternal rest by showing the people that they, and only they have the power to determine their destiny.

LETTER TO THE MAYOR OF NEW ORLEANS

The Honorable Moon Landrieu Mayor of New Orleans New Orleans, Louisiana 70112

My Dear Mayor Landrieu:

We are appalled to hear Representative Sutherfield's remarks about requesting you to have the New Orleans Police Department to evict the Black Panthers from the apartment they are occupying in the Desire Housing Project, if HANO fails to evict them. Whereas Mr. Sutnerfield may feel that he represents a "silent majority" of the people in our area, we feel that as the spokesmen for a not so silent minority" of the people in our minority, any attempt by the police to evict the Panthers from the apartment they are occupying will cause more unnecessary mass murders in our area. Therefore, we ask that if anything is to be done about the Panther situation, perhaps food and money should be allocated for their use in the Free Breakfast Program that they are interested in starting in the Desire Housing Project area.

Perhaps if the "law and order" advocates of this city and of this state would spend more time affecting changes in the system that require NO use of violent (police) tactics to put down nonviolent, Free Breakfast Programs, such as the one the Panthers have in mind. we could all sleep better at night, knowing that the police will not have reason to fire upon a Panther" stronghold" to use this as an excuse to call in re-enforcements to have another bloody gun fight! We further suggest that because the Panthers meet the requirement of financial need, which determines who will ultimately get an apartment in the slums (e.g., the Desire Housing Project) of this city, we feel that they should be allowed the same rent free status that is given to other organizations that use these apartments for their "poverty programs" and training center activities. We particularly sight as an example the use of the apartment above the one now being used by the Panthers by an organization of the Tulane University School of Social Work. If this predominately White organization can use the facilities of the Desire Housing Project without paying rent, then we suggest that as Mayor of a city that is almost 50% Black, you take whatever steps that are necessary to help the Black Panthers to feed the poor, hungry, Black children of the Desire Housing Project area, while at the same time taking whatever actions that are necessary to prevent more unnecessary Police-Panther encounters.

As we see it, the Panthers are asking no more of HANO, or of the world for all that matters, than are the Whites who are working in our area -- other than an equal opportunity to serve those in need, Continued use of a double standard of treatment for Blacks and Whites by City agencies can only lead to more bloody confrontations. You are in a position to solve part of the existing problem. All we ask is that you do something -- NOW.

OVER THE FENCE TO FREEDOM

The American system of exploitation, oppression and brutalization has created a situation where revolutionary armed struggle is inevitable. Historically the most oppressed have always made the first attempts to obtain their freedom by any means necessary. The brothers and sisters within the confines of the chambers of horrors, the so-called institutions of social rehabilitations, jails and prisons all across this country have moved the struggle of Black people to a new and higher level. Point No. 8 of the Black Panther Party Platform and Program states that "We want freedom for all Black men held in federal, state, county, city prisons and jails." This point is being implemented by the brothers in prisons themselves as exemplified by the actions of Jonathan Jackson. James McClain, William Christmas and Ruchell Magee at Marin County Hall of Justice in San Rafael, California, when these four brothers took destiny into their hands in their quest for freedom.

It was further exemplified by the actions of the brothers in the Manhattan Mieus House of Detention for men in Long Island. New York, the Brooklyn House of Detention, and the house of detention in Philadelphia. These brothers demanded better living conditions, to the point where they seized hostages and sections of the prisons.

Once again the quest for a better living, for freedom, was exemplified by six inmates at the Washington, D.C. jail. This relic of the past is a Brown brick "cave" commonly called a jail which is surrounded by two cyclone fences that are 15 feet apart. One fence is about 20 feet high and is stopped with 12 strands of barbed wire arranged in a V shape, the fence on the inside is lower and has four barbed wires. On Monday November 2, 1970, Charles Swann 21, Samuel Young 24, Frederick Hinton 22, Ray Mitchell 25, Frank Tillman 21, and Leroy W. Howard 18 obtained their freedom.

These brothers were part of a group of 68 men who had left their dungeons for daily exercise in the recreation area, which is a grassy field in the southwest corner of the jail property. They were in a touch football game. All of these brothers mentioned were on the same team and with freedom on their minds. These brothers ran an offensive play down the field and over the fence to their freedom!

When the masses of people move to take their freedom barbed wire fences, guns, or the technology of the oppressor cannot stop them! Our Minister of Defense says that the spirit of the people is greater than the man's technology. So we have to say right on to those brothers, Right On!

ARMY SENTRIES ROBBED OF RIFLES

On Sunday, November 15, 1970, two army guards on routine patrolwere robbed of their M-16 rifles.

They were robbed by two men both wearing stockings over their heads, one of them was carrying a shotgun. They forced the guards into a boiler room, tied them up and made a clean escape with the pieces. excerpt from "Essays From the Minister of Defense, Huey Newton"

"The Black Panther Party for Self Defense teaches that in the final analysis, the amount of guns and defence weapons, such as hand grenades, bazookas, and other necessary equipment, will be supplied by taking these weapons from the power structure, as exemplified by the Viet Cong. Therefore, the greater the military preparation on the part of the oppressor, the greater is the availability of weapons for the black community. It is believed by some hypocrites that when the people are taught by the vanguard group to prepare for resistance, this only brings the man down on them with increasing violence and brutality; but the fact of the matter is that when the man becomes more oppressive, this only heightens the revolutionary fervor. The people never make revolution. The oppressors by their brutal actions cause the resistance by the people."

Although, we do not know if the pieces were liberated for revolutionary purposes, we encourage the people to arm themselves by any necessary.

Are we free when we are not even secure from being savagely murdered in our sleep by policemen who stand blatantly before the world but yet go unpunished? is that" …equal protection of the laws"? This is in regard to the promises made by you on October 2, 1970 to the inmates at Branch Queens House of Detention for Men during recent prison revolts. At that time you stated `If and when hostages were released unharmed there would be no reprisals taken against any individual who participated in said revolt, and if any reprisals were taken you would personally intercede in behalf of that individual.' Recently indictments were handed down by the Queens County Grand Jury against me, James Capers and three other individuals (John Powell's, Kenneth Cender, Robert Carlos Drake) charging us with kidnapping first degree, unlawful imprisonment first degree, inciting to riot first degree, rioting first degree, and reckless endangerment first degree.

I appeal to you to fulfill the promises made by you, and to intervene in my behalf. This indictment has been brought about by the Department of Corrections and other city officials who seek to persecute us and discourage prisoners from protesting their illegal detention and the inhuman conditions which we are subjected to. I, being Black and poor and unable to obtain competent legal counsel do not expect to receive a fair and just trial, therefore, it is requested that you render legal assistance. I also respectfully request your appearance on November 5, 1970 at the Queens County Supreme Court for my arraignment.

PIG HARASSMENT ESCALATES IN BAY AREA

At approximately 3:30 a.m. on Nov. 9th. five of my comrades and myself were stopped by the pigs when we were en route to Richmond. Four pig cars blocked our car on all sides and a nigger pig named "Poole" approached us. The driver asked the pig why we had been stopped and the pig replied that the car had warrants on it. The pig then asked the brother sitting opposite the driver his name and ordered him out of the car. Pig Poole searched and harassed the brother while the other pigs stood by, paranoid and eager to be at or kill Michael.

After this the pigs caucused to decide whether or not they were going to take us to jail. Finally they told us to leave because they were mistaken about the car having warrants and we weren't the people they were looking for.

Everynight for the past week, the pigs in the Bay Area have stopped and harassed almost all Panthers and community workers leaving the offices at night. Three nights prior to the above related incident, I was also stopped at approximately 2 a.m. The pigs ordered me out of the car and started yelling hysterically about something being in my hand. When I moved to show that it was only a scarf in my hand, one of the obviously nervous pigs moved in behind me and unfastened his holster. The other pig told me to throw the scarf on top of the car.

The increasing acts of harassment and brutality in the Bay Area are the pig's response to our effective political work. The pigs are going mad because the people are grasping and implementing the ideology of the Black Panther Party. The masses of people are picking up guns and turning them against the pigs. Pigs are dying and will continue to die in the streets of Babylon.

BLACK YOUTH VICTIM OF GENOCIDE

Under the guise of law and order, pig storm troopers have time and time again invaded our communities and perpetrated mass murder, inhuman brutality, exploitation, and oppression on Black people. As part of a national conspiracy to commit genocide on the Black race in Babylon, the pigs usually attack our youth.

At about 8 p.m. on October 31st., Halloween night, Joseph Norwood (13), Sylvester Norwood (15), Lester Cheathian (15), Larry Knight and six other young brothers were on their way to a party, when they noticed a fire in a graveyard at Norman die and Washington Sts. Knowing that the youth of our community usually have bonfire parties in graveyards on Halloween night, the brothers started toward the fire.

As the brothers approached, approximately twenty to thirty terrorist pigs jumped from behind trees and tombstones and surrounded them. The pigs started screaming madness that none of the brothers understood, so brother Lester held up his hands saying "We didn't do anything." That statement was the cue for the pigs to go into their usual fascist performance on our youth. After a severe beating with the pigs nigger sticks, the brothers were thrown out of the graveyard.

Later on that evening, more of our young brothers and sisters fell into the same pig trap and became innocent prey of the sneaky tactics characteristic of low natured beast. All incidents of pig brutality and murder of Black people are part and parcel of a pig program of genocide, for Black people's right to life, liberty and the pursuit of happiness are constantly being systematically denied. In order to halt this war of genocide being waged on our people, we must secure our rights by building another foundation -- a new constitution. Even more important, we must implement this new constitution with a revolutionary justice that only the masses can mete out.

PIGS ATTACK AND BRUTALIZE 18 YEAR OLD BROTHER

On November 13, brother Ronald "Chico" Richardson, 18 years old, was brutally beaten and attacked by racist brutes from the Newton St. Division of the L.A. Pig force. This attack occurred as several young brothers were playing football on 57th St. in Los Angeles. These pigs, who had just minutes before accosted assister and then let her out on the corner of 57th and Broadway, were driving a blue Rambler station wagon and were wearing plain clothes. After they released the sister, they drove on down the street to where the brothers were playing football and told them, "Niggers get your Black butts out of the street or I'll run over you!" They circled the block and came back to where the brothers were and again told them. "Get out of the streets or you're going to jail." Chico, who has a chronic asthma problem and suffers from severe seizures, asked. "Who are you taking to jail?" and then the pigs jumped out of their car and began beating the brother and chocking him until he passed out. Then they pushed him onto the street, were he lay, coughing and spitting up large clots of blood.

The community became very up-tight when they saw what happened and one concerned mother came running down the street and asked the pigs what had happened. One pig answered. "We're arresting this nigger for resisting arrest." Then they picked the brother up shoved him in the car, and carted him off to jail.

This isolated incident is very indicative of the type of inhumane treatment practiced daily on oppressed people by the agents of this fascist, racist power structure. If laws were made to serve men equally, we wouldn't be faced with such barbaric treatment and complete denial of our basic human rights today. Our past history and present condition makes it crystal clear that the laws of this decadent society were not made to serve Black people in particular, and oppressed people in general. Therefore, we must move to destroy all remnants of this racist power structure, from its decrepit constitution, its agents and lackeys…the local gestapo pigs.

WE FIND THE SLUMLORDS GUILTY OF GENOCIDE

On Thursday afternoon, Nov. 5, 1970, another brother in Winston-Salem died because of the negligence of a slumlord. Ernest Leroy Suber, 29, died from a fire which could have easily been avoided if the slumlord, C.W. Miles, had made the necessary repairs on the house. The house where brother Suber lived with his wife and 5 children had some faulty wiring and a gas leakage which could have easily been repaired. Because Slumlord Miles neglected to make the necessary repairs, the house was hazardous to the occupants.

It is well known throughout the Black community of Winston-Salem that C.W. Miles is a racist and avaricious slumlord who often neglects the needs and demands of his tenants. Brother Suber's family had repeatedly asked pig Miles to repair their home. Each time he sent some lackey who would always report that the house was in perfect condition and leave. There is concrete evidence that the fire was a gas fire because within two minutes after the fire was spotted there was an explosion and flames erupted everywhere. The house was destroyed, however the pig department says that "they" haven't yet found out why the fire started.

When brother Suber's wife asked slumlord Miles if he could let them stay in one of his other houses until they got themselves together he told them that he didn't have any place for them at all. As a result of the fire Ernest Suber's wife, Barbara, now has no home and 5 fatherless children. Slumlords like Miles should, be dealt with because when they deny the people decent housing and a brother dies because of their neglect, they are guilty of genocide. The fascist pig power structure of Babylon makes things easy for slumlords like Miles because they recognize and endorse this form of genocide. We need laws that will punish slumlords and other pigs for their ill practices on the people. This definitely shows the need for a Revolutionary People's constitution. Poor and oppressed people and Black people in particular have no laws that are relevant to them in today's decadent society.

The people of Winston-Salem and all the people of Babylon find C.W. Miles and other slumlords guilty of genocide and the sentence is…

THE PEOPLES STRUGGLE CANNOT BE BLOCKED

With the growing concern of the people over the fate of Chairman Bobby Seale and Sister Ericka Huggins, and as the trial date draws nearer, the pigs have stepped up the harassment of members of the Black Panther Party, Community Workers and Supporters of the Party.

Preceeding the November 3rd rally for Chairman Bobby and Sister Ericka, people working out of the Connecticut State Chapter headquarters in New Haven were putting up posters announcing the rally when the pigs tried to prevent them from doing this. On Tuesday, October 27, four brothers - Billy O., Marvin, Lumped, and Gary - were arrested by plainclothes detectives about two blocks away from the office. The charges were dismissed the next morning in court. Later that night (Wed. Oct. 28) Gary and two sisters from the community - Sharon and Ella - were arrested while putting up posters. Thursday morning in court, their charges were also dropped. Later that same night, a member of a local Radical Women's Collective, was arrested after placing a poster on a wall with a thumbtack.

It should be obvious that all of these arrests were nothing more than petty, general harassment and an attempt to sabotage the people's rally. However, this only served to heighten these brothers' and sisters' consciousness and the peoples' servants continued to function untill the posters were up all over the city.

Just as "Bozo" Rizzo made a futile attempt to block the RPCC Plenary Session by putting his fascist dogs on three of our Philadelphia offices, here in New Haven, Chief Pig Ahern made an equally vain attempt to block the Nov. 3rd rally. We are certain that the pigs will continue to try and stop the RPCC from being successful. But we say, as Big Man expressed it on the Green, "If we can't have it at the Armory, there's always the White House lawn; but we're going to hold our Revolutionary People's Constitutional Convention …by any means necessary… whether the pigs like it or not." The people's struggle will continue.

ON THE MURDER OF RONALD REDRICK

On Sunday night, Nov. 8, 1970, on the South Side of Chicago, Ronald Redrick was slain at the hands of Mayor Daley's finest uniformed pigs.

The enemies of the people say that Ronald, age 19, was stopped by an officer by the name of Maurice McNulty in what he believed to be a stolen car.

The pigs also state that Ronald was shot and killed accidentally when McNulty's already drawn gun discharged because Ronald attacked him.

As usual, on investigation, the Black Panther Party found this story given by the pigs quite different than the account given by the oppressed people who inhabit the Black community where Brother Redrick was murdered.

One brother, Charles Terrell, 36 of 726 E. 37th Place, says he saw McNulty deliberately shoot and kill Ronald as he was running away from the scene where he had supposedly been stopped. Two sisters, Diane Bass and Gayla Pope, both age 16, made similar statements. All the witnesses live in the immediate area where Redrick was shot.

Let's look at the facts more closely. McNulty claims that Redrick attacked him and his gun discharged, killing the brother. Why would the brother attack a pig who had his gun pointed at him? Ronald was supposedly shot at close range. Why then were there no powder burns found on his clothing? (powder burns would indicate he had been shot at close range.) If the brother was shot while struggling with McNulty, how do you explain the fact that the bullet entered through Ronald's back.

No, the story given by the pigs is clearly a fabrication designed to mislead the people. But the people have acquired consciousness, they know and understand their relationship to the power structure, and they are moving to correct the contradiction that exists between the people and the pigs.

The Black Panther Party went to the funeral at the request of the family of Ronald Redrick and our Deputy Minister of Information, Michael "Tapps" Rhymes helped deliver the eulogy. Tapps stated that:

"The death of Ronald Redrick will be avenged. Although everyday in the oppressed communities of Babylon we hear of brothers and sisters being murdered by the fascists, the other side of the coin is that every day you can hardly pick up a paper and not see the same thing happening to the pigs, and there is a greater number of people than pigs."

The people called a community meeting to discuss ways and means to deal with the situation. They are prepared to move on the aggressors that infest the Black community by any means necessary.

PIGS ATTEMPT TO SABOTAGE FREE BREAKFAST PROGRAM

The Free Breakfast Program in Bromley Heath is only 3 weeks old and has already served close to 700 school children! In order to run the program, the businesses in the area, along Centre Street, were asked to donate either money or supplies to the Free Breakfast Program on a weekly basis. Historically, white-owned businesses have made profits hand over hand from the Black community and these profits have left the area, draining the community of its monies. We feel that the time has come for these stores and store owners to re-invest some money back into the community, so that the community can grow and prosper, and the Free Breakfast Program for School Children is one of the best and most concrete ways to do this. Also, we feel justified in asking for a donation on a weekly basis for the simple reason that the people in Bromley - Heath Projects shop and spend their money along Centre Street on a daily basis, let alone, weekly. Besides, the Free Breakfast Program is run daily, Monday-Friday, 7:00 A.M. to 8:15 A.M.) A $5.00 weekly donation wouldn't break any of those stores and the money or supplies is greatly needed in the community. There is not one White owned business along Centre Street (which was asked) who will contribute to the free Breakfast Program.

Power is the ability to define a certain thing, (figure out where its coming from) and then make that thing act in a desired manner. We understand that this power to change things, to fit our human needs and desires, can never be lost and always rests in the people We must be able to tell our friends from our enemies, to draw lines of distinction, for we know we have the power to inflict upon our enemies a political consequence to deal with them accordingly.

While all the stores along Centre Street have proved by their actions to be more interested in profit and money making than in the interests and well being of the community, certain stores have proved by their arrogance to be outright, dead up, enemies of the people -- Pigs. Three in particular, Meat-land, Stop and Shop and Kozy Korner. And there should be no hesitation as to our response, our political consequence. These three capitalistic greed-hungry stores should be boycotted until such time as they donate an adequate amount of supplies, or they should be put out of business.

We have the power, we've always had the power, and the time has come to use our power.

RACISTS AND FASCIST PIGS ATTACK PEACEFUL DEMONSTRATORS

Recently the pigs in Trenton oinked that Black children who have been attending schools in their own Black community are now to be bussed to a school in the white community for the purpose of integration. Some people from the Black community came together and staged a peaceful demonstration outside of the school (located in the white community). Because they believe that children from the Black community shouldn't have to be bussed miles away. Just to go to school with white people when they could go to school right around the corner from their homes. Most of the white student's parents who are racist and didn't like the idea of their children going to school with blacks were also present at the demonstration. The peaceful Black demonstrators soon found themselves victims of an unprovoked attack and they defended themselves the best that they could under the very heavy odds. The local pigs had come and they helped their racist brothers attack the demonstrators and then arrested them.

News of what happened spread quickly and soon the streets were filled with Black people, looking for someway to retaliate. The slow moving mass threw bottles and bricks through store windows and at white people. Immediately, the pigs came in marked and unmarked cars, jeeps, tanks, and helicopters. Most of them carried 12-gauge riot pump shotguns, .357, 41. or .44 magnums. The pigs beat people in the crowd and at gun point carted people off to jail. Although the people out-numbered the pigs, the pigs were able to quell the crowd and force them off the street with the use of the gun.

However, most of the crowd was composed of people between the ages of 12 and 21, and their fighting spirit could not be crushed by the pigs. The crowd was back on the streets bright and early the next morning, and there numbers were even greater than the day before. Many adults showed up this time, filled with hatred and disgust for the pigs, because of the way the law-natured beast had dealt with the youth on the previous day. (One young brother had been shot by one of the pigs and is now in the hospital). The pigs also showed up in greater numbers than the day before, equipped not only with guns, but with police dogs also. Boot-lickers from various (jive) organizations held meetings to try and make the Black people `behave', but the masses saw through their game and left the meetings and went back to the streets.

A state of emergency was declared (by pig Mayor Holland). The people were attacking the pigs with bottles and bricks. Soon the reactionary forces started firing shot-guns blast above the heads of the people in the crowd and then they fired at the heads of people in the crowds. When this happened the crowd fled into alleys and buildings, but the pigs fire was returned by a lone sniper and all the big bad pigs ran: like scared dogs for shelter, anywhere they could find it. The crowd laughed because the pigs had been exposed as the cowards that they are, even to themselves.

The pigs are the strong-armed cowards that are hired to keep us in our place and to make sure that we don't disrupt the process of exploitation. They are there to keep us from moving to change the oppressive conditions that we live under. When we move anyway we are labeled as rioters, looters and criminal trouble-makers by the reactionary pig press. But we must move; failure to move against these conditions would be reactionary suicide. The days of reactionary suicide are long gone and now is the time for revolutionary suicide. Because we have justification for moving against these conditions. It is not only our right but it is our duty to do so. When we move it must be organized and strategic. Large numbers of people moving hap-hazardly through the streets only gives the pigs an opportunity to do the thing they like to do most, and that is `Kill Niggers'. Violence of this type is sporadic and short-lived. Many people get thrown in jail and vary few pigs get hurt.

Revolutionary violence is of a different nature. It is time for people to travel in groups of 2's and 3's throughout the city and then we can kill a pig as he eats a hamburger at the `White Castle' Restaurant or while he is sitting in his car reading the morning newspaper. This way is longer lasting and much more effective than bricks thrown at pigs clad in heavy suits and carrying a shot-gun. The longevity of our resistance will depend on how well we can attack and get away.

To the pigs of the power structrue we say: Where is freedom when the right to `Peacefully Assemble' brings on massacres ? Where is our right to `Keep and Bare Arms' When Black people are attacked by the racist gestapo of America? Are we free when we are not even secure from being savagely murdered in our sleep by policemen who go unpunished ? Is that'… Equal Protection of the Laws' ?

The empty promise of the consitution to `Establish Justice' lies exposed to the world by the reality for Black people's existence.

The pigs have shown the people of Trenton just another reason why -- we must have a Constitutional Convention. They must make it crystal clear that oppressed people have no rights that the oppressor is bound to respect.

THERE IS NO RHETORIC TO MATCH THE TRUE INTENT OF THE FASCIST

Whereas, Pursuant to the Powers Vested in Me by The Laws of 18 71, Section 21, App. A:9-40, et seq.: N.J.S.A. 2A: 126-4, et seq&dot, I have declared a local disaster emergency which exists within the City of Trenton; and

WHEREAS, the aforesaid laws authorize the promulgation of such orders, rules and regulations as are necessary to meet the various problems which have or may be presented by such emergency:

NOW, THEREFORE, IN ACCORDANCE with the aforesaid laws, I do hereby promulgate and declare the following regulations to be in effect until such time as it is declared that such an emergency no longer exists in the City of Trenton, which regulations shall be in addition to all other laws of the State of New Jersey and of the City of Trenton:

There shall be no movement of vehicular traffic in the City of Trenton between the hours of 6 p.m. and 6 a.m. of the following day, except for the movement of police, fire, and such other vehicles as may be permitted by me and other authorized officials.

There shall be no vehiclar traffic within such areas of the City of Trenton as I may from time to time designate and at such hours as I shall designate during periods other than the hours expressed in regulation No. l aforesaid.

No person shall sell or dispense gasoline or other flammable products within the City of Trenton except directly into a vehicle for the use thereof during the existence of this emergency.

No person under the age of 21 years shall remain in or upon the public streets, ways or places of the City of Trenton within the hours of 9p.m. and 6a.m. of the following days, except as authorized by me or other designated officials.

All persons licensed under the Alcoholic Beverage Control Law to dispense alcoholic beverage or for on premises consumption shall cease operation of their businesses during the existence of this emergency except that hotels may remain open for the service of food and supplying other accomodations to their guests.

No person other than State Police, Trenton City officials, local police or any other law enforcement person shall carry, hold or possess in any motor vehicle, carriage, motorcycle or other vehicles, or carry on or about his clothes or person or otherwise have in his possession, or under his control, alcoholic beverages, narcotics, firearms or explosives of any kind during this emergency.

AVARICIOUS SLUMLORD EXPLOITS BLACK WOMAN

Point #4 of the Black Panther Party 10-point Platform and Program states, "We want decent housing fit for the shelter of human beings." Howard Avenue apartment houses is a contemporary example of indecent housing which the people of Brownsville are subjected to daily by the white greedy slumlords.

One recent victim of these blood suckers in our community was a sister by the name of Myra Davis. Mrs. Davis who resides at 663 Howard Avenue has been having trouble getting a decent refrigerator among other repairs made in her apartment. For several weeks she (Mrs. Davis) has been complaining to her landlord, pig Roter, who owns several slum buildings on Howard Avenue about the broken refrigerator in the apartment. All she could get from this greedy fool was promises, but no results. Finally after much aggravation, a different refrigerator was brought to her apartment, but Mrs. Davis was to find out that this one was in even worse condition. Apparently it came from another apartment, where a tenant had been evicted or moved due to the sub-human living conditions in most of the buildings. Greedy slumlords seldom use money from the profits they have looted (robbed) from the Black and Puerto Rican community to make repairs. Roter Realty is one of a clique (gang) of big-time slumlords who have vast (large) control over local politicians like bootlicking Sam Wright and police nigger Captain Wilson of the 73rd precinct.

To protect their interest in the Brooklyn Colony (East New York, Brownsville, Ocean Hill) and other colonized areas, they find it very advantageous (economically) to have this type of syndicate. Understanding the politics of capitalism, this pack of wolves work hand and glove with one another. Some of the others are Eugene Hoffman, Kermitt Goell, Sam Levine and a few whose names aren't available at this time. When Mrs. Davis received what she thought to be a good refrigerator she went out and bought groceries for her apartment. When she returned home that evening to cook, all the food had spoiled. The lost was totaled at $20.00, which isn't anything for an avaricious (greedy) businessman like Roter to replace; but for black people and other poor people like Mrs. Davis who have to break their backs to earn slave wages which cannot even meet their basic needs, such as food, clothing, housing and medical needs, etc., this is a great loss. Mrs. Davis has included her $20.00 food loss along with the other grievances, and is demanding satisfaction. Mrs. Davis brought her problem to the Black Panther Party like many other people in our community. We will listen to her and the rest of the oppressed people of Brownsville and educate the masses to the correct way of dealing with these thieving dogs who plunder (rob and rape) our communities year in and year out. We call for an immediate end to the robberies of our black communities by the capitalist dogs like pig Roter, and we will not rest until they return the stolen profits and are ran completely out of our communities by any means necessary.

HOUSING IN THE BRONX COULD ONLY HAVE BEEN CREATED BY CRIMINALS

The biggest and most explosive problem confronting people in the Bronx, New York today is housing. Greedy slumlords and City and State government agencies lie at the heart of the problem. They turn open pockets and deaf ears to tenants' pleas. The People's Housing Coalition of the Bronx, composed of these tenants, work daily with the Black Panther Party to correct some of the inhuman conditions that could only have been created by criminals!

It is not uncommon for a person living in the Bronx to have to walk through maggot infested, garbage strewn hallways with holes in walls to get outside to a fire hydrant because there is no water inside the building. Back inside they have to deal with roaches, mice and alley-cat size rats that try to make meals of the children. While cooking they have to stand guard over the food not only to ward off animals but also to short stop any waste that may drain from the toilet bowl in the apartment above when it is used. The tenants of the People's Housing Coalition patch holes, paint walls, repair plumbing, drain flooded apartments and do anything else thats needed.

Another common occurrence in Bronx is lead poisoning. Lead paint affects mostly children and all too often it isn't detected until the child is on his death bed. One mother on Woodycrest Avenue found that her child couldn't talk because of lead poisoning. The slumlord is trying to evict her for not paying rent. Mrs. Virginia Grey's children were taken from her home at 1540 Charlotte Street by the fascist state because they were lead poisoned. With the help of the People's Housing Coalition, she regained custody of them.

The East Concourse Housing and Rehabilitation Center along with other city and state agencies that are supposed to be taking care of the housing problem is not doing its job. Tenants have gone to these offices for help, and have been given every excuse and lie the pigs could think of to avoid repairing the violations. We've gotten inspectors and more inspectors but no repairs. We've had our buildings certified, received letters from Mayor Lindsay, held meetings with his flunkies and lackeys and still no repairs have been made. We've organized tenant committees from various buildings, amid constant harassment from the pig department, filled out form after form, had had our patience tested time and time again. We have exhausted all legal means. All Power to the People.

DEMONSTRATION

A demonstration is being called by Women's Liberation in the Bay Area in support of Bobby Seale, Ericka Huggins, Angela Davis, and all prisoners of war being held in the Bay Area such as the Soledad Brothers, Shellie Bursey, Ruchell Magee. The demonstration is called for December 12 across from the Alameda County Courthouse, 12th and Fallon in Oakland. Women are urged to create mass mobilizations in support of these and other prisoners of war across the nation at prisons and jails on this day.

This demonstration further is in solidarity with all women and men incarcerated in the concentration camps of Babylon. We are also planning to expose the brutality, sadism, racism, and sexism practiced in these camps.

THE BEGINNING OF THE TRIAL OF CHAIRMAN BOBBY SEALE AND ERICKA HUGGINS IN NEW HAVEN, CONNECTICUT MARKS WHAT THE PIGS ON A LOCAL AND NATIONAL LEVEL, HAVE PRE-ARRANGED AND OVER-CONSPIRED TO BE THEIR GREATEST VICTORY FOR FASCISM

On November 17, 1970, the first day of the trial, with the exception of one boot-licker, an all white jury panel was present. All of the prospective jurors are middle-aged, middle-class, registered voters, and have never been arrested. These legal railroaders are the farthest deviation from the peers of the defendants.

Black Panther Party Chairman, Bobby Seale and Connecticut State Chapter Deputy Chairman Ericka Huggins are the trial defendants charged with murder, conspiracy to commit murder, kidnapping, conspiracy to commit kidnapping and binding. The beginning of this trial in New Haven, Connecticut marks what the pigs on a local and national level, have pre-arranged and over-conspired to be their greatest victory for fascism. The presence of the jury completes the tool kit necessary for a clear cut fascist railroad.

Judge Melvey is there to overrule every defense objection, deny defense motions, interrupt the defense counsel when he doesn't like what is being said, give his own opinion about the guilt of the defendants, and intimidate defense witnesses and the general audience with contempt of court sentences. Also the District Attorney is there; he will object to everything the defense says, make prejudicial statements, and enter lies on the court record as facts.

To ensure a contaminated jury, the judge on the first day denied a defense motion to have the jury sequestered from that day on, Judge Melvey's alledged grounds for denial was that the motion had already been heard and denied by another judge in a pre-trial hearing. The denial of the motion means the jury will be allowed to go home each evening to gossip with their families and neighbors, read the pig press, listen to racist news releases on radio and T.V. and return to court the next morning to listen `objectively' to the testimony. By the conclusion of the trial, the jury will be able to return a most decisive guilty verdict.

A second defense motion requested that members of the press be allowed to do sketches of courtroom scenes. This motion was also denied (one artist had four sketches confiscated) because courtroom sketches might give the masses of people a glimpse of what is happening to Chairman Bobby and Ericka, that cannot be allowed. Throughout the entire court proceedings the pigs hope to keep only an immobilizing distortion of the facts before the masses of Black people in Babylon. At this point however, Black people from a historical experience of 400 years of slavery and repression in America know that Chairman Bobby and Ericka are victims of a fascist frame up.

"…one thing must be made absolutely clear to America; no matter what the White people of America are prepared to accept, Black people do not accept this ultimate attempt to bind and gag Bobby Seale with death because of the fearless leadership that he has given to our people."

"Our Minister of Defense, Huey P. Newton, teaches us that in order to have security from the unceasing aggressions of the enemy, we must always be in a position to inflict a political consequence upon the aggressor for each act of aggression. This attempt to murder Chairman Bobby Seale cold-bloodedly in the Electric Chair is an open provocation and the ultimate aggression against Black people. It is a calculated step taken by fascist pigs in the unfolding of their vicious blueprint of genocide against Black people. We, Black people, if we are forced to go it alone, must be prepared to unleash the ultimate political consequence upon this racist nation. The ultimate political consequence which Black people have in their power to unleash is RACE WAR. Indeed, we have been and at this very moment are the victims of a systematic racist repression. The Black Panther Party, as everybody knows, has taken a leading role in trying to avoid precisely this disasterous RACE WAR which the fascist oppressors have been working night and day to bring about. But we cannot and will not continue this policy to the point of racial suicide. We will not sacrifice Chairman Bobby Seale on

the alter of interracial harmony if White people continue to sit back and allow this ghastly plot to go forward. So if the so-called freedom loving White people of America do not stand up now, while there are still a few moments of time left, and put an end to the persecution of Chairman Bobby Seale, then Black people will have to go it alone and step forward alone. This will mean the end of our dreams for the Class War which America needs and the beginning of the Race War which America cannot endure. This is the political consequence which America faces because of this unspeakable evil attempt to murder Chairman Bobby Seale in the Electric Chair."

INTERNATIONAL NEWS: STATEMENT BY MINISTER XUAN THUY, CHIEF OF THE DELEGATION OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIET NAM, AT THE 19th PLENARY SESSION OF THE PARIS CONFERENCE ON VIET NAM NOV. 5, 1970

Ladies and Gentlemen,

1. At the last session, the U.S. delegate said again that we were putting preconditions while the U.S. proposals were fair and without conditions. But the truth is just the reverse, U.S. proposals are made with conditions and are not fair at all. Moreover they contain a great deal of fallacy and falsehood.

For instance, with regard to the question of troop withdrawal, the United States demands a "mutual withdrawal," making believe that it is advancing a fair proposal without conditions. But, as a matter of fact, having brought its troops for aggression against Viet Nam it must of course rapidly and totally withdraw its troops, without posing any condition to the Vietnamese people. It has however been adamant in insisting on a "mutual withdrawal." This is a condition put with extreme absurdity indeed.

Or with regard to President Nixon's proposal of "cease-fire-in place, without preconditions, thoughout Indochina," the United States claims that such a ceasefire will make both sides "stop the use of force" and "let down their weapons." Actually it wants to make people mistakenly think that this is "fair" and "without conditions." In fact, this is a way of limiting the Vietnamese people's sacred right to self-defense, because a cease-fire observed when nearly 400,000 U.S. troops and 70,000 soldiers from other foreign countries in the U.S. camp are still occupying South Viet Nam and when the U.S. puppet administration is still oppressing and exploiting harshly the South Viet Nam people, is tantamount to a legalization of the U.S. egression and U.S. NEO-COLONIALISM. How can such a "cease-fire" proposal be said to be "fair" and "without conditions" On the contrary, the Provisional Republic of South Viet Nam has proposed that, after the U.S. government has accepted to withdraw from South Viet Nam all U.S. troops and those of the other Foreign countries in the U.S. camp by June 30, 1971 and let the South Viet Nam people form a provisional coalition government with three components, and after the parties have signed agreements, the parties will stop fighting. This is evidently a correct proposal aimed at ensuring independence and lasting peace in South Viet Nam.

Or, with regard to the political settlement in South Viet Nam, the United States tortuously talks about the South Viet Nam people's right to self-determination, about the three principles governing the U.S. position, etc. but its real intention is to try to maintain the dictatorial, warlike, and corrupt Thieu Ky Khiem administration it has created. This cannot be qualified as a "fair" proposal "without conditions," but one aimed at imposing a U.S. puppet administration and U. S. neo - colonialism upon the South Viet Nam people.

Therefore, can it be said that, at this conference table, there are two completely opposite approaches to the Viet Nam problem.

One is the 10 point overall solution of the P.R.G. of the R.S.V.N. that Minister Mme Nguyen Thi Binh further clarified in her September 17, 1970 peace initiative, aimed at peacefully settling the Viet Nam problem on the basis of respect for the fundamental national rights of the Vietnamese people and the self-determination of the South Viet Nam people.

So far as the D.R.V.N. is concerned, we have said that although in our view, socialism is the best system, yet we do not impose socialism upon anyone. This is why we fully approve and unreservedly support the solution proposed by the P.R.G. of the R.S.V.N., i.e. South Viet Nam will become independent, peaceful, neutral, and democratic the reunification of Viet Nam will be carried out step by step through peaceful means and on the basis of negotiation and agreement of the two zones, without coercion from either side.

The other approach is that the United States has advanced most arrogant proposals. The Nixon administration together with the Thieu Ky Khiem administration are opposed to both communism and neutralism. It is evident then that the United States only wants to keep South Viet Nam in the framework of U.S. neo-colonialism, that is to say to seize South Viet Nam as a U.S. neo- colony and military base. This is an objective it has been unable to achieve after so many years of war. It is trying to achieve it now through diplomacy frauguient elections and terror that it calls the legal way. This is precisely the essence of President Nixon's so called "five point peace proposal."

One may ask which of these two approaches is correct, logical and reasonable and who is putting conditions to whom? Who really wants to end the war, honorably to all the parties? Who wants to prolong the war and the deadlock of the Paris Conference on Viet Nam? It is obvious that the U.S. Government has put preconditions and demanded a price for the end of its aggression (which it is compelled to end), while the P.R.G. of the R.S.V.N. and the Government of the D.R.V.N. have, with their logical and reason able proposals, shown the utmost flexibility.

We have often said that President Nixon always talks one way and acts another. During the last electoral campaign in the United States in order to gain votes for his followers in the Republican Party, he did his best to make fallacious propaganda, making the Amercian people believe that he wanted to end the Viet Nam war and to bring home all U.S. troops. He boasted that the "Vietnamization" policy was fairly successful, that a number of U.S. troops had left South Viet Nam that billions of dollars of war expenditures had been cut off, that the war was going to an end, etc. This was aimed at deceiving the American people and allaying thier indignation, opposition to the war, and demand of troop repatriation.

But it becomes clearer and clearer that President Nixon has not the least intention of ending the war in Viet Nam or of pulling out all the G.I.'s from South Viet Nam. Mr. A. Harriman, former chief of the U.S. delegation to the official conversations between Viet Nam and the United States recently wrote in the American magazine "Look" that Mr. Nixon's policy of "Vietnamization" is not a plan for peace but one for the prolongation of the conflict."

It should be pointed out that so long as the U.S. war of aggression is not ended, the United States will not be able to resolve its difficulties in all fields. How can Mr. Nixon conceal from the American people the more and more serious inflation in the United States, the increasing budgetary deficit that amount to over 10 billion dollars this year, particularly, the unemployment that has now reached the number of 4,607,000 men while there were only 2,675,000 when Mr. Nixon came to office. During the last electoral campaign, he deliberately resorted to lying to mislead American public opinion, but the American people are not easily fooled. Senator E. Muskie himself has accused President Nixon of leading, inspiring, and guiding a political campaign built on lies, slander, name calling and deception of almost unprecedented volume. In the process, he said, the United States' millions of voters have been deprived of full and fair public debate on the real issues confronting the nation: inflation, unemployment, war, the cities, and a generally shaking economy.

Mr. Nixon resorted to all perfidious means to secure majority in the Senate and the House of Representatives and to win the majority of State Governorships so as to implement more reactionary internal and external policies, but he has met with failure, as has been evidenced by the outcome of the recent elections on Novemeber 3rd.

If Mr. Nixon really wants to end the Viet Nam war, to get the United States out of the war, one very costly in lives and wealth, and thus to solve the difficulties in all fields of the country, thereby meeting the most urgent demands of the American people, he must change his policy, stop his empty talks about peace, really stop the U.S. policy stop his empty talks about peace, really stop the U.S. policy of aggression in Viet Nam and Indochina and let the internal affairs of Viet Nam be settled by the Vietnamese and those of Indochina by the peoples of the Indochinese countries without foreign interference.

The September 17, 1970 peace initiative of the P.R.G. of the R.S.V.N. has offered a good opportunity and an honorable way for the United States to do so. The U.S. Government should give this peace initiative a serious answer.

On the contrary, if the United States obstinately persists in pursuing its aggression, the Vietnamese people have no other way than to stand shoulder to shoulder with the Cambodian and Lao peoples and resolutely continue their sacred struggle for self-defense until real independence, freedom and peace are recovered.

This just struggle, approved and supported by the whole progressive mankind, will win glorious victory.

IT SEEMS TO BE THE BLOOD OF BLACK PEOPLE, ESPECIALLY THE BLOOD OF A PANTHER, THAT FEEDS THE GESTAPO POLICE

The police are pushing us into a corner, we say we are revolutionaries, we say that the corner is not a good place to be and because we are in fact revolutionaries we will not accept a corner as our grave.

I think that the police forces of America have proven by their practice that they are now the judges, jury and executioners of Black people. They have been given a blank check, a clear road to jail, beat, and murder Black people. They have become masters of intimidation and of brutal repression.

The actions of the police have to be counteracted by revolutionary actions of the people. Another step has to be made on our journey toward freedom. That step is reprisal. We cannot continue to allow these atrocities to go unjudged. It seems to me that the blood of Black people, especially the blood of a Panther seems to feed the gestapo police, it seems to make them more monsterous than they were before, they have, it seems developed a sick enjoyment in murdering our comrades whether it be in their sleep or in a gun fight. They know they have gone unjudged by the masses of people. This is wrong and must stop. The verdict is guilty, you know it as well as I. The sentence is death: A head for a head, a life for a life.

Winter time is rapidly approaching along with the fallacy that the summer-time is the right time, the only time that Black people want to rebel or can rebel. I say this is and has been a very tactful lie. In fact, the summer-time is more favorable for the pigs. They have complete freedom of mobility. Communications serve mobility.

When the snow is fresh and slick, mobility is stifled. Objects can easily be placed in the snow to stop or slow down this pig mobility giving the guerrilla a clear flight. A pig can easily be trapped in the snow. His calling for assistance will be of no avail because of the swiftness and foresight of the urban guerrilla, assistance will only be there in time to cart off the unarmed remains of a pig.

This year can also serve to be very beneficial for the urban guerrilla and very disasterous to the avaricious greedy businessman.

Dig, Xmas is swifty approaching, this means that goods will be brought into the various cities, in monsterous quantities to be sold to the masses. As in the past the businessman will make 200 and 300% profits off the people. Due to the present economic situation that America is in, I would say that the Xmas profits are very heavily depended on. Because one of our main tasks is to drain, disrupt and destroy, the strategy for the 1970 urban guerrilla is to destroy those goods on a mass scale. I'm saying that in those factories where Black people sell their labor -- throw a nigger wrench into the machinery. I'm saying that the trucks and trains that carry these goods to market should not be allowed to reach the markets, then I'm saying that the markets themselves be turned into infernos. The only caution outside of being captured is against the injury or death of innocent people. We must always bear in mind that we are servants of the people, we are not bent on destruction for the sake of destroying but destruction of those things that oppress and systematically destroy us.

Any people that cannot inflict a political consequence is virtually a people without power. Greet Santa this year with a bang.

PIGS LET INJURED BROTHER LIE IN THE STREET FOR 36 MINUTES

Black people in this country have no rights that the oppressive power structure or their lackeys and running dogs are bound to respect. As more and more of the masses become conscious of this phenomena, the armed struggle reaches higher and higher levels.

In the Grove Hall section of the Black colony of Roxbury in Boston, many people were educated on Saturday October 17, by the fascist Boston pig department. I was in the area selling the Black Panther Party newspaper when I noticed a group of people standing in the middle of the street. Two pig cars were parked on the side of the group of people so I walked on up the street to investigate and when I got there I noticed a brother lying on the ground. The people told me the brother had been hit by a car. I rapped with the brother whose name is Phillip "Boo" Jackson, and he told me his leg was in extreme pain, and he was sure it was broken. Boo also said that the pigs had supposedly called an ambulance, but they were not trying to comfort him as he lay on the ground.

By this time there were 8 pigs in the area and all of these degenerate low-lifed scum were directing traffic! A Black man was lying on the ground in excruciating pain, and the pigs who are thoroughly trained in first aid were directing traffic. I walked over to the closest pig, and demanded that the brother receive some kind of medical attention. The pig oinked that he had called an ambulance. I told the pig that the brother had been on the ground for a long time and asked him where was the ambulance? The pig, truly showing his depraved mind, oinked "Do I look like an ambulance driver?" The ambulance the pigs had called finally arrived at 4:35 p.m. The brother had lain on the ground for 36 minutes.

The people by this time were uptight about the brother not being cared for properly, but the pigs, because they are pigs, didn't care about the attitude of the people. When the attendants who were from Boston City Hospital (a city run butcher shop) picked the brother up to put him on the stretcher, the brother's leg, which had been bleeding very little, spurted forth blood. Boo screamed out at the pigs, "my leg, my leg, you're hurting my leg!" But this did not stop the sadists from handling the brother brutally, because in their opinion it was just another nigger.

Total lack of and improper medical attention is another form of genocide perpetrated on Black people. The medical rights and demands of Black people and all poor and oppressed people must be included in the new Constitution. The Revolutionary People's Constitutional Convention on November 27-29 in Washington, D.C. is going to give us the document needed to stop the genocide of Black people. The armed struggle will put that document into practice.

A VARICIOUS BUSINESS MEN REFUSE TO FEED HUNGRY CHILDREN

Point No. 3 of the Black Panther Party's 10 Point Platform and Program states "We want an end to the robbery by the capitalists of our Black communities." This is necessary because the pig capitalist drain our communities of money and then neglect the welfare of the people in the community.

In Winston-Salem several racist businessmen and some nigger lackeys refuse to support the Free Breakfast Program. These pigs give lots of jive reasons such as "we should look to the lord for things we need" and "really we ain't making no money." Some even meet the people servants with open contempt, saying that they will never support the Black Panther Party because the Panthers are trying to overthrow the government and the system that they love. These statements should educate the people to the fact that these pigs never will think anything of them.

These avaricious pigs of Winston-Salem ignore the fact that the parents of the kids that we feed are the ones who purchase from these stores. That's right they exploit the parents and then refuse to put a little of the money they stole back in the community to feed hungry children.

When the businesses in the community fail to reach the needs of the people in the community then they stole back into the community these businesses should be put into the hands of the people., So either these pigs will stop exploiting the people or else the people will take what is rightfully theirs. We expose North Winston Hardware, Hutshins and Woods Appliances, Little Rose Supermarket, Krogers Supermarkets, A and P Supermarkets, and H.B. Jones Grill to the people of Winston-Salem because they have repeatedly neglected the needs of the people and the people must deal with them by any means necessary.

THE QUESTION OF FREEDOM RELIES SOLEY ON THE ARMED READINESS AND THE MORAL WILLINGNESS OF THE PEOPLE TO USE THOSE ARMS IN DEFENSE OF SELF-DEFENSE

The late, the beloved Malcom X, once said that we (Black people) gave our blood in the civil war for the White man, and we gave our blood in Korea and we gave and are giving our blood in Vietnam for the White industrial-military monsters today.

Well if we have to bleed for freedom then let it not be for the freedom of the rich capitalist to grow and expand. Let it not be for the freedom for those industrialist to further exploit and oppress us or for pigs to kill us. Let our blood run red for our own children. If we must fight a war, let it be a just war a revolutionary war that will eventually put the war mongers in the ash can of history where they belong.

In all facets of life wherever Black people are, there must be revolution. Where there is revolution there is blood shed and sacrifice. Without bloodshed and sacrifices there will be no revolution, without revolution, there will be no freedom for Black people. The downright poor and oppressed people in this country have traditionally been used as pawns by the greedy, heartless monsters who have kept us poor, confused, and virtually defenseless, especially the Black community, which constitutes most of the oppressed in this foul land. Well, it's time to break with tradition. Those who live in the streets take to the streets, liberate your streets and form the power base there.

Those who work in the factories stop trying so hard to slide past your duty by your subjective analysis of the Lumpen. Take to your battleground, the factories. I'm sure you can see the economic situation that the American empire is in. People learn through examples start destroying the means of production. Start sabotaging new Projects, Start with the monsters, General motors, Kaiser, Chrysler, Del Monte, Clothing factories, Colgate, Palmolive, Skippy Peanut Butter, Coca Cola, etc. Let us deal together in the destruction of the economic monsters of this country, these monsters who are killing us in the streets. Stop the heart of America, it's factories.

Those in the schools have to disrupt all study activities close down entire universities and colleges. The enemy cannot deal with the work and study time lost. Work and study interruptions, although they are of brief duration will cause severe damage to the enemy.

The basic fact is that the enemy suffers losses, with material and moral damage, and is weakened by the action. Let us turn our basements into workshops: community organizations of self defense groups, community alarm systems and socialistic programs in our communities across the country.

The time is nearing swifly when the rude fascist awakening will be at hand. Those who are at that time unprepared, untrained or unorganized will be the sad victims of fascism.

We will have to find within ourselves "The courage to kill." We must characterize ourselves as urban guerrillas that is by our bravery and decisive nature. We must be good tacticians and straighter shooters.

REVOLUTION IN OUR LIFETIME

We must come to realize that we as Black people have been dancing and drinking away our frustrations for 400 years failing to realize that our very existence is at stake. For 400 years we have been shackled and kept in bondage. Today we are victims of 20th century slavery. We have brothers ripped off the block and sent to prison to serve long terms for the crime of having never understood how to take what they needed. Black children are dying from starvation, diseases and numerous other inexcusable ills. Black mothers are dying from scrubbing too many floors and Black fathers are dying from simply trying to make ends meet. America is quite obviously preparing for the mass elimination of all Black people. We are faced with a situation however, in which we can move one or two ways-acceptance or resistance. Will we accept this process of elimination with open arms? (or) Are we going to resist this move and deal with the question of survival? Should we accept, we will go to the gas chambers, ovens, and concentration camps voluntarily. Resistance for survival is only necessary when you have nothing to lose but a life, and freedom to gain. We are the footstools of this decadent corrupt system.

Now is the time for us to rise up against the injustices and humiliations we continue to suffer as a race of people. Will we continue to dance away our frustrations or are we going to inflict political consequences against those who exploit, humiliate, oppress, and murder us? Time is running out. The time to deal is right now. So let us implement the political consequences and move immediately on this oppression that manifests itself in so many forms of evil.

GUINEA PIG TYPE EXPERIMENTATION ON THE INMATES OF THE ILLINOIS STATE PEN

The Illinois State Penitentiary, another fascist concentration camp, in cahoots with Children's Memorial (Butcher Shop) Hospital of Chicago, is currently conducting experiments on its inmates for "Hepatitis Research". Hepatitis is a deadly disease of world wide distribution caused by a virus and characterized mainly by subacute (somewhat acute) inflamation and enlargement of the liver, and other symptoms including fever, distress of the stomach and intestines, headache, anorexia (loss of appetite), and jaundice. This program of experimentation has been going on for approximately 12 years, and out of the 150 participants, 17 had contracted the disease, and it is yet unknown how many more have contracted it.

The Joliet Division of the Illinois State Penitentiary is working hand in hand with Children's Memorial Hospital to fabricate experiments by using the inmates as guinea-pigs to further their research for the "betterment of humanity". Officials of both institutions have agreed to call the submission-under-pressure of the inmates "an expression of their altruistic (unselfish) idea of really doing something for society." Was the submission of the Jews' to the Nazi's "Pain Threshold Research Program" what you call really doing something for society? The sadistic nature of the pig has brought itself to bear heavily upon the people. What right has a pig to decide that a human being, who has been jailed unjustly by a fascist society should be reduced to the level of a beast to be experimented on at the discretion of the pig? The "experimental sterilization" of the male population of India (which brought transistor radios and a piece of food to all those who participated) the destruction of a complete tribe of Indians (totaling 3,000) in the interior of the jungles of Brazil and various other medical "experiments" that have taken the fascist physicians of the U.S. on a world-wide escapade of murder, bears proof of the intentions of this government to eliminate non whites.

The Black Panther Party calls for the relatives and friends of the inmates of Joliet State Penitentiary to demand an end to these wild and reckless experiments on their loved ones. Experiments such as these are being conducted all across the country, with malice aforethought as blatant and overt as the commitment of genocide. The Black Panther Party says that the power of the people's resistance is far greater than the man's fascist use of "medical technology".

LEFCOURT: EVERY PANTHER IS GUILTY OF CONSPIRING TO BE FREE

Madison (CPS) -- recently, University of Wisconsin Daily Cardinal Associate Editor Peter Greenberg interviewed Black Panther defense lawyer Gerald Lefcourt in his New York law offices. Lefcourt is one of five lawyers presently defending 21 Black Panthers in a trial stemming from a 30 count indictment of the Panthers, ranging from conspiracy to bomb to attempted murder. Lefcourt began his legal career as a legal aid society lawyer, where he first became acquainted with the Panthers. Originally he was a member of a three man defense team which included William Kuntsler and Len Weinglass in the trial of the Chicago 8, but left the team in April 1969 when the "New York 21" were indicted and arrested. He has worked on the case ever since. The following is the transcript of that interview.

College Press Service:

When did you first get involved with the Panthers?

Lefcourt: My first involvement with the Panthers was back in August, 1968. I remember it was in August that I received a phone call that some Panthers had been arrested. At that time they were unknown in New York. We had some news of the California organization but in "68" the Panthers were new here. I went down to the court and I was told by a family in the courthouse that the three had been arrested for assaulting police officers. That first case in New York involved an allegation from police which claimed that three Panthers attacked 5 armed to the teeth cops on a Brooklyn street at 2 o'clock in the morning. What is even more absurd, when I got to see them they were bandaged, heads cracked, arms in slings and things like that and the police officers who they had allegedly assaulted were standing in the courtroom with grins on their faces, untouched. And when the case came before the judge for arraignment and bail setting, the first bail set on any case in New York City involving the Black Panther Party was $50,000 each. That started a whole series of outrageous ransom bails, harassment arrests, framed charges and a situation which led directly to the arrest of the Panther 21 on April 2, 1969 about 8 or 9 months after the party was formed there.

CPS: You defended the original three Black Panthers that got arrested for assault. Did they get off?

Lefcourt: Yes. It was a total fabrication. The idea of unarmed Panthers attacking armed police in the dead of the night in Brooklyn. It was just to absurd to be believed. But the others didn't get off. We've had literally hundreds of Panther arrests in New York. And there's a reason for that, I think. New York has historically been the front lines for the Black liberation struggle in the United States. What happens in New York usually generates throughout the nation. The Harlem riots of 1964 spread at a fantastic rate. Every Black organization that has ever come on the set has been stopped in New York. New York, in a ten mile square radius having millions and millions of Black people and also in the middle of the eastern establishment, is the danger point for the powers that be. And therefore, every attempt is made to stifle, harass, repress Black groups as they form here in New York. Malcolm X was indeed shot to death here in New York. It can even be traced as far back as Marcus Garvey. When he was stopped in New York. The Panther Party is no different. An indication of that is the New York secret service police, which are the most sophisticated in the United States and more feared or should be more feared than the FBI. There are indications that this secret service known as police BOSS (Bureau of Special Services), the hero of secret services, has infiltrated the Black Panther Party before they ever arrived here in New York and in fact helped start the party here. That is because they want to control them. They want to make sure that they can make those harassment arrests that are so necessary for the stifling of political activity.

CPS: When you talk about the bail, the original Panther bail in 1968 was set at $50,000 escalating to $100,000 for the Panther 21. We could assume for the record that these types of arrests will continue. What can you do about the bail?

Lefcourt: Well, I don't think that lawyers can do anything about it. We have taken the bail situation to the supreme court. The supreme court has avoided it. Specifically, in the Panther 21 case we went through 43 judges trying to get bail reduced, all unsuccessfully. You can only conclude that there is a general conspiracy in the courts to make sure that Black Panther leaders are not free.

CPS: In the case of the 21 there has been a lot of confusion in the press. What exactly have they been charged with?

Lefcourt: It is a 30 count indictment. It is the most comprehensive indictment ever returned against a political organization in this country. It does not charge one act such as Huey Newton shooting a policeman or Bobby Seale ordering a murder in Connecticut. It charges 30 acts, some of which sounded like conspiracy which means conspiracy to bomb public buildings such as Macy's, Gimbels, and various police precincts throughout the city, subways and railways. Including the riduculous charge of conspiracy to blow up the Bronx Botanical Gardens. Maybe the Panthers wanted to see Black flower power. I don't know. The Indictment also charges, besides the conspiracy to do all these things, the actual bombings of police precincts back in January of 1969. Therefore, the charges are arson, attempted murder, conspiracy to murder, conspiracy to bomb, and possession of a huge amount of weapons.

CPS: Quite bluntly, do you think they're guilty?

Lefcourt: Well, no. But I should say that I don't think Black people struggling for their freedom in this country can be guilty of anything. I sort of subscribe to what Tom Hayden was saying back in the May Day demonstrations in New Haven: that guilt or innocence is not really important anymore; what is more important is the goals the party stands for, the party programs and the relationship of the party to White people; a movement to change their views on imperialism and capitalism it seems to me to be more important. The Panthers in views on Imperialism and capitalism it seems to me to be more important. The Panthers in New York get involved in what they call revolutionary self-defense. When you're fearing imminent destruction by the police, attacks through frame-up prosecutions and physical assaults from officers, you prepare and if you don't prepare then you're committing suicide. It is easy to turn that preparation into an indictment against almost anything. I assume that every Panther in this country is guilty of conspiracy in one sense and that sense if that they are conspiring to be free.

CPS: What is your definition of subversive?

Lefcourt: Before I answer that I think I should point out that the Panthers have been J. Edgar Hoover's number one public enemy for three years running. I think that is an important fact, because we have a government which is putting forth a mass propaganda campaign regarding the Black Panther Party. Whether it be the Attorney General's list or J. Edgar Hoover's saying that they are public enemy No. I or Spiro Agnew's saying that they are a criminal band of anarchists. What it really amounts to is government fear. Fear of possible effectiveness in the Black nation and in this country, that's what it's all about.

They stand for no more oppression, no more imperialism, no more capitalist exploitation, and in that sense they are completely subversive. I can't talk in terms of definitions in the sense that the attorney general does. His definition of subversive is anyone who wants to change the existing condition of the United States, which I guess should be termed pre-revolutionary conditions. I assume he is right.

CPS: Have you had any trouble in the subpoening of newsmen to reveal their sources?

Lefcourt: I've been in contact with lots of newsmen who have either been the subject of subpoenas or threatened with them. I don't think we can talk in terms of what the government violates really nonsense. They're going to do what they have to do to meet the challenge of this movement. People too naively talk about the government not complying with the law. It's really silly. Because the government makes the law. The attorney general makes the guidelines and he can change them or do what he want with them. I mean, there is an executive policy in this country; executive stemming from the President of the United States. Repression and stopping this movement. This policy, instead of being checked by the legislative branch, the congress instead of that check operating, the congress has joined in that policy of repression and appropriated the necessary funds to supply the FBI and other secret police organizations with the weaponry needed to stop movements for change. The courts, instead of operating as a check on the executive and legislative branches join right in constitutional statues, unconstitutional such as the Chicago 7 riot act, they join right in and allow it to go on. When we talk about law we're talking about law in a situation which involves these conflicts. A challenge is being proposed to an existing order. An order which will turn fascist to protect its rulers. It's really not helpful to discuss whether or not they've violated their specific statues or guidelines.

CPS: Do you think the government is interested in justice or in simply creating and perpetuating an image about the Panthers?

Lefcourt: It is interested in maintaining its power. It is interested in maintaining domestic tranquility whether it be through force or jailing its revolutionaries or what have you. That is the government's interest. It is not at all interested in any form of justice here at home, in VietNam, or Asia or South America. We are involved in a world revolution. Peoples' liberation movements are starting in all continents of this earth. Blacks in Africa, Browns in South America, and Yellows in Asia, the United States is in the midst of that revolution. Its purpose is to hold it off to prevent the writing on the wall from becoming a reality. The United States domestic scene has linked up with that world revolution. The Black and White revolutionaries in this country have joined this revolution. I think that is what really should be discussed. Not the naive questions about justice, about what the government wants to do. They'll do anything that's necessary to maintain control.

CPS: In your opinion, how much control do they have? What is the breaking point as far as what you can see?

Lefcourt: I see in the next two or five years in this country increasing conflict. We all talk about repression but I think we ought to redefine that a little bit. The government if acting not to oppress in a sense of let's get them we don't like them. They're acting out of fear. Fear of a growing mass movement in this country and fear of an ever more powerful physical attack upon the government power structure. Repression is in response to a conflict that has been generated by the great problems of this society. The problems that they have no desire to deal with, war, racism, poverty, those are the things that have brought about mass movements and those are the things the government's really reacting to when we call it repression. What it really is fear of change. I think in the next two to five years this process of movement, repression, courts, jailings, bombings, murders, will continue. It's going to escalate. It's going to grow. We'te in pre-revolutionary times. We're at the beginning stages of a real mass conflict in this country. People should be deciding on whose side they're on. People should be realizing that sometime they are going to have to make this decision. White liberals will run as they always do. They'll join the ruling class and try to maintain the status quo. The radicals on the other hand will be fighting. They'll be fighting on the side of oppressed people in this country and throughout the world. And we cannot escape decision time. We can put it off for a while but sooner or later we're going to have to face up to it.

CPS: You are defending a group that is clearly against the system. Yet your defense takes place within the very system they're against. What are your feelings about this?

Lefcourt: You know people often say that and they should understand what that means. Fidel Castro's trial when he and several other people made an attack on the government military installations in Cuba was of course a trial within the system. We don't have a choice at this point in time. We cannot try the Panther 21 in any other place except in their courts. We do not have our own courts. We must use their courts to the best of our abilities to defend and to plead those issues that have created the trial. It's nonsense to say that one is working within the system or without the system. What people are doing is working for change or not working for change. They've made a decision. What methods we use doesn't seem to be really important to me. If we want to write books and make movies to rip off money from the capitalist system to be used to aid and advance our cause, that's one way to do it and there's nothing wrong with that. If we have to go into the American courts where we don't expect justice and say that that's another way to do it.

If we can operate without the courts and without the system, that's fine. Anything, any activity that is designed to educate and create support for our movement must be done. The idea of whether we should use the courts or not is really nonsense. What do you do when 21 people are in jail who are valuable leaders who have $100,000 balls on their heads, who have been in jail for a year and a half and have to come to trial. Do you abandon them? I don't think anybody would answer that question in the affirmative. We have to fight anywhere and everywhere. Within or without the system. It doesn't matter.

CPS: Two jurors of the Chicago 8 trial in a recent interview said that (Judge) Hoffman refused to declare a hung jury and sent them back. As far as the results of that trial and the curious circumstances surrounding it what do you think? Will that decision be reversed?

Lefcourt: Sure it will be reversed. It was the most successful trial we've had in our recent history. Thirty percent of the population believe that the government was out to get them and got a raw deal. It's an important occurrence. People cannot just have a closed eye view of the courts and say the hell with them. We did a lot in that trial. We got a lot of support in trial. We proved a lot of points in that trial. And we're going to win it to boot. That to me is a successful trial. All those people that were on trial are out with the exception of Bobby Seale who is in jail on another charge. We're going to win on appeal. That's victory and we should be proud of it. We all were, from Madison to Santa Barbara to Boston. We all did what we had to do. And that was a success. It was more successful than going to the Democratic convention originally.

CPS: With the 21, as in the Chicago trial, have you tried to change judges?

Lefcourt: We've tried almost everything to have the judge removed. As we've said in court, he's sitting at the prosecution table. When he talks, he talks for himself and the prosecution. He's biased.

CPS: How was he selected to be the judge?

Lefcourt: A very unusual procedure. He was hand picked by the district attorney that is prosecuting the 21. The district attorney admitted this. It was done ex-prate which means without the defendants or their lawyers knowing it. The whole procedure was done in my view to select the judge which would be the most sympathetic to his case. That procedure was unconstitutional. That's why we want to get rid of him. Because the district attorney has said that it is the most important trial in his office in New York City. Under those circumstances he has the

power to select the judge. He said that he thought a long time about who the judge would be.

CPS: You're talking about D.A. Frank Hogan

Lefcourt: Yes, Frank Hogan, the district attorney in New York County.

CPS: You've already started out with a stacked deck against you. So you're going to start again with the same judge?

Lefcourt: We don't have a choice. We've tried everything we can to disqualify the judge. We sued him independently. The Supreme Court of the United States had a petition filed just a few days ago asking them to stop the trial and disqualify the judge. Whether they do it or not, I don't know. But in the meantime we're on trial and we have to go forward.

CPS: What cooperation did you get, if any, in preparing your defense fence from the prosecutor?

Lefcourt: None. The defendants have been deprived of every right to find out what the trial is about. They have made countless motions numbering well over twenty. All have been denied. It's been four months of pretrial hearings. There's been wire-tapping which was based on information from an informer who's a lunatic, who has spent the last four months in mental institutions. That information was used to get wire-tap orders to listen to the phones and bug apartments of the Panthers. All illegal and all inviolation of the United States constitution. There have been searches of Panther's apartments without search warrants. Those searches are illegal and in violation of the 4th, amendment. There have been confessions beaten out of the defendants. When I say confessions I don't mean confessions to acts, I mean admissions that they were somewhere where they were charged to be or or things like that, all of these are in violation of the constitution of the United States. The defendants have tried everything. They have made every conceivable motion. They have an absolute record on appeals for reversal. If they're convicted the case should be reversed. It's a pattern now. It's a patter in all there political trials, it's a pattern to get them to the lower courts get them at the trial level. Whether the case is reversed or not, they don't even care about it.

CPS: Is that it? I mean is it just that they don't care?

Lefcourt: No, they don't care What they really care about is a long trial and the publicity stemming from it resulting in a conviction. When the trial is reversed, it's one day's news and they know that. The trial itself could be months of nes. So with Spock, the Buffalo 9, the Chicago case, Huey Newton's case, all of them. The same kind of results. Conviction, reversal.

CPS: You spoke about informers what role did the informer play in this case?

Lefcourt: He's not going to play a role in the case anymore. He was just used in the wire taps. He gave them information which is totally false. The information was false and the police know that and they have admitted that on the stand They knew it from the beginning. He said for instance, that the Black Panthers were being hired to murder Alber Shanker, who is the head of the teachers union who has had so much trouble with the Black community here is New York. But the police used this to get a wire tap order which would help in the indictments. He is not going to be used again. He was totally destroyed in court. But there will be a big bag full of agents, not informers. Informers are a different kind of person than agents. Informers usually operate on such motives as money. Agents of police departments or the CIA or Internal revenue system are much more dedicated. They have worked undercover for years to gain credibility. They are used at a trial to wipe out certain people. We are going to have the biggest disclosure of agents in any case heretofore tries in New York. We expect more than half a dozen.

CPS: How many of the original Black Panther 21 have been let out of jail on bail?

Lefcourt: Out of the original 21, three were never caught. I understand they are in Algeria. Thirteen are going to be coming to trial in the 21 case now. Another 3 have cause of age (to young to be tried with adults). Another one was severed because of illness, the defendant Barry who is an epileptic and was placed in the tombs, New York's famous hell hole on $100,000 bail and had 14 epileptic seizures. When we brought habeous corpus procedures to get him out of jail we were delayed four months by the districts attorney and when he was finally transferred to a hospital (stil being under $100,000 bail) he was so sick that he was in critical condition for three months. He lost 65 pounds and almost died. There will be two different trials eventually. One will be adults who are not beig tried because they have severed because of illness or other reasons and the other trial will be for the youths.

CPS: All 13 at once?

Lefcourt: Yes all at once. That's pretty tough sight in courtroom because it's pretty wierd. It's croweded in the courtroom. There's not much room to move around especially with fifty armed guards in the courtroom. The court building itself is an armed camp with hundreds of police stationed in buses behind the building for possible use; closed circuit TV filming of the building and police officers scattered in strategic location. Adjoining the courtroom there's a small detachment of special tactical patrol force police that remain there in case anything happens within the courtroom.

CPS: How many have been let out on bail?

Lefcourt: Out of the 13 that are coming to trial, four have posted the hundred thousand dollar bail. That money was raised through the efforts of the Panther defense committee, which is by the way located at II West 16th Street in New York City. They have been raising the money for the bail and the Panther defense cases generally. It's called the Committee to Defend the Panthers. The four that were let out on bail represent the quality of the 21 as a whole. The others are still in jail. Unless the money is raised they'll stay there.

CPS: As a lawyer and a movement person, what is next?

Lefcourt: What we have to understand with violence is I don't think violence is blowing up a mathematic building. That's really no violence. Violence would be defined by us as a system which allows children to wake up hungry in three quarters of the earth, a system whcih allows 30 or 40 million Black people in this country to remain in a slave status after 400 years of turmoil. A system that exploits workers, a system which operates solely on profits and thereby eliminates art, education, fun from their definition of what work is. If there is no profit in anything it won't be done. That system is a violent system and that is really the definition of violence: A system that doesn't allow for change, that oppressed and represses its people's a system which defines individual freedom by how much money you have. A system which defines justice by how much money you have. That is violence, and any attempt to change that system shoudl not considered violence. I think people should understand that there is going to be turmoil in this country, that there is going to be activity in which people can get hurt but over all they should keep in mind that the reasons for movement, the needs of the movement and the need for change are primary. We must neutralize as much as we can, our parents and the liberals, had we must join as many forces as we can with us to try to combat the existing conditions.

CPS: What do you think is going to happen at the trial?

Lefcourt: I think it's going to be a long, fascinating, exciting trial. It will involve different kinds of events, different kinds of people on trial, every sophisticated government attack, one in which everybody will learn from. I'm not a cynic. Whether or not we won, the case in the Supreme Court was a victory. Should we have won the Panthers would have been free.
