Fred Hampton MURDERED: By Fascist Pigs Dec. 4, 1969

Deputy Chairman Fred Hampton of the Illinois Chapter has joined the ranks of martyrs, revolutionary heroes; Lumumba, Malcolm X, Little Bobby Hutton, Bunchy Carter, John Huggins, Che, Toure, Jake Winters and the countless other revolutionaries who have given the most precious gift that they could give in the name of the people.

These brothers and sisters gave their lives in order that you and yours may one day enjoy true freedom and the best that technology can provide. Eldridge Cleaver, Minister of Information, has stated that "it is time to intensify the struggle", and that now is the time for "mad men". Deputy Chairman Fred Hampton was just such a "mad man". Reactionaries wondered why Deputy Chairman Fred waged such a resolute struggle seemingly against the greatest of "odds." Reactionary cultural nationalists had forgotten Malcolm's words. Malcolm thundered that we are a generation that don't give a f -- k about the "odds."

Deputy Chairman Fred saw through the bulls -- t. He saw the corruption, poverty and bankruptcy of capitalism in Amerikkka. He saw and experienced the hunger, the pain, the agony and the death that is part and parcel of the Amerikkkan way of life. Deputy Chairman Fred checked out history and learned the very nature of this decadent fascist society, which was conceived in the genocide of the Red man. Deputy Chairman Fred dug that vulturistic capitalists were growing fat off the flesh and blood of the toiling masses of the world. So the Deputy Chairman dedicated his life to destroying the number one enemy of mankind.

The Amerikkkan government supports and carries out the death dealing policy of the vulturistic, greedy capitalists. This government was created to serve and protect the interests of slave holders and growing Yankee capitalist bandits who made their family fortunes by robbing workers of the fruits of their labor, food, clothing, decent housing, medical treatment, the right to self-determination etc. Capitalists are denying the people their right to exist through various devious means. Exorbitant prices for commodities necessary in life. And under the cover of "law and order", which give their fascist pigs plan open season on those who would change this society. This evil fascist government deprives the people of their lives and is even attempting to murder our unborn (they call it birth control) while the vile vulturistic capitalists makes huge fortunes off this policy of "an ounce of prevention is worth a pound of cure". Deputy Chairman Fred understood the nature of our class enemy and knew what must be done.

From the correct teaching of Huey P. Newton and the Central Committee, Deputy Chairman Fred moved to establish revolutionary political power for the people by any means necessary. Deputy Chairman Fred dealt with the enemy. Under the guidance of our fearless Deputy Chairman, the Illinois Chapter expanded and grew.

Socialist programs, people's programs were implemented by the Illinois Chapter and the people. The leadership of Deputy Chairman Fred has won the support and love of all the oppressed people for our Party. We loved and respected Deputy Chairman Fred as did the people whom he served so selflessly.

A WORD FOR PANTHER PARENTS

(Mrs. Jewell Barker delivered this speech at the memorial rally held December 6, 1969, 201 So. Ashland in honor of Fred Hampton and Mark Clark. She is the mother of Panther Ann Campbell.)

I have but one thing that I would like to ask of the Black mothers and fathers in this country and all over the world. You have given much to your sons and daughters. You have overcome insurmountable forces of evil against you. You have paid the supreme price. You have given to the world the best. Stand behind it. Do not be ashamed. I have but one child. I gave her to the cause. She works for you, because she knows where Vietnam really is. She said to me one day. she said "Mother, they are not oppressing us in Vietnam, they are not killing the soul brothers in Vietnam, they are not shooting through doors and killing Black women in Vietnam, they're doing it herel Yes, mothers and fathers, I would like to say to you that you have listened to the television, the radio, and you have read the newspapers, but you have not walked out of your doors to the Breakfast Centers to see what your children are trying to do. Don't listen -- walk and find out for yourselves. And when you see the tremendous forces that are working against the beautiful work your children are trying to do. I think you will be very glad to stand up and be counted. Remember this: prayer is good. If Fred could be murdered while he slept, remember what can happen to you while you're on your knees.

I pledge allegiance to my parents and I hope that you will understand the necessity of standing behind your beautiful sons and daughters who are working so fervently, working for the salvation of all mankind. Don't let anybody tell you that you have failed. Don't sneak in corners and hide when your children cry "All Power to the People." Don't sneak in corners and hide when they ask you to help build a Medical Center that will accommodate all poor people. Support them in their struggle.

Father Clemens said yesterday that he was ashamed of his generation. You have no need to be ashamed. Be our judges. Be our jurors. You are our peers. Make it real for our children. And this is the only way. The only way is through the struggle of our children and generations to come. Not through the birth control pill: no, not through hungry children, not through fine minks an big Cadillacs, and not through money. And if you love Fred Hampton, he wouldn't appreciate your being here saying all these beautiful words, but you will fight for Fred, you will hold up Fred's banner.

SEIZE THE TIME -- SUBMIT OR FIGHT

The arrest of Chief of Staff, David Hilliard, was like a political prophesy come true. In an article in August 1969, David Hilliard made a statement that should be quoted here The statement was "their intentions are to imprison, to murder and silence the voice of the Party that speaks in the idiom of the suffering and exploited masses". His reference was to the U.S. government. That was August of 69 -- a few months before the Chief of Staff was arrested on trumped up charges of threatening to kill the President.

There's no need of going into whether one is a Republican or a Democrat, or whether one is pro-Nixon or anti-Nixon. The essence of the charge is the absurdity of it. The absurdity that a man would threaten the President before a crowd of three hundred thousand people at a speech given at San Francisco's Vietnam Moritorium that would be televised and broadcasted around the world by radio and television. The Federal Government is seeing fit to define a portion of the statement, taken out of context as "clear and present danger to the security and well being of the President of the U.S." Well, the clear and present danger to the well being of all the pigs of the power structure, of which Nixon is the chief pig, is the danger inherent in a system that is overtly racist and a system of government that has institutionalized racism for centuries. A system of government that has perpetrated genocide against people all over the world. The clear and present danger, not only to head pig Nixon, but to all the people of the world is in fact this power structure which this man (Nixon) is so-called, "responsible" head of.

The government of the U.S. is a perpetrator of the most heinous crimes in the history of mankind. This is not to say that the people of the U.S. are the perpetrators, but those who have been silent all this time have in fact endorsed the conspiracy against peace and freedom-loving peoples of the whole world. This silence is not part of the vernacular and the terminology or the rhetoric of the rebellious, because the rhetoric and the terminology of the rebellious is a language of revolution. It's the vernacular that believes actively that the oppressor has no rights which the oppressed are bound to respect. The terminology of the oppressed people is the vernacular, of rebellion and revolution. And that terminology in the U.S. today takes the form of the terminology of Black people in America who have been victims of American Democracy for over 400 years. The language of the oppressed is not theirs by design -- definitely not a design over which they have any control. It is the language given to them by the historical conditions. It is the lone alternative between the reality of their situation, and genocide. It is the question of submit or fight and it doesn't hinge on any verbal Marquis of Queensbury Rules as to what we should say about the oppressor or how we should say it. So that, if we want to call him a motherfucker, then he's a motherfucker. If we want to call him a son-of-a-bitch, pig, swine, a Nazi bastard, then he's all of those and a hundred more as Chairman Bobby would say.

There are those in the Mother Country who seem not to understand this, who seem to think that the language of the oppressed should be defined by those who have either actively oppressed or who have endorsed this oppression by their silence. There are those who say rightly "we agree with the Black Panther Party, that Richard Nixon is an evil man, but there's a proper way and an improper way to talk about an evil man." If we listen to these people long enough they would probably have a proper way and an improper way for our Party members and our people to be shot down in the street -- to be lynched in a gentlemanly manner -- to be beaten into comas -- to be beaten to death in a way that would satisfy the gentlemanly morals of our sadistic oppressors and meet the standards of liberal morality espoused by those who have endorsed essentially those genocides by their silence. This includes the many anglo-negroes or White minds with Black skins. To suffer in blessed silence to turn the other bloody cheek is not the way chosen by a people who choose survival to genocide.

If anyone is in doubt about the fervor for freedom and the zeal for revolution among Black people, they can look at the practical statements, the statements that Black people have made in the streets and in the ghettos all across Babylon in the last five years. The most eloquent statements of political positions, to this date, by Black people have been the Harlem rebellion, the five nights and five days of the Watts Rebellion in August of 1965, and the Detroit Rebellion which did 200 million dollars worth of damage to property which was never really ours. These are the practical statements of Black people manifested in action.

The articulations of these feelings have always been costly. These articulations have been made by men who decided to stand up and by doing so, pay the price. Malcolm X, when he said "by any means necessary" was articulating the genuine feelings of Black people. This is the essence of why he was assassinated. When Huey P. Newton, Minister of Defense and founder of the Black Panther Party, said that "an unarmed people are slaves or subject to slavery at any given moment" and then began to put into practice ways and means for solving this very real modern-day slavery, he was imprisoned on trumped up charges after the pigs failed in their attempts to give him the same treatment that was meted out to Malcolm X. Fred Hampton, Deputy Chairman of the Illinois Chapter of the Black Panther Party, who was recently assassinated, was able to articulate the feelings of Black people. He liked to say, "I am a revolutionary", and he proved it and he put it into practice. His articulation of Black people's feelings always made Fred say, "You can kill a revolutionary but you can't kill a revolution". For his speech and his practice on behalf of Black people, he was assassinated. Eldridge Cleaver, Minister of Information of the Black Panther Party, articulated the feelings of Black people all across Babylon when he said, "You're either part of the problem or part of the solution". The attempt to kill him was a failure and resulted in exile, a painful forced separation from the people that he loves and fights for, Bobby Seale, Chairman of the Black Panther Party and co-founder along with Huey P. Newton, formulated the most articulate statement of verbal position that Black people in racist America have put forward. This is the program and platform of the Black Panther Party. The platform and program in essence dealt with the need for, and manner and means to gain "land, bread, housing, education, clothing, justice and peace." In the case of our Chairman Bobby Seale, point number nine of our Ten Point Platform and Program was particularly ironic. Point number nine says, "We want all Black people when brought to trial to be tried in a court by a jury of their peer group or people from their Black communities as defined by the Constitution of the U.S." This is based on the belief of the Black Panther Party as articulated by Huey and Bobby and the belief of the majority of Black people that the courts should follow the Constitution of the U.S. so that Black people will receive fair trials.

The Fourteenth Amendment of the Constitution of the U.S., gives a man a right to be tried by his peer group. A peer is a person from a similar economic, social, religious, geographical, environmental, historical and racial background. To do this the court would be forced to select a jury from the Black community in which the Black defendant came. We have been and are being tried by all White juries who have no understanding of the average reasoning of the Black community. Bobby Seale's only legal slack from the Federal Government, so far, has been that they have applied a part of the so-called "Civil Rights Bill" to him. Although those parts of the Civil Rights Bill that deal with school de-segregation were scrapped, a part has been applied in the case of our Chairman Bobby Seale. That is the anti-riot clause that deals with crossing state lines to incite a riot. Its been applied to try Chairman Bobby and seven Mother Country radicals (who are known as the Conspiracy Eight) on trumped up charges of conspiracy to commit and incite a riot when in fact the only rioting was done by the Chicago pigs. In the process of the court trials, Bobby Seale's constitutional right of free speech, (the First Amendment) was violated. The Fourth Amendment of the Constitution was violated, a constitutional right that requires Federal Officers to have a warrant to arrest a person. The Sixth Amendment to the Constitution was violated, his right to legal defense, to counsel of his choice. The Fourteenth Amendment was violated, his right to due process of law -- to guarantee him the rights of the Constitution. The basic constitutional tenant that deals with Black people has been violated, and that's the Thirteenth Amendment that "allegedly" abolished slavery. For his part in articulating the basic needs and desires of Black people, Bobby Seale, like Malcolm, like Huey, like Fred Hampton has been railroaded, framed on conspiracy to incite a riot and on a trumped up murder charge. For demanding his constitutional rights our Chairman Bobby Seale has been sentenced to four years for contempt of court.

Centuries of slave rebellions, centuries of repression have failed to still the cries and pleas of Black people for freedom, for justice and for peace. The catalogue of mounting horrors since the death of Malcolm X has failed to silence the voices of the people's cry for justice. So it's evident that David Hilliard, Chief of Staff of the Black Panther Party, was voicing the true sentiments of all Black people who truly desire freedom when he stated eloquently, "Fuck that motherfucking man, we will kill Nixon, we will kill any motherfucker that stands in the way of our freedom." The trumped up charge of threatening the life of the President, that is leveled against our Chief of Staff David Hilliard, now will have the effect of intensifying the cries for freedom and justice for the Black community, as the attempt to silence Malcolm brought forth his echoes in Huey Newton, Fred Hampton, Eldridge Cleaver, Bobby Seale and David Hilliard.

Dear Brothers:

We have heard with great condemnation the news that the agents of the American White House, have butchered brothers Fred Hampton and Mark Clark.

This outrageous crime has robbed the anti-imperialist camp of some of its valliant fighters for peace, progress and human dignity. It is an irreplaceable loss. It will be deeply felt by all who abhor degradation and oppression.

The cause which they have watered with their blood is a noble one. They have laid down their lives because they stood and fought for a world without plunder and oppression. Or a world in which man could not hunt and kill man, but a world in which man shares without hinderance with his or her dexterity to nature; and generates opulence to serve the needs of man in society. They wanted an end to slavery in all its forms. Because of their unalloyed belief and contumatious defense of these lofty ideas; they were shot and killed while they were asleep by Nixon's gestapo forces.

This is one of the most wanton, barbaric, uncivilized acts; which will wake up the dirty past of capitalist America. And designate the wrath of progressive mankind against the system which the perpetrators of this appalling crime represent and defend.

Fred Hampton and Mark Clark have demonstrated heroically that tortures, assassinations, imprisonment and exile cannot maim the will of the people determined to destroy the machine of oppression. The clique in the White House is still blind to the fact that oppression breeds resistance. And that as long as there's oppression, the father and mother of resistance lives and is active. Resistance will grow to combustive proportions. The blood of Fred Hampton and Mark Clark will certainly inflame resistance against the capitalist set-up - which breeds hate, squalor, disease, crime, war and all the ills that beset man on this planet earth. Their passing is a shining example which will go down in history, and the occurrence is worthy of emulation. The reverse would be treason.

We of the Union of the Population of Cameroon mingle our tears with yours for the sad passing of these brothers. We do so, not because they are of African extraction, but because they gave the best of their lives to a just cause. The cause of freedom and justice for all. The murderers must be punished; the murderers believe in war. We should all mourn for them with arms in our hands.

Please accept and transmit to the other leaders and members of the Black Panther Party, and the families of the two brothers our heart felt condolences.

First they wipe out the people's army, then eventually Black people completely. And I'm telling you, you're gonna have to pick up your guns to be men. Sisters, you're gonna have to pick up your guns and be sisters. Cause this struggle is a struggle involving everybody, not just the brothers. And as the sister said before, you don't need no man who ain't gonna be a man. You don't need no man who's scared to pick up a gun and deal on them pigs. And brothers, you don't need no sisters who are gonna just be there to wash the dishes, cause the pigs will come down on her. And when you find your other half that's for real, right on, go on and make those revolutionary babies. Make those revolutionary babies, cause the youth make the revolution. And we're gonna start a beat. The beat has already been started, but we're gonna keep this beat going and it's going to continue all throughout Babylon. We're going to stop talking about this relating to what's going on in Vietnam, cause that's far away. We're going to relate to this bullshit going on in Babylon, cause it involved every motherfucker out here. Every motherfucker. And those of you who are going to wait until tomorrow to get it together, I'm telling you tomorrow might not be here. Tomorrow might not be here. You'll wake up tomorrow and you'll be dead, and your man will be dead and your kids too. So now is the time to SEIZE THE TIME and off the slime.

THE BLACK PANTHER PARTY AND KSAN

So much has gone down in the past week that it is very hard for me to know where to start. Perhaps a little clarification on the genocidal war being conducted against the Black Panther Party, as well as the recent attack upon myself by the Federal Government will serve as a starting point.

As you probably know, David Hilliard, Chief of Staff of the Black Panther Party, is on trial right now for an incident in which Bobby Seale's (the Party's Chairman) door was kicked in February 1968 by local pigs; while at the same time he is awaiting trial for an indictment brought against him by the Federal Government on a charge of "threatening the life of a President." Bobby Seale, is in jail with a four year sentence facing him, while he awaits a couple of trials on some bulls -- t conspiracy charges. Many other Panthers have either been killed by the pigs or are in jail on bulls -- t charges and enormous ransoms forbidding their release -- like the New York 21. And I'm sure everybody knows about Huey and Eldridge. This is just one aspect of pig harassment against the Party; the other pig front consists of RAIDS on Panther Offices as well as the homes of various Panthers. It is clear to me and many others, including Senator Mervin Dymally from Los Angeles, that there is a nationwide planned genocidal plot against the Black Panther Party which is carried out by systematic attacks against the Party. In fact, it is the latter which caused my dismissal from Metro Media's KSAN on December 4.

I opened my show on Wednesday December 3 with a suggestion that had been phoned in by a listener. The suggestion was for people who supported David Hilliard's statement made at the November 15 Moratorium Rally and /or his right of FREE SPEECH to sendtelegrams of a like nature to Richard Nixon showing their support. For this I was fired. However, there is one thing we must keep clear: my being fired was an indirect attack against the Black Panther Party as well as part of Spiro T. Agnew's attacks against media (which is but another way of attacking free speech and radical dissent in Amerikkka). I intend to file suit against KSAN demanding back both my job and pay as of December 4. I plan to exhaust all legal means in my fight to maintain the right to bring information to the oppressed peoples of the Bay Area as well as the world. Labor leaders and union members have voiced their support of my just fight against the rising tide of FASCISM in AmeriKKKa.

I call on all people who support me and my fight to also support the Black Panther Party and their fight because they are one and the same. People all across the nation are outraged at the vicious attacks levied against the Party. This is as it should be, however, support should not stop at the oral level by a mere shouting of "Power to the People" nor by just saying "Right On" to this article. What is needed is for everyone to engage in the struggle against AmeriKKKan imperiasilm as it manifests itself in Vietnam against the "Viet Cong" (NLF) and in Babylon against the "Viet Coon" (Black Revolutionaries). We must also fight against the rising tide of fascism with every breath, muscle, and drop of blood within us. Conducting vigils outside of Panther Offices, helping to feed school children in the mornings, setting up Free Health Clinics, free forms of clothing distribution, organizing Liberation Schools and demonstrating against the government on every level are among the things that the Black Panther Party is now doing and are among the things that all people who are concerned about an end to fascist oppression and murder must now begin to do. People must also arm themselves not only with revolutionary weapons but with a revolutionary ideology such as Marxism Leninism so that we will always rule the weapon as opposed to the weapon rulling us.

By the time you read this article a lot of things will have gone down; for one, I have been subpoenaed by the, not so, Grand Jury on Wednesday, December 10. As of now, I do not know exactly why I am to appear since they refused to relay this information either to me or my attorney. No matter what happens to me in court I will continue to fight for the liberation of ALL oppressed people this means Black, Brown, Red, (Yellow and White) throughout the world who are fighting against capitalism and all its malignant growths; such as imperialsim, racism, economic exploitation, male chauvinism and decadent bourgeois culture. I will continue to fight with every weapon at my disposal in the future just as I have in the past (which is the real reason I was fired). I only hope that we ALL will become better equipped in the future to wage an even better struggle than we have in the past. I have faith in the masses of people, and I have faith in myself; this is a life and death struggle that we will probably be fighting for the rest of our lives. Let's get our s -- t together and prepare for the long fight ahead. And let us never forget that "They can jail (and Kill) revolutionaries but they can't jail (and Kill) revolution."

“WHAT IS THERE TO TALK ABOUT?”

All of our environmental surroundings, from one level to another are constantly changing, as well as the human mind and body itself. And so the same with this capitalistic society. It is constantly changing from undercover fascism to open fascism. Black people's oppression and their struggle to survive is, the explanation for the existence of the Black Panther Party. It is because of the people's oppression that the Party exists, in order to educate the masses on how to resist the power structure. To set the correct examples and bear the brunt of the ruling circles attack. For hundreds of years Black people and other oppressed people of Babylon have voiced their oppression loudly, Black people have sung, marched and cried for their liberation and still we have no liberation. After marching, singing, talking and crying we have to move our struggle to a higher level. There is an occupying armed force in the Black community to keep us oppressed and enslaved, so we'll have to use armed force to destroy oppression and obtain our liberation. This is what Bobby Seale relates to. Armed force among the people which will bring liberation of all oppressed people. And put the oppression in order through disorder.

As the specter of fascism looms over Babylon, the reactionary forces and their moves to halt the vanguard of the people's struggle become more overt and less "constitutional." Their former shams and smokescreens become less veiled and their efforts at deception, minimal. The pretext at "justice for all" has been dropped. Constitutional fascism is on the wane. Deception and justification are no longer necessary. Pigs from Head Hog Hoover (F. B. I.) down to your local rent-a-pig are running amuck.

Well you still say you're free? The Chicago "Conspiracy" trial was a fascist arena dedicated to the destruction of the Constitutional rights of Black people. Fascism appeared with chains and gags. Chains to keep a man from moving, gags to keep a man from speaking, and they say this is America, land of the free. To be beaten for trying to use your constitutional rights, to ask for legal counsel (a lawyer) of your choice and be denied is not freedom. We can clearly see that this capitalist system refuses to let Black people determine their will and destiny. The constitution of the U.S. abolished slavery only on paper, disregarding practice. Dred Scott in 1857 was a slave in Mississippi, and later taken to Missouri, a free state. Dred Scott brought suit in federal court for his freedom. Supreme court justice Taney replied: "Black people have no rights that white people are bound to respect." Scott was returned to slavery because of the fugitive slave law. Bobby Seale, Chairman of the Black Panther Party was kidnapped off the streets of Berkeley and transported to Chicago to stand trial. Also related to the Dred Scott case. Bobby had spoken at the Democratic Convention about fascism and returned to the West coast to continue the struggle. He was then kidnapped from Berkeley, (like a fugitive slave), thrown in a car and taken to Chicago by car. The trip took a week; through this ordeal Bobby was subjected to abusive treatment and thrown into various rat-infested jails along the route. Bobby's health became bad. All of this was done without the protection of his Attorney, Charles Garry. Upon arriving in Chicago, Bobby was thrown into the cesspool of hate, Cook County Jail. It was clearly shown throughout the trial that racist war monger Judge Hoffman would s -- t on the rights of a Black man. Charles Garry had asked war monger Hoffman for a continuance (delay) in the starting of the trial, so that he would be able to defend Bobby. The delay was because of his own illness here in San Francisco. This was denied; therefore Bobby was brought to trial without counsel. Without protection from this arena of fascism. Bobby then moved to secure his constitutional rights by demanding an attorney of his choice. The pig judge decided that attorney Kunstler (attorney for the other seven defendants) was to be Bobby's lawyer, Bobby refused his counsel and moved to defend himself. Bobby began to try to cross examine witnesses. He was told to sit down. He tried over and over again, for five weeks, to be able to use his right to be his own counsel. Fascism went from words and paper to chains and gags and beatings. The symbol of all that Black people hate sat on the bench and tried to auction off the freedom and survival of Black people. The trial in Chicago was one of slave master trying a slave. We clearly see that Bobby Seale had been denied his rights guaranteed to him by the Supreme court in the 1st, 4th, 6th, 8th, 13th, 14th amendment to the constitution. And then to be sentenced to four years (for contempt of court), without a lawyer, without a jury and without a trial, is an obvious attempt to silence dissent and scare Black people. In the process of the court trials Bobby Seale's constitutional right of free speech, (the first amendment) was violated. The 4th amendment of the constitution was violated, the right that requires federal officers to have a warrant to arrest a person. The 6th amendment to the constitution was violated: his right to legal defense, to counsel of his choice was violated. The basic constitutional tenant that deals with Black people has been violated and that's the 13th amendment that "allegedly" abolished slavery. The 14th amendment was violated, his right to due process of law -- to guarantee him the rights of the constitution.

The Black Panther Party is a mirror that reflects the needs and desires of Black people. What is happening to the Party is happening to the people. The murders of Bobby Hutton, Bunchy, John, Fred Hampton and many others are also happening to the people. Brothers and sisters in the streets are shot down daily. Brothers and sisters are denied human rights not to mention civil rights. Bobby is an example for the world to see. A Black man who has been denied his constitutional rights, beaten, chained and gagged in a U.S. courtroom like a slave who spoke of freedom. Dred Scott of 1969. Bobby as well as many political prisoners is being subjected to the most fascist, racist tactics that this capitalistic, racist country has to offer.

If any man is denied the right to be what be wants to be or say what he wants to say, then he's not free. The only difference between slavery four hundred years ago and slavery now, is that it's more advanced and sophisticated today. The pigs made a mistake thinking that they could silence the Chairman by gagging him. Because what happened in that courtroom, shouted to the ears of the world.

And now Babylon's oppressive ruling class has taken one more regressive, reactionary step backwards, this time a step back into the 17th century. The reactionaries have raised their fascist curtain on a 17th century New England witch hunt ---- New Haven 1969. Moving to an even higher level than the Reichstag, or the Chicago farce, the New Haven witch hunt is barring all reporters and even artists (for sketches) from the trial. Taking a page from the Salem witch hunts, no demonstrators are allowed within 500 yds. of the courtroom. The better to maintain the `purity' of the hangman. It is as if these reactionaries and their tools, lying lackeys (like George Sams) are trying to exorcise themselves of what they consider evil (like serving the people, eradicating capitalism, racism, and imperialism). In the days of the New England witch hunts lunatics and idiots were used to take innocent lives, as reliable witnesses and repentant informers.

Hoffman used terror, open terror with federal marshals running amuck in his courtroom, ordering Bobby to be drugged, beaten, bound and gagged. One can imagine what medieval tortures are planned for the New Haven Inquisition with no media present, and lunatic pig informers for witnesses.

Presently Bobby is being held in S.F. County Jail, where he has been beaten, choked, and left in a filthy, crap infested hole. He is awaiting extradition to Connecticut. The New Haven witch hunters and their Reagan disneyland fascists are co-operating to the fullest extent. New Haven authorities have already received assurance from piglet Ronald `Mickey Mouse' Reagan that Bobby (the runaway slave, another Dred Scott), will be extradited as quickly as possible. In further co-operative moves the New Haven authorities have refused to allow Bobby's presence at his OWN extradition hearing in Sacramento, California, further barring him from speaking in his own defense.

So this is it, fascism 1969. Amerikkkan style. Complete usurpation of the rights of Black men to free trial, and legal counsel of their choice. Cruel and unusual punishment inflicted, treated as a slave, no rights for niggers (or any oppressed peoples) which White men, (capitalist, imperialist, warmongering, vulturistic, fascist White men), are bound to respect. The reactionary ruling class waging a last ditch stand against the Vanguard of the revolutionary movement in Babylon and against you, THE PEOPLE. "So what is there to talk about?" Nothing but fascism, U.S.A., and the need for freedom of all oppressed peoples, for the liberation of the people's warriors.

PRESS STATEMENT: NEW HAVEN CHAPTER B.P.P.

The threat by every type of local to FBI to CIA policeman- pig -- including the so-called Justice Department to destroy through any means the Black Panther Party in a final fascist attempt to destroy the people's just struggle for liberation and basic change in the society has become more overt in recent months. Our Chairman, Bobby Seale, has been shuffled through the racist, fascist court of senile Judge Julius Hoffman. He was then transferred to San Francisco to be incarcerated, brutally choked and beaten and thrown into a medieval dungeon, jokingly called `solitary confinement.'

In the past year, also, over 12 Panthers have been murdered by this same collective corps of vigilantes; and over 200 men and women of the Black Panther Party have been thrown into the various and sundry jails of this country on any type of trumpedup charge that could be found. However, the last two days have indicated the trend of these madmen to be even more overt in their program to eliminate the Black Panther Party in particular, and the spirit of the people to bring about change, in general. Last Wednesday December 3rd, our Chief of Staff, David Hilliard, was captured by secret service night riders and held for a ransom of $30,000 dollars. On the absurd charge of "threatening the life of the President of the U.S."

David Hilliard is one of the last remaining members of the leading body of the Black Panther Party who has not been killed, forced into exile or sentenced to a forever period in some jail. As such David Hilliard has helped guide our Party and the People to the correct path to liberation. David Hilliard has always exposed this racist, capitalist, fascist system everywhere he has been without hesitation. In other words, exposed the truth. And it is for these reasons and no others that he in particular was thus kidnapped. However, it must be stressed that recently our Party made it known that through the efforts of our Minister of Information, Eldridge Cleaver, we have been able to negotiate and exchange Prisoners of War held by the Vietnamese for the freedom of Huey Newton and Bobby Seale. Such negotiations have placed the power of Black people in Babylon on an international level, linking us with the just liberation struggles of the peoples of the world. Henry Cabot Lodge in a year couldn't even negotiate the exchange of a peanut. Therefore it is interesting to note that it is at this time in history that Chief of Staff, David Hilliard, was arrested, after having made a speech at an anti-Vietnam War demonstration last November. Specifically, David said that we would kill anyone who stood in the way of our liberation, including Nixon. It must be remembered that niggers. Black people in the ghetto, speak a language that is part of the jargon of the streets, our vernacular. Just as one reads any statement made in books, magazines, newspapers or speech and understands it in that context, this statement must also be understood in that way. As long as Black people in the 20th Century have lived in the ghettoes of Babylon, we've made such general statements. Only racists, fascists, and fools can't see that.

In addition to the incarceration of our Chief of Staff, on Dec. 4th in the early morning our Deputy Chairman of the Illinois Chapter, Fred Hampton, and another brother from the Peoria Branch, Mark Clark, were viciously murdered in a clear Nazi, KKK style. The holocaust brought down upon the home of Deputy Chairman Fred, occupied also by his eight month pregnant wife and others was beyond description. Fred and Mark were alseep, they were asleep in the privacy of their home, when agents of fascism, disguised by riding in a Bell Telephone Co. truck, attacked their home with outlawed weapons namely, Thompson sub machine guns. These cowards surrounded Deputy Chairman Fred's house, and in true SS style burst through the doors and emptied their war weapons. Fred Hampton never got out of bed; Mark Clark never got out of bed. Several women and other men were wounded. The blood of these young revolutionaries was spilled everywhere. There had been no knock at the door there had been no notice of a warrant for some trumpted-up charge. There had been nothing but gangster-land raid on the private home of one of our hardest working brothers and leaders.

Finally - these attacks and arrests will not, as they have not, destroyed either the Black Panther Party, nor the will of the people, of all oppressed people; to be free and to get that liberation any way we can. They only make us stronger and know that we are going in the correct direction. They only expose to the People for us, the fascist nature of this decadent society. All we can say is to quote our Minister of Information, Eldridge Cleaver, We shall have our manhood. We shall have it, or the earth will be leveled by our attempts to gain it.

TO THE PEOPLE AND ALL POLITICAL PRISONERS

From the time we were incarcerated up to this very day, we have witnessed and heard of the most brutal treatment of political prisoners and the constant heightening of the fascist tactics in the streets of America. It is hard to explain what we particularly face, because we are the victims, here at Niantic, of a subtle fascism nevertheless, we feel the chains, we hear the "Seig Heils" and the oinks.

We know that Landon, Lonnie McLucas and Rory are not being fed-we saw the controlled media's verson of our Chairman's trial; we know that he was choked and beaten. We know that Frances Carter, who gave birth on November 12th, to Che Alprentice Carter, was not allowed to bring her baby back from the hospital for fear that she would educate the other women here, who have babies. We saw the inadequate medical care she was subjected to while she was pregnant and after she delivered. We know that Rose Smith, when she gives birth, will not be able to bring her baby back and when she comes back to this hole, she will have to fight to regain her health.

We are aware of all this and more we are aware that the courtroom we sit in everyday is convened for the purpose of wiping out the Black Panther Party through press smears, through dehumanization, through various counter-revolutionary elements. We are aware this judge, "Palmer-Hoffman", and all judges are the remnants of judicial bulls -- t, shuffling closer to death each day and all the while digging the graves for all of the ruling circles of America to fall into.

We realize that with this trial, the system, in its frantic efforts to kill us (in all ways), is using a very old tactic, divide and conquer, with all the defendants thrown all over Connecticut and throughout the country but we will not be cowed, we will not bow to their psyches, we will not allow them to break our will, our determination to see the People rise.

THEY CAN ARREST US, THEY CAN KILL US. THEY CAN CHOKE US, THEY CAN TAKE OUR BABIES THEY CAN STARVE US - BUT THEY CANNOT STOP THE STRUGGLE… We can see it coming and coming fast, because the line of demarcation is being drawn even more clearly and the lying politicians, the greedy businessmen and the fascist troops are siding and the People are coming closer together, like fingers on a gigantic fist, that will smash the mall And WE KNOW that fist includes all those babies they keep snatching away from us - all of them - when they learn that their mommies and daddies have been taken, they will turn their anger into rebellion and this rebellion can be turned into revolutionary struggle and we will fight from one generation to the next.

But, you out there, the people, you who have the streets to walk on and lives to give must refuse to let these insane pigs, lackies and fools surround you and kill your strength and your revolutionary spirit.

And you, the Political Prisoners, must realize that the only way to gain freedom is to take it. "POWER IS THE ABILITY TO DEFINE PHENOMENA AND MAKE IT ACT IN A DESIRED MANNER." We know we won't get justice in the courts F -- k the courts and every foul, feeble, fascist faggot in them. We realize that whether we are on the streets or in the jails that the jackboot of oppression is on our necks - we can't ask it off, we can't pray it off, we can't talk it off, we can't send peace vibrations through it - we have to force it off. The people in Vietnam are doing it, the people in Algiers have done it, the people of Korea continue to do it and historical materialism shows that we MUST do it.

There's no time for comrades to be sitting in detention camps, biding time. There's work to be done. There's no time for the people to be tolerating the everyday intimidations and murders they are subjected to: REALIZE, ORGANIZE, RISE!

So much can be said - but words are just words, "the best way of telling, is doing!"

Statement From: CHAIRMAN AND EXEC SECRETARY, OF THE COMMUNIST PARTY OF ILLINOIS

The assassination of Illinois Black Panther Party leader Fred Hampton and of Mark Clark in a pre-dawn raid today by the police under a search order of the State's Attorney's office is a barbaric, racist, anti-working class act of extermination to wipe out political opposition and dissent.

It can be likened only to the Nazi concentration camp racist death ovens and to the bestial racist search and destroy operations in Vietnam typified by the extermination of My Lai Village. It is still another warning that the police powers of the state are being mobilized for an all-out genocidal, fascist assault on the ghettos and against all political opposition and dissent -- all in the name of "law and order."

This is no isolated atrocity. It is a pattern which goes back to the assassinations of President John F. Kennedy, Dr. Martin Luther King, and Malcolm X. It calls to mind Mayor Daley's "Shoot to Kill" order of 1968 and the ill-disguised threats lurking behind recent Agnew-Nixon speeches. It recalls the physical silencing-by-gag of Black Panther leader Bobby Seale as a defendant in a federal court of law. It reminds us that Black Panther Party, peace and other leaders of opposition and dissent have been and are being harassed, persecuted and held under exhorbitant bail, as in the case of the Chicago "Conspiracy" trial. The murder of Fred Hampton and Mark Clark was preceded by the police murder of four Black Panther activists in recent months, and by the police raid on the home of three Black Panther leaders here just two days earlier.

It is a pattern of the physical silencing and annihilation of political opposition and dissent. This is the meaning of the Nixon-Agnew "law and order" program.

If not stopped here and now, it will surely spread to all peace movements and activists; to all Black freedom movements and activists to all student movements and activists; to all labor leaders and shop stewards who militantly defend the interests of the working class; to all forces of independent political action.

It is meant to intimidate every labor leader and shop steward from waging the fight against the profit-bloated, war-tax fattened corporations and the Nixon Administration anti-labor, planned hunger program; to set the stage for an all-out attack against trade unions to forestall a fight for higher wages and better working conditions for 3 1/2 million workers whose contracts expire in 1970. The injunction limiting picketing at the Chicago Hotpoint-GE plant is a long step in that direction.

The immediate target of this murderous conspiracy, in which the Bill of Rights is being pled underfoot, is the Black Panther Party, a militant champion of Black-White unity for the progress of Black and White working people in our country. Defense of the Constitutional rights of the Black Panther Party has become the first line of defense of democracy for all and to halt the advance of fascism in the USA today.

We call on all workers, Black and White, on all unions and peoples' organizations, including the state and county AFL-CIO, on all democratic-minded people, to immediately wire or write President Nixon, your congressman, Governor Ogilvie and Mayor Daley, to demand:

1. An immediate halt to the persecution and extermination drive against the Black Panther Party;

2. An immediate Congressional investigation into the conspiracy to exterminate the Black Panther party;

3. A declaration by President Nixon calling a halt to all methods of violence and assassination, of harassment and frame-ups, in dealling with political opposition and dissent; and bringing the full power of the federal government to bare to prosecute and imprison any and all public officials or police who authorize or use these Nazi methods in USA;

4. The police shall be put under the control of the communities they are supposed to serve;

5. A complete, immediate investigation of the assassination of Fred Hampton and Mark Clark and the full prosecution of those responsible;

6. Free the "Conspiracy Eight;" quash the Chicago frame-up trial.

We call on all unions and organizations to appeal to the United Nations for an investigation into the genocidal practices evident in My Lai and other atrocities in Vietnam and in these genocidal assassinations directed against the Black, Puerto Rican, Chicano and American people in the ghettos and reservations of the United States -- all in violation of UN policies to which the United States government is a party.

We call for a campaign of mass protest and indignation in every form open to the American people. The time to prevent fascism is NOW.

Seeing that the two of you have been imprisoned on some framed-up charges clearly shows the people here in Babylon and throughout the world that the fascist pigs are running amuck like a pack of mad dogs near their doom.

Fascism is becoming more rampant in this country because U.S. Imperialisim is being smashed abroad and that capitalism here is dying because history has moved to a point where they can no longer exist.

Whether your struggle is in jail with other brothers who are victims of this racist and oppressive system or in the community, you will always have the support of millions of oppressed people who are also fighting a common enemy, U.S. Imperialism abroad and fascism at home.

The teachings of Huey P. Newton is a far superior weapon to any thing the pigs can produce. This is what the pigs fear most of all and this is why they would like to see us all in jail even though it would not do them any good because the teachings of Huey P. Newton has already reached the people and its practice has shown the people that all pigs are a bunch of punks and paper tigers. And it is possible to destroy all of them when they get in the way of our freedom.

I want to also, say just keep on getting stronger everyday because we will free all prisoners by any means necessary. Especially political prisoners who we know are the most wanted men by these criminals who run this fascist country. All these reactionary pigs, whether they appear as the news media, the avaricious businessmen or any other type of pig, they are on the verge of extinction from history no matter how they wish to distort the struggle.

So I'd like to finish by saying that you will all have the support of the people because all oppressed people in the world want complete liberation and the will to determine their own destiny.

OPEN LETTER: TO THE SILENT MAJORITY

The American public is now tasting the bitter grapes of Nixon's law and order! The recent massacre of over five-hundred Vietnamese in the village of Songmy, most of them unarmed women, children, and old men. The threat of censorship of T.V. and the press by two of Nixon's stooges is just a sample of what happens when large numbers of any society is not concerned with the basic human rights of all of its members and the lives of other human beings. As a consequence of your apathy, there will be more massacres abroad by U.S. imperialists and more repression at home in Babylong. Soon you will not receive even the half truths and information you now get from the government controlled news media.

America's jails are filled with people who love peace and freedom. History has shown that the next step is the concentration camp. If a large body of people allow a smaller group of people to suffer under a government and if the freedom and justice of that smaller group of people is violated because they are Black, Brown, Red, or Yellow, or wear their hair long, then the larger body of people tolerate, uphold and perpetrate fascism. The fascists in this country have concentration camps ready for use. When these fascists take off their thin veil of democracy they will try to enslave the whole of America and not just the non-White communities.

Racism is just a tool of fascism. The fascists pit one group against another so that all can be exploited.

Get hip to this, silent majority (i.e. White middle class Americans) genocide, atrocities, assassinations, and political imprisonments are being committed in your name, and have been done in your name since the beginning of this country's history (enslavement of Black people, extermination of the Indians, Hiroshima, etc.). Complacency is complicity. No man's freedom is safe while another's is being violated. Remember the Third Reich.

Finally, silent majority, Black people will not let you stand idly by and watch the revolt against oppression. As Eldridge says, "Either you will be part of the problem or you will be part of the solution" (to the problem).

THE SPIRIT OF THE PEOPLE

Through their spirit and moral support the people have shown that they will no longer remain silent and watch this racist, decadent society and its supporters railroad brothers and sisters off to some pig pen for the rest of their life.

It was this spirit that brought the people out in support of the Panther 21's trial, Monday. November 17, and in protest of the fascist courts and the racist dogs who control and run the courts of injustice.

However, as it turned out, through much vacillation from the pig judge and the pig D.A., there was no trial. The judge and pig Hogan oinked about a new 30-count indictment against the Panther 21. More ridiculous charges were added to the original 12-count indictment. The new trumped up charges are; conspiracy to blow up subway switching-control rooms and possession of rifles, pistols and bombs. Also, another person has fallen victim of the pigs injustice. He is now on the pigs' slaughter list, along with the Panther 21.

The Panther 21 were again denied the lowering of bail by the fascist racist pig judge. We see this as being outright racism. Just a couple of weeks ago, four White persons were arrested for setting off bombs in eight corporate and governmental structures, and their bail was reduced from $50,000 to $20,000 while 21 brothers and sisters are still being held on $100,000 ransom. Also, racism showed its ugly face among the Black supporters and the White spectators who attended the `trial'. Black people were searched by the pig flunkies (the court officers) while Whites were admitted into the court without being searched. The Panther 21 are being denied their Constitutional rights just as Chairman Bobby is being denied his Consitutional rights. Chairman Bobby has set the proper example for us. Chairman Bobby has said that, "If I am continuously denied my constitutional right of legal defense, counsel of my choice who is effective, by the judge of this court, then I can only see Judge Hoffman as a blatant racist of the U.S. court with gross prejudicial error toward all defendants and myself in particular." And we see the pig judge of the N.Y. State Supreme Court as being "a white-haired" racist just as Judge Hoffman in Chicago and all the racist judges across this decadent country. And we say that, THE OPPRESSOR HAS NO RIGHTS WHICH THE OPPRESSED ARE BOUND TO RESPECT."

Life under the present system is a threat to all revolutionary Parties and revolutionary people in particular. We are subject to fascist attacks at any given time or place by the capitalist aggressor and his running dogs. OFF-DUTY PIG ATTACKS TEXAS CO-ED

Dallas (LNS) -- An off-duty pig from University Park, Tex., attacked a 19-year old co-ed during a sociology class at El Centro Junior College recently. The attack occurred after the pig made bigoted comments in response to the lecture being given by a Black instructor. The co-ed, Charity Cowart, angrily said: "You know, you're acting just like what they call you -- a pig.' He beat her with his fists. The incident was the talk of the campus, but there were no charges and nary a word in the press.

SEATTLE CHAPTER BEGINS SIDNEY MILLER FREE MEDICAL CLINIC

Monday, December 1, marked the opening of the Sidney Miller Free Medical Clinic. The clinic was named in honor of comrade Miller who was savagely murdered in a West Seattle supermarket, November 7, 1968 by a racist capitalist store manager. The clinic is located on 20th and Spruce (173-20th) in the heart of the Black community, and will serve the basic health and medical needs of the people in the community. We know that the working masses cannot afford the high medical and medical insurance costs now imposed by the present hospitals and local doctors, who are known by the people to be notorious butchers on poor and oppressed people (i.e., the jokingly called county hospitals which are located in the Black and oppressed area where patients are made to wait seven and eight hours before given medical assistance).

Prior to the opening of the clinic, announcements via mass media, leaflets and community meetings flooded the community basically concerning the need for volunteers As a result the community has been very responsive which has attributed to the present fourteen volunteers and several more community people who have voiced interest in donating their time to the clinic.

Also many druggists in the area have made commitments to supply the medical clinic with the necessary pharmaceutical products.

The clinic will be opened Mondays and Thursdays from 5:30 to 9:00 p.m. with doctors on call seven days a week in the event of emergency cases.

In addition to our Health Clinic, and the operation of two Breakfast for School Children Programs (in which two more are being planned, making a total of four Breakfast Programs) we are now in the process of starting two new projects. One will be a Free Clothing Program which will serve the clothing needs of people in the community. The second will be the opening of a Liberation School which will be held in the waiting rooms of the Medical Clinic when it is not in operation.

We must serve the needs and desires of the people, because we are the oxen to be ridden by the people. In order to educate the people adequately about how to go about their survival it is necessary to plan physical programs in which their needs are served.

WE HAVE ACHIEVED A GREAT DEAL IN OUR WORK

The Black Panther Party has shown through its practice that, you do not fight racism with racisms, but you fight racism with solidarity and the proof of this work is starting to show. We see a different change in the basic attitude of Black people. A few years back when a Black person was asked what they thought about White revolutionaries, the response would be to the effect that there is no such thing. Today a lot of skepticism exists, but there is a basic change because now they will say, "show me one or yeah, there are a few". What is more important is that Black people recognize that white revolutionaries can exist, because of political situations here in Babylon.

Now the pigs of the power struc-have moved to attack the very essence of the peoples' movement (solidarity), by trying to throw racism into the game, by trying to make political moves seem racist when actually they are only set up to create racism within the movement and perpetuate racism with the masses.

We have seen since the beginning of the year a gross difference between the punishment and treatment of progressive and revolutionary Whites and that of the Black counterparts. The case of the Oakland "7", of the Brooklyn College "19", where Blacks and Whites were together in solidarity, yet when the pigs vamped they made sure that only Black students were victims of this fascist frame-up. We must also keep in mind Chicago and the trial of the conspiracy "8", where our Chairman was treated in the most inhumane fashion, we see again the White defendants were not faced with those indignities. Then there is the case of the Panther 21, charged with trumped up lies of conspiracy to blow up department stores, railways and the botanical gardens and we have seen the Panther 21 remain in jail on $100,000 ransom unconstitutionally for 8 months, now we see a group of White revolutionaries arrested and charged with the act of blowing up buildings "PROPERTY DESTRUCTION". Their ransom was set at $500,000 but was reduced within three days to $15,000 and now they are all out on bail. Many of us, when we compared the cases of the Black revolutionaries to those of the White revolutionaries, we call the courts decision racist.

But when we get down to the essence of this s -- t when we check out the historical roots of these dual standards, when we come to see that racism has existed in Babylon ever since the Pilgrims raped the Red man. As we check out the economic development of the people of this nation, and we see that this nation industrialized rapidly and at a very early age and we take note that the workers were struggling constantly for a better life, and we see the full weight of their protest of their anger was never felt, because industries were divided by ethnic groups and these groups were always at odds with each other, because of the manipulation of the power structure. There has always been disunity of the working people, because of the power structure's ability to keep a certain level of ethnic antagonism (racism) going. This is the same problem that the movement failed to see for years.

It wasn't until 1966, when two niggers, Huey P. Newton and Bobby Seale got together some functional machinery, "The Black Panther Party", to deal with this problem of racism to define it and put it in it's proper place.

Capitalism in Babylon is and has always depended on racism, the tool that divides the working class. Now that evil mad dog Nixon is moving to force racism into the very movement that is going forth to smash it, because he understands that a working class that is united against capitalism and racism, the two components of fascism, is a deadly threat to his existence and the existence of his bosses, the vulturistic businessmen. And checking out all of that, it is very easy for us to see the desperate need the power structure has to spread racism into the movement and the method the pigs are using is treating progressive Whites as misguided children, while treating Black people in the usual f -- ed up slavish manner. The purpose of this is to have Black people respond to progressive Whites as some group that the power structure doesn't fear, so so that Black people will feel that White revolutionaries are just doing their thing because of adolescent frustration or some other silly s -- t that takes away from the very fact that America is a fascist state and not only Black people see it, and are willing to do something about it. By this, the pigs hope to split the people and their movement, thus hoping to have us fight amongst ourselves, instead of uniting under the banner of proletarian (workers) solidarity and dealing with our true enemies, "the pigs of the power structure".

This new fascist tactic was introduced by none other than Richard the "chicken hunter" Nixon, his ace henchmen, John Himmler Mitchell and the rest of the square commode. Nixon, we understand the flendishness of all your mad s -- t. You are a PIG, the lowest dog to crawl the earth since its inception, you have ordered these moves in the courtrooms across Babylon to cause distrust of our White revolutionary brothers and sisters. You have tried to use the racism that already exists in society to destroy the movement with cold calculated political moves, that are designed to deceive the masses of people into believing that these acts are used to perpetuate racism and create distrust.

The Richard `Hoghouse' Nixon administration in its last desperate struggle against the revolutionary forces has tried to use the words of Chairman Mao against the people.

"I hold that it is bad as far as we are concerned if a person, a political party, an army or a school is not attacked by the enemy, for that case it would definitely mean that we have sunk to the level of the enemy. It is good if we are attacked by the enemy, since it proves that we have drawn a clear line of demarcation between the enemy and ourselves. It is still better if the enemy attacks us wildly and paints us as utterly black and without a single virtue: it demonstrates that we have not only drawn a clear line of demarcation between the enemy and ourselves, but achieved a great deal in our work". Red book, p. 15.

Dig it PIG, it won't work because the people are hip to your s -- t and the solidarity of oppressed people throughout the world will remain until the enemy is crushed completely and then the Black Panther Party will go to help create the most beautiful life for all humanity.

REPRESSION AGAINST THE VANGUARD PARTY

It has become increasingly clear to the people that this racist, capitalist government under fascist Dick Nixon and J. Edgar Hog intend to destroy the Black Panther Party by any means available. Our Chief of Staff, David Hilliard expressed this very clearly when he stated that "their intentions are to imprison, to murder and silence the voice of the Party that speaks in the idiom of the suffering and exploited masses.' J. Edgar Hog oinked to his pig boss "Fascist Dick" and to the people that the Black Panther Party represented the most serious threat to the security of this country. This is the statement that gave his murdering dogs another "greenlight" to imprison and to murder the revolutionaries who refuse to stay on their knees and accept the bulls -- t that the pigs are rendering to the people, Black people in particular. We say another "greenlight" because these racist motherf -- kers of this pig power structure have always had greenlights to murder Panthers and call it "justifiable homicide."

The fascist frame-ups began when the pigs jailed Huey P. Newton on trumped-up charges after they failed in their attempt to murder him. Then came the assassination of Li'l Bobby, Bunch John and on and on. Eldridge was forced to leave Babylon to avoid a sure death. Chairman Bobby was recaptured as a runaway slave in Aug. of 69. The most recent attacks occurred on Nov. 27th, when Emory Douglas the Minister of Culture, his wife, sister Judy Douglas, and Field Marshal D.C. were harassed in Paris, France by chief pig Pompideau (Nixon's fascist bedfellow). On Dec. 3, the fascist dogs arrested Chief of Staff, David Hilliard, for a so-called threat on Fascist Dick's life. A few hours later the racist motherf -- kers from pig Daley's stormtroopers vamped on Deputy Chairman Fred Hampton's house with Thompson machine guns and murdered Mark Clark and Fred Hampton. The facts have been shown to prove that Comrade Fred was murdered while lying in bed asleep. After murdering Mark and Fred, these murdering dogs had the audacity to claim that they were attacked. This is very indicative of a pig, because we say that "a pig is a low-natured beast who masquerades as a victim of an unprovoked attack."

The Black Panther Party has come under more repression than any other revolutionary political organization in the history of Babylon. The mass media plays a part in this repression because the mass media disseminates bulls -- t to the people -- BULLS -- T that keeps the masses confused. The government controlled news media refuses to expose the true nature of these barbaric beasts that fascist Dick Nixon and J. Edgar Hog have unleashed on the Black Panther Party. The Black Panther Party cannot fight fascism alone, this is a people's struggle. I think that we should pay close attention and act on what Eldridge said because his statement articulates the present-day situation to the utmost. Eldridge said "That the destiny of the world lies in the hands of the American people that whatever way America goes the world will go. If America goes into fascism openly for everybody, then the whole world can forget it. I think it is our duty to ourselves, to posterity and to the whole idea of civilization to run ourselves to death to avert a probable catastrophe."

The police murder of two Black Panther leaders in Chicago and the imprisonment of David Hilliard in San Francisco are the latest instances of the systematic repression of the Black Panther Party and the liquidation of its leadership by the Government in its attempts to silence all protest against the present political order. The Board of Directors of Berkeley Neighborhood Legal Services supports the Black Panther Party in their efforts for liberation of the Black and all oppressed people of this country. We are frightened and angered by the concentrated attack on the Black Panther Party for the "crime" of fighting for equality, dignity and self determination.

The Board of Directors of the Berkeley Neighborhood Legal Services calls for an end to the systematic repression of Black liberation groups. Consistent with that end we call for:

1. The dismissal of the four year sentence of Bobby Seale;

2. The release of Huey Newton;

3. The release of David Hilliard;

4. The arrest of the Chicago police who killed Fred Hampton and Mark Clark;

5. Amnesty for Eldridge Cleaver.

We call on all members of the community to support these demands and there by reclaim freedom and the power to determine the destiny of all our lives.

BLACK PANTHER PARTY SOLIDARITY COMMITTEE

Dear Comrades:

This is only to inform you quickly about our demonstrations in Frankfurt on November 15. More about our work to help create solidarity with the Black Panther Party in our next letter.

November 15 was the date of anti-imperialist demonstrations all over West Germany the largest demonstrations took place in Berlin with more than 10,000 participants and in Frankfurt where more than 4,000 took part. In Frankfurt preceding agitation and teach-ins concentrated on information about the internal situation of the U.S.; we tried to show what structures of a late capitalist society make possible (and necessary) to lead a war like the war in Vietnam, and we tried to show what internal resistance there is to such a society of exploitation and repression.

For more than a month our agitation had paralleled a Frankfurt conspiracy trial (against three well-known brothers for the demonstrations at the Frankfurt Book Fair 1968) with the Chicago trial of the "Chicago 8". The same scene in Frankfurt and Chicago; the right of the people to assemble suppressed, "impartial" courts establishing "evidence" through pig informers, agents, and infiltrators. There were differences, though: we were still allowed to argue politically in front of the court. This "liberality" came to an end at an exemplary point: the Frankfurt morning press had published a picture of Bobby Seale chained and gagged at the Chicago trial; when the Frankfurt conspiracy court resumed session that day, the accused and the whole audience got up with clenched fist, shouting: "Struggle against political trials! Free Bobby Seale!" Immediately, the court used riot police to clear the room, and when "order" was restored, sentenced the accused for "contempt of court".

Till the next day in court the information reached us about Bobby Seale being sentenced to four years in jail for contempt of court. The first response was an attack of more than 150 people against the Frankfurt U.S. Consulate General; 28 huge windows were shattered, the wall painted with "Free Bobby Seale!"; when the pigs arrived, no one was there any more. The next session of the court, with immense coverage by the press, we had almost every one in the audience bring posters with Bobby Seale's picture. When the court entered, all of a sudden the whole court was full of banderoles, posters, clenched fists and slogans. The photograph of the bench with Bobby Seale posters went through the whole German press.

On November 15 besides slogans of support for the revolutionary struggle of the Vietnamese people, agitation against repression in the U.S., and the U.S. Army in West Germany were important. The first block of the demonstration carried white flags with a Black Panther, there were more than 50 pickets with "Free Bobby Seale" - posters. The police tried to break up the demonstration, but small groups went all over town to agitate and to attack; Chase Manhattan, USIS, American Express, Consulate General, and the court were the main targets. Altogether, the police announced, some 50,000 dollar damage was created against the imperialist institutions. More important: for the first time, American GIs participated in the demonstration (even though many had been restricted to base) and when a part of the demonstration reached the American Gutleut Kaserne, GIs were waving out of their windows, giving the clenched fist salute, responding to the "Free! Free Bobby Seale!" slogans. Soon the officers would order the GIs, to close the windows.

The next day, the police chief of Frankfurt announced that they consider preventative ban on demonstrations against the war in Vietnam, also they would have to figure out new ways to stop the American "allies" from being bothered.

New demonstrations have been, announced by SDS for December 13. And the "allies" will be bothered. A coffee house has started for American GIs in Frankfurt. GIs are putting out an undergroundpaper. Agitation at universities, schools and in the factories has been taken up.

BSU or BSU

This article does not pertain to all BSU's. There are some functional BSU's that are working in the interest of the people and serving the masses. But for those of you who do not function in this manner, then it is advisable that you read this article very carefully; accept the criticism and act in a desired manner.

You call yourself a BSU, a Black Student Union. You are supposed to be the official voice of the Black students on the campus. Your policies are supposed to be in the best interest of the students. In short, you are supposed to be a serious-mined politically-oriented body of Black students, but from several observations, I have been unable to see you fill the qualifications of a BSU.

I also call you a BSU, a Bull S -- tters Unlimited. This evaluation is made because you deal strictly in cliquism, rhetoric, and other types of Bull S -- t. Instead of dealing with problems which face the majority of the student population, the Black student population in particular, you sit around in your little meetings and pass "heavy" policies. More often than not your "heavy" policies are nothing more than flunkism, trying to import another campus' policies to your own campus, not realizing that yours is not the other campus, that you have a completely different set of conditions.

As far as being representative of Black population, you fall far out of line. In your meetings your leaders demand the utmost in respect. Yet, when a member, especially one not in the clique tries to say something you don't give him the same respect. Listening to what he has to say, thinking about what he said. And as far as serious-mindness goes, 5 years ago, Black college students wore the Quo Vadis and played cards on campus, today you are wearing naturals and playing cards, in the BSU meetings, that is when you do not play other little games or gossiping about who's f -- king who.

So as you can see, you're a long way from becoming a Black Student's Union. In order to become a real BSU, you're going to have to become a serious group of politicians, (I don't mean Black racists or cultural nationalists) and begin to work for the people, earnestly, on and off campus, Until you do this, you will still be a Bull S -- tters Unlimited.

THE SLAVE TAKES THE HEAD OF THE SLAVEMASTER

Greetings Comrades,
All Power to the People's struggle. For our struggle is a just struggle, one in which we have been trying to free ourselves ever since the first slaveship arrived here on the shores of Babylon, bringing cargoes of thousands and thousands of human beings, from a far away land, to a new land against their will, to be murdered, brutalized, terrorized, dehumanized, explotted and thus, mass genocide. These people I speak of is none other than the broad masses of Black toilers.

It should be known, that according to the laws of mankind, every nation of people on the face of this earth, have the right to be free, the right to determining their own destinies. Therefore, we have every right there is to rise up in arms and free ourselves from this present state of bondage. We have in no way asked for these conditions they have been forced upon us against our will, and our only out is "revolution", a people's war, an insurrection, an act of violence, in which the slave takes the head of the slavemaster. This is the only way we will be able to obtain total freedom, there must be blood shed. Imperialist America has been running rampant ever since the purchase of Alaska by Steward, in the year of 1867, for $7,200,000. This was the begining of America's imperialist role. Steward became greedy for land and other countries and islands were seized with the gun, Hawaii Somoa, Venezuela, Cuba, Puerto Rico, the Phillipines, Panama, Santa Domingo, Halti Nicaragua and Mexico, but only for a short spell. Troops landed on Vera Cruz these troops were American marines killing in the neighborhood of two hundred Mexican women and children. WHOLESALE SLAUGHTER! America today has not changed at all. In Vietnam mass genocide is being committed by the U.S. Right here on the home front, genocide is being committed against those who speak of freedom.

We as revolutionaries must always remember that freedom will only come after great sacrifices have been made (Fred Hampton, Bunchy, John, etc.) It is a must that we condition our mind and body so as to enable us to brave the storm. We have had much courage, and we must continue to be courageous. The masses are relying on us, and as revolutionaries it is our sworn duty not to fail them. As a member of the Black Panther Party, I owe my allegiance to the broad masses of oppressed people and to the Party, and to no other. Therefore whatever the masses and the Party decide upon that is in the interest of the people, for their demand, I will struggle till the death, and all revolutionaries must feel likewise. wherever or whomever one maybe. Comrades, wherever death may surprise us, let it be welcome, provided that this our battle cry reach one receptive ear, and another arm stretch out to tear down the walls of capitalism, making way for the bright future of SOCIALISM.

Pigs Attack Southern California Chapter Of Black Panther Party

Monday, December , at approximately a.m., the Los Angeles Pig Department launched a full scale attack against the Southern California Chapter of the Black Panther Party. In a of pre-dawn raids, 24 Panthers were arrested, in an attempt to wipe out the Black Panther Party in Los Angeles.

The people of the Central community had the opportunity to see, first-hand, open fascists as the pigs attacks were not confined only to the Black Panther Party. Many interested citizens were beats, arrested and denied access to their homes, as the pigs had blockaded the area off, for a radius of four square blocks.

At 334 W. 55th St., the pigs demanded to a Panther with a warrant for the arrest of Ebner "G" Pratt, and Paul Redd. In the home at that time, were two brothers, three sisters and two children. The pigs kicked down the door, and shot into the house, and arrested everyone, including the two children.

The Walter "Toure" Pope Community Center, located at 1100 1/2 Exposition, was the scene of the tear gassing and brutal beating of four Panthers. As each Panther exited the Center, he was subjected to a beating that left one brother minus some of his teeth, another brother with a badly sprained wrist and multiple bruises, and a sister with possible broken ribs. None of the injured were given any medical attention. Witnesses from the community were subjected to the same type of treatment, as a result of their concern and interest for the servants of the people inside of the building.

The pigs topped all of this however, with their assault on the Central Headquarters, at 4115 S. Central Ave., approximately 300-400 pigs were amassed, at what the pigs thought would make complete, the genocide of the Black Panther Party in Los Angeles. Under the same presense that was used at all of the other locations (the issuing of warrants), the fascist troops attempted to gain to the building. Examples of the manitions that the pigs used in the raid were tear gas, shotguns, revolvers, hi-powered rifles, grenade launchers and even a tank was kept in-waiting.

A battle that lasted from 5:00 a.m. to approximately 10:15 a.m., left the pigs a bit shaken in their former expectations. They had expected to just run off into the office and kill everyone inside. But the warriors of the people waged a battle that lasted almost six hours, resulting in the wounding of three pigs -- one wounded critically. The Panthers sustained minimal injuries, as only three people were wounded ( critically), and the other casualties were a result of tear gas, and flying glass. Truly, the "spirit of the people" was in these courageous warriors, as it took almost 400 fascist, stormtrooping pigs to "subdue" eleven Black Panthers.

The people witnessed an excellent lesson in political education that day. They saw what the power of the people was all about. They saw that the "spirit of the people is greater than the man's technology." Those pigs threw everything that they had into that office, and still not one Panther died.

The correct example has been set. The Panthers defended their property, and only decided to letup on the pigs, when the objective conditions were no longer favorable. You see, the pigs had started to bring in their tank, and were setting detonating charges to the building.

The Black Panther Party has once again demonstrated that it is the Vanguard of the struggle for the liberation of oppressed people in this country: and the support that the Vanguard deserves, must be given.

"I arrived at 7:15 a.m. at 43rd the roof of the Panthers' Head-and Central in company with the quarters. We also heard automatic Rev. James Donaldson. We were positioned in such a way as to look up the street to see the Panther Headquarters.

The area was heavily patrolled by police on motorcycles, patrol cars and unmarked cars with plain clothesmen.

We were present because we wanted to observe the actions of the LAPD, the Panthers, and the community so we could reach our own conclusions and interpret the events to others in the White community. We had the use of binoculars so that we could observe close-up.

Several policemen told us that we could not move down the street to 42nd Pl. They had no badges or identification tags on them. They told us that if we did not like the way they were operating, we should go to another country.

About 9:45 or 10:00 a.m., there was a tremendous fire-fight with the police, by their own admission, using shotguns, revolvers and shaped charges. At least two chargers were used to blow holes in weapons fire.

My emotional reaction to the above events was not fear but rage at the illegal and immoral actions of the LAPD and its overt attack on the Panthers. This, for me, was a confirmation of the numerous reports of brutality, oppression and harassment which I have heard from neighbors, congregants and friends."

There were about 50 police (LAPD) on the scene. Without giving due legal warning of any sort half of the police moved upon half of the crowd across Central bandishing billyclubs, not giving the crowd a chance to peacefully disassemble. Policemen then lined the street in front of the crowd I was in. They, likewise, gave no legal declarations, Upon the word of one officer the rest ran to the crowd and began to club members chasing them as they attempted to flee. I saw them using their clubs as offensive tools much as cavemen did to their prey. I saw at least four people repeatedly chased and beaten. I then fled. The measures used by the police were very obviously geared not towards control, but antagonism."

At 11:00 a.m., four of us, three women and myself, were walking on Vernon W. of Central when we were called back by three cops and told that we could not move towards Central. There was no blockade, there was no reason to stop us. They would not let us continue on even though we were walking towards the car. Finally one of them grabbed Charlotte Conn and tried to push her back and said that we had given them trouble at Jefferson & Central, where we were just watching the atrocities. This was the same cop that said to Judy "Today isn't the day to get your Blackman for your White cont. After meeting the cop in a yelling match, he let me go get the car and pick up the three women. I am sure that two of the three women I was with were pushed by the cop and reasoning given was that we had given them trouble. They treated two of the women roughly, but would not touch me."

People's Health vs L.A.P.D.

I do not think anyone is unaware of the flagrant violations of health rights suffered by the Black Panthers at the hands of the Police but a documented report concerning events of December 6 to December 8 in Los Angeles might be worth reporting.

On Saturday night, December 6 between 7 and 8 p.m. George "Duck" Smith walked outside the Party office on 41st and Central in Los Angeles. And was shot (suffering from either a powder burn or graze wound of the head) and was knocked unconscious with a gun butt, by a plain clothes LAPD. He was then subsequently dragged down the block to an awaiting group of police and arrested for some minor offense. He received absolutely no medical attention and could not even be located by lawyers until noon on Sunday. At that time, several doctors and nurses went to Central jail and demanded to see the prisoner.

We were informed he "did not request medical attention" and were refused admission. Twenty minutes later we were called back and told he had just been seen by a prison doctor and did not need any attention. He told his lawyer that he had not received any medical attention and did request to see me - still permission was refused. "Duck" obviously suffered at least a concussion-and possible severe bleeding within the skull.

It would be impossible to adequately evaluate the damage with a very brief examination. This brother needed, and was entitled to complete X rays (never done) and at least 24 hour observation in a hospital. The fact that he was refused these basic human rights is evidence of the complete disregard by the LAPD of any human concern for prisoners.

After the events of the morning of December 8 (elsewhere described, although really an indescribeable atrocity of calculated genocide) seven of those arrested were seriously wounded. Four ended up in the jail ward at LA County General Hospital, although two with bullet wounds were not thoroughly examined for several hours. Tommye Williams, Roland Freeman and Wayne Pharr all suffered multiple bullet wounds but did very well. Albert Armor seffered multiple sprains and bruises and did well. He had severe trauma to the right eye-it seems unlikely this was inflicted "accidentally."

Sharon Williams, suffering from severe kidney disease, was deprived of her needed water pills and held in Sybil Brand Women's Facility without medical attention for at least 12 hours. And it was only after much pressure from Health groups that we were promised she would be sent to LACGH. She is believed to have been suffering from fractured ribs during all of this time without medical attention or pain medicine.

One of the arrested sisters had a miscarriage during the attack on the office and received only cursory medical attention in jail, not in the hospital.

One Brother was severely beaten and kept in jail without medical attention for at least 24 hours.

The above is a factual report of just a few instances of repression taking priority over very basic health rights..

These facts speak for themselves, and really need no political analysis to show what the priorities of this system are. A Black Panther Free Clinic is planned and work has begun to set this up in L.A. We will continue this work and take every possible opportunity to better health care for the People and point out how priorities must be changed and second rate health care for Black and working people must stop.

HUEY'S APPEAL

Part 14

EDITOR'S NOTE:

The following article is taken from the appeal prepared by the attorneys defending Huey P. Newton, Minister of Defences of the Black Panther Party. Huey's attorneys have moved to have the case reviewed by the Court of Appeals of the State of California. The Black Panther News Paper will print the appeal in part -- every week to give the people all the facts as to why Huey P. Newton should be set free immediately.

2. THE FAILURE OF THE TRIAL COURT TO REOPEN THE TRIAL AND RECEIVE THIS NEWLY DISCOVERED EVIDENCE WAS PREJUDICIAL ERROR.

Subsequent to defendant's motion to re-open the trial, supported by the declarations of Garry, Keating and Hoffman, the trial court listened to the original dictabelt of Grie's statement and to a tape recording amplifying it (R.T. 3790-93). The trial court then determined that the word was "didn't" (R.T. , ).

Denying the motion to re-open, the trial court instead ordered the typed statement be re-typed changing the word "did" to "didn't," and ordered the re-typed statement introduced into evidence and submitted to the jury without any indication that the change had been made and in no way drawing any attention to the document (R.T. 3765, 3604). The trial court squarely violated the provisions of section 1:38 of the Penal Code, and said refusal to re-open was prejudicial error.

In People v. Henderson, 4 Cal. 2d 185 (1935), conviction (for contributing to the delinquency of a minor by giving her intoxicating liquor) was reversed because when the jury requested the reading of testimony concerning the time the left the defendant's store. From the re-reading there were a few lines of testimony of a witness who established that the complainant's time after she left the store was not accounted for. There was no question of willful or other suppression of evidence by the prosecution but only of failure to read testimony which had actually been heard by the jury. In reversing, the court said (4 Cal. 2d at 194):

"Who can say that the jury, in their five-hour deliberation, might not have reached an opposite conclusion had they had the benefit of having reread to them that which they requested, to wit; all of the testimony touching the element of time, particularly the time that complainant left defendant's store."

Who can say that in their four-day deliberation herein the jurors might not have reached a different conclusion if Grier had been further discredited?

Whether or not the jury reviewed or noticed the change in the Grier transcript (and the record establishes that the jury did not the change, R.T. 3845), defendant was entitled to a communication to the jury in open court and to argument and further cross-examination of Grier and, at the very least, to argument before the jury on the fact and implications of the change from "did" to "didn't." See People v. Alcaide, 24 Cal. 2d 177 (1944), and People v. Winkel-specht, 237 C.A. 2d 227 at 230-231 (1965)

The trial court gave as its major reason for refusing to re-open the trial the fact that the defendant testified he was in fact at the scene of the incident (R.T. 3785). This had no bearing on the materiality of the newly discovered evidence, the defendant never admitted and vigorously and consistently denied tussling or wrestling with Frey. Grier testified at the trial that the man he saw reaching into his shirt for a gun was tussling or wrestling with Frey just prior to reaching for the gun. The defendant denied having a gun or firing one at or Frey. The defendant testified that Frey made him lean over Frey's police car while Frey searched the defendant (R.T. 3124). This was corroborated by the witness Tommy Miller, the passenger on Grier's but (R.T. 2758), but Grier said nothing about this.

The discrepancy between Miller's testimony, corroborating the defendant's testimony as to what happened seconds before the shooting, and Grier's trial testimony as to the assailant's tussling with Frey before shooting him, makes critical the newly discovered evidence that Grier never saw the face of the assailant. The early "didn't see the fact" then puts into doubt the entire story about the assailant and the tussle as it relates to the defendant; it suggests that another Man may have been tussling and wrestling with Frey, perhaps after Frey shot the defendant.

The descriptions of the assailant given by Grier in his early statement and at the trial, when he was sure it was the defendant, differed in many particulars, all set forth, supra. These discrepancies make the newly discovered "didn't (see the face)" more, not less, material. The discrepancies between the defendant's account and Grier's account can be explained by the absence of information concerning other persons in the area, the activities of after he "blacked out," the activities of the passenger, as well as by rejection of Grier's trial testimony in the particulars in which it differed from his early statement. Had the Jurors known of the Grier discrepancy, kept from them by the method employed by the trial court, they might have turned more attention to these other sources of explanation, including lines of inquiry which tended toward complete of the defendant of any part of the killing of Frey.

The trial should have been re-opened, and failure to do so must compet reversal here.

E. The Trial Court Contributed to the Highly Charged. Emotional Atmosphere of the Trial and Courtroom, and Arbitrarily Abused its Discretion in Numerous Prejudicial Rulings Adverse to Defendant.

1. EMOTIONAL, CHARGED ATMOSPHERE OF THE TRIAL AND COURTROOM.

The trial court denied several motions for mistrial based upon the atmosphere of the courtroom, and the court itself contributed to the highly charged, emotional and, at times, racist atmosphere of the trial, ordering great numbers of armed deputies into the courthouse and at the entrance to the courtroom, and ordering personal searches of persons entering the courtroom (R.T. 9, 10, 1702, 1336, 20, 2345) (47)

47. The trial court severely limited the number of persons who could altered the trial, ordering it to be had in one of the smallest courtrooms in the Courthouse, denying defendant's pre-trial motion to move the trial to a larger courtroom adequate to seat the relevant public (C.T. 183). The courtroom contained 62 seats, of which approximately 21 seats were permanently assigned to the press (Id.). Varying numbers of deputies occupied, from time to time, several of the remaining 41 seats.

The constitutional requirement of a public trial is for the benefit of the accused, and the meaning of the term "public trial" depends largely upon the circumstances of each particular case. People v. Terry, 99 C.A. 2d 579, 584 (1950). People v. Dock, 46 C. A. 2d 558, 562 (1941). The circumstances here, where hundreds of persons desired to attend the trial and waited daily in long lines to do so, required that the trial be moved, under California Constitution Article 1, Section 13.

END FOOTNOTE

The atmosphere was continually suggestive of an armed police state. It frequently approached the hysterical, due to the excess of uniformed personnel, their technical equipment, manner, and the resultant oppressive tension. In this atmosphere defense counsel received death and torture threats; motions for mistrial based on these facts were denied (R.T. 1327, 1334, 2746, 2750). As much as the atmosphere brought about by the publicity and behavior of mass media representatives in the courtroom and courthouse where Dr. Samuel Sheppard was tried, the atmosphere permitted and in part created by the trial court here diverted the trial from the "calmness and of the courtroom" which the Supreme Court held an essential part of due process of law in Sheppard v. Maxwell, 384 U.S. 333, 16 S. Ct. 1507 (1986).

2. DISSEMINATION OF PUBLICITY ADVERSE TO DEFENDANT BY GOVERNMENTAL AUTHORITIES

Commencing at the time of the arrest of defendant and continuing up to and during the trial, various governmental authorities of Oakland and Alameda County issued highly dramatized and inflammatory statements to the press and various media of the area relative to the "threats" and dangers posed by the Black Panther Party. On April 25, 1958, a few weeks prior to the time the trial was scheduled to begin, Oakland Police Chief Charles Gain called a press conference, which included all the major radio and television stations in the entire northern part of California and all the news media (C.T. 107).

At this news conference, Chief Gain villified and attacked the Black Panthers and their defense counsel for approximately forty minutes. Gain was presented in the television media in person, and his statements were carried throughout the State of California. (C.T. 108, and see Exhibit I, "Gain: Panthers Area "Threat" Oakland Tribune, a newspaper of general circulation, April 25, 1968; C.T. 110-112; Exhibit II, "Oakland Chief Fires Broadside at Panthers and Their Attorney." Berkeley Dally Gazette, Friday, April 26, 1968; C.T. 113-14, Exhibit III, "E Bay Police Chief Angry at Panthers," San Francisco Examiner, April 25, 1968; C.T. 115; Exhibit IV. "Oakland Chief Attacks the Panthers," San Francisco Chronicle, April 26, 1968; C.T. 116; Exhibit V. "Mayor's Statement Regarding Police," Oakland Tribune, April 28, 1968, C.T. 117.)

On Saturday, May 4, 1968, at 12:50 a.m., at the special instigation and demand of Chief Gain, he appeared on the Joey Bishop Show, nationwide, on American Broadcasting Company's Channel Saves, at which time he attacked the Black Panther Party and many specific Black Panther Party members (C.T. 108)

On May 18, 1968, the Oakland Tribune reported that the Oakland Police Department had given medals to Officers Heanes and Frey in ceremonies in the Police Administration Building auditorium (C.T. 120). The defendant was identified as "Minister of Defense" of the Black Panthers, and the lead sentence of the article referred to "the gun-fights with members of the Black Panther Party." (Id.) The awards were presented during a recognition program that climaxed National Police Week (Id.).

The day before the twelve trial jurors were sworn, Oakland's Mayor Reading issued widely reported statements accusing the Panthers of "extremist pressure on Blacks," stating that, "The polarized Black vs. White society predicted by the President's Commission on Civil Disorders has come to Oakland several years early," blamed the absence of "reconciliation" on Black militants, etc. (R.T. 1329-35, Defendant's Preliminary Hearing Exhibit ). The Mayor stated that the Black Panther demand for decentralized neighborhood police stations would bring "utter chaos" and linked this to "increasing crime" (R.T. 1331)

On the day the trial began, the Berkeley Daily Gazette carried a lead article and photograph of the defendant with a gun on the front page (R.T. 1337-38, Defendant's Preliminary Hearing Exhibit K).

During the trial, the San Francisco Examiner, on August 13, 1968, published an article entitled. "Police Star for Garry Under Fire. Oakland's Officers How I" (R.T. 2342). The article stated, "Charles Garry, Attorney for Black Panther leader Huey P. Newton, is an bombary member of the San Francisco Police Department and has an $11.50 gold star to prove it. This bugs the Oakland Police Officers Association so much that five-point asterisks might best express the feeling in a family newspaper." The article further reported on a letter of protest sent to San Francisco police by the Oakland Police Officers Association, complaining that Garry "goes out of his way to make it look as though the police officers are always wrong." (R.T. 2343)

All motions for mistrial on grounds of these specific publications and additional adverse publicity were denied (see R.T. 1343, 2347).

The trial court's denial of motions for continuence (C.T. 101) and mistrial (cited, supra) on grounds of the prejudice caused by the wide and continual dissemination of this publicity by the governmental authorities of the City of Oakland were reversible error. Delaney, v. United States, 199 F.2d 107 (1st Cir. 1952). Irvin v. Dowd. supra, 366 U.S. 717, 81 S Ct. Maine v. Superior Court of Mendocino County, Cal. 2d 375 (1968).

In Delaney, the defendant moved for continuance of a trial for receiving bribes and making false certificates as a tax collector until the prejudicial effect of nationwide publicity of these charges and others as a result of open congressional subcommittee hearings wore off. The United States Court of Appeals held that the trial court's denial of this third motion for continuance was reversible error and further held that defendant's failure to apply for change of venue did not affect the right to continuance, as the right to apply for change of venue was given for defendant's benefit, and a defendant is not obligated to forego his constitutional right to impartial trial in the district wherein the offenses charged are alleged to have been committed.

In Maine, the California Supreme Court fashioned new remedies to assure that every defendant obtains a fair and impartial trial in the face of "…the serious constitutional issues arising out of prejudicial newspaper publicity which either caused or reflected widespread hostility to a defendant in the community" (68 Cal. 2d at ). In Maine, the Court, by a unanimous decision, granted a perempory writ of mandate to compel the Superior Court of Mendocino County to grant motions for a change of venue, when a lengthy continuance would have been inadequate to insure a fair trial, in the face of local community involvement in the prosecution and newspaper publicity.

In the instant case, although defendant that the problems of White racism in the White community required continuance, thorough study, changes in the selection processes and assurance of adequate representation of Black people, poor people, and other minority groups on the jury panel, defendant did not desire a change in venue and never claimed that the community was involved in the prejudicial publicity. Had the governmental authorities ceased dissemination of their publicity, a lengthy continuance, as suggested in Maine and in Delaney, would have remedied the effects of the publicity already issued.

The combination of the publicity and the atmosphere of the courtroom itself generated an atmosphere of hysteria, fear, and racial polarization in which a fair trial was impossible. See Irvin v. Dowd, supra, and Sheppard v. Maxwell, supra.

3. THE TRIAL COURT'S ERRONEOUS EXCLUSION OF EVIDENCE OFFERED BY DEFENDANT.

The trial court's refusal to hear the testimony of John Burton, Daniel Quinsones, Gus Daniels, Lum Harris and Eugene Brown constituted prejudicial error.

With respect to Burton, the elderly Negro longshoreman whom Frey mistreated, the court had already recognized that evidence of Frey's brutality and mistreatment of Black people was relevant and material, but the court simply abused its discretion and refused to admit Durton's testimony for no disceraible reason. Barton's testimony was not merely cumulative, because although numerous other Black persons had testified to Frey's actions in the ghetto, Burton was the only witness offered on this point who was a member of the elder generation. Defendant was entitled to show the entire range of Frey's actions, with respect not only to "militants," but toward middle-class, stable, adult community members, and the consistency of his insulting behavior to Negro children, youth, adults, and aged persons.

The testimony of as to treatment by Oakland Police officers of the defendant within a day following the incident was relevant and material as to the attitude and motive of the Oakland Police Department which clearly existed before the incident. Defendant had introduced evidence, much of it cross-examination of prosectuion witnesses, which established a continuing attitude toward the Panthers on the part of the Oakland police. Thus evidence of Oakland police threats and gestures made to Newton in his prison hospital bed was material to the reasonable inferences to be drawn from the defendant's testimony as to Frey's actual behavior towards him, and thus related to the credibility of both defendant and Officer . The actions, attitudes, behavior and statements of Oakland Police officers

within hours after defendant's arrest were, in fact, part of the res gestae, no less relevant to the facts in this case than the actions and statements of the defendant after the arrest, which the prosecution was permitted to introduce.

It is not easy to find civilian witnesses to police mistreatment of persons under their custody and control, and, when found, factors of fear often influence their decision as to whether or not to testify. Defendant was forced to project his theory of the case with respect to the Oakland Police Department's plan to eliminate and harm the Panthers almost entirely by cross-examination of hostile witnesses. What little actual evidence was available other than the testimony adduced through such cross-examination (e.g., the actual list of Panther vehicles circulated by the Oakland Police Department, Defendant's Exhibit A), supported the defense theory. The testimony of Quinones, who was, at the time he offered to testify, in the custody of the Alameda County Sheriff's Department at the county jail, would have been extremely important in substantiating this theory.

The offer of proof of the testimony of Daniels, Harris and Brown as to the prosecution's attempts to "pay well" for information in the case was clearly admissible under People v. Alcalde, supra, 24 Cal. 2d 177, 184-85; People v. Wong Chuey, 117 Cal. 624 (1897); 27 Cal. Jur., page 125; and see, also, Witkin, California Evidence (1966), section 1235, and cases therein cited.

It served no overriding state interest, to deny defendant the opportunity to present the testimony of the nation's most highly qualified experts on the factual questions of the partiality of the death-qualified jury, either by continuance for a few weeks, or by compensation to defense counsel that the witnesses might be deposed in the East, or by admitting their affidavits (R.T. 333-34). The ruling was particularly inopportune when the United States Supreme Court had a few weeks earlier refused to rule on the point because the evidence before it on the partiality of the death-qualified jury was too "tentative" and "fragmentary." Wither-spoon v. Illinois, supra, 391 U.S. at 517, 88S. Ct. at 1774.

It denied defendant equal protection and due process of law to thus prohibit him from establishing the complete evidentiary base demonstrating the unconstitutionality of a death-qualified jury, when the qualified experts, who had conducted the studies referred to by the United States Supreme Court, were willing to testify without fee within a month or so, or to be deposed or to travel, if compensated, at the time of the hearing on the motion to limit application of Penal Code section 1074.8.

As between defendant and the state, defendant should not have been required to finance a total demonstration of all the psychological and social science research undertaken in the United States on death-qualified juries. The showing defendant made with the testimony of Professors Zelsel and Sanford, and the willingness of such eminent scholars to travel and testify in this case, demonstrate the seriousness with which the defense addressed itself to issues currently before the court on these questions. Under the trial court's ruling, only a wealthy defendant can make a complete record. This is not the law under Griffin v. Illinois, 351 U.S. 12, 76 S.Ct. 585, supra, and recent expansion of equal protection guarantees.

THE BLACK ATHLETE AND DEMOCRACY U.S.A.: WILLIAM L. PATTERSON

In every school, on every campus across the country the Black athlete is entering the arena of politics. His honor demands it. The Black athlete also a student, moves to protect his dignity as a human being, his constitutional rights as a citizen, the honor and the unification of the nation. Money can't buy what the Black athlete is seeking. Athletic coaches, the dispensers of athlete scholar ships, the average sports writer, thinks that it can; they fool themselves. Nor can the emotional impact of the cheers from the stands ease the burden of pain from the racist contempt and insults which the Black athlete must daily accept and suffer.

In the interest of a democracy that will now traffic with racism, a humanism the educational system of this country has never known, in order to elevate his status as a personality, a social being not classified by the color of his skin, the Black athlete is demanding more than dollars for what he gives his school and country.

His prowess on the football field, on the tennis and basketball courts, his fame as a runner par excellent is to be found in every record book on sports. The Black athlete is a money maker for those who have made of athletes a business. But for them, for business, he remains a paid entertainer; that is his lot, his role, and for most of the country's leading bourgeois ideologists for the Black athlete to seek more than monetary returns is not in the interests of this form of government. "Irate Black athletes stir campus tension". That is a New York Times headline culled from the front page of The Times of Sunday. November 16, 1969. It is false. It is consciously misleading; it is a subtle form of racism. The news story goes on to say: "…aroused Black athletes in increasing numbers are gambling their principles against their education".

That, too, is false. The Black athlete defends principles without which there can only be miseducation. He defends principles that the White student must see, principles that in the class interests of the nation's bourgeoisie, the White student is being taught to mock.

The Black athlete's stand became, as a consequence, a fight against his own dehumanization and that of his White brother. The New York Times conceals that significant fact.
